Iowa, met in Regular Session at City Hall 00 p.m. on May 5, 1986. Mayor McKinley in Lichty, Wright, Angel, and Miller. Absent: Invocation by: Rev. Clive Cook, Kimball Avenue United Methodist Church. Pledge of Allegiance by: Montrice Burnside and Chad Holmes, Pack 9. 89134 - Moved by Seeber, seconded by Miller that the Agenda, as amended for the Regular Session of May 5, 1986 at 7:00 p.m., be accepted and approved. Motion carried. 89135 - Moved by Wright, seconded by Angel that the Minutes of the Regular Session held April 28, 1986, at 7:00 p.m., be approved. Motion carried. ORAL PRESENTATIONS 89136 - Darlene Jarosh, 633 Reber Avenue, represented neighborhood residents opposed to the variance granted by the Board of Adjustment for property located at 600 Reber Street (action taken on April 22, 1986: Case No. 289). She stated that the property formerly was the location of Buehler's Meat Market and now will be the site of an auto parts store. She stated that the neighorhood is primarily residential in nature and with the location of the auto parts store at this location, traffic will increase and their property will be devalued. She stated that the neighbors were not given adequate opportunity to relate their opposition to the Board of Adjustment. The neighborhood understanding was that the grocery store was allowed to remain under the grandfather clause and if neighbors had been aware that another business could go into this location, they would have not bought homes in the area. Councilperson Seeber also reiterated his opposition to the decision of the Board of Adjustment. He suggested that the Council ask the Board of Adjustment to review their decision. City Attorney, Hugh Field, stated that the City on the behalf of the neighborhood may appeal the decision of the Board of Adjustment to the District Court. Recourse to a Board of Adjustment decision can only be through District Court. Councilperson Miller asked City staff whether or not other alternatives had been reviewed. Building Official, Jim Curran, reiterated the decision made by the Board of Adjustment. City Planner, Bob Stevenson, stated that according to the zoning ordinance, the Board of Adjustment was to determine whether or not the new use was equal in intensity to the former use. Moved by Seeber, seconded by Miller that the City write a letter to the Board of Adjustment asking that they reconsider their decision on the variance granted at 600 Reber Avenue. Ayes: Six. Moved by Seeber, seconded by Wright that communication from City Planner transmitting dwelling unit rental agreements for Geraldine Stillwell, 1215 South Hackett Road: Sara Erion, 2424 Ansborough Avenue and Joni and Scott Green, 2630 Ansborough Avenue (properties acquired by City in conjunction with Interstate Substitution Projects), be received, placed on file and "Resolution approving said agreements", be adopted. Resolution adopted and upon approval by Mayor assigned No. 1986-249. 89143 - Moved by Seeber, seconded by Wright that communication from City Planner transmitting Agreement No. 86-3-039 with Iowa Department of Transportation for Relocated U.S. 218, Project No. IX -218-7(69)--3P-07 (construction project and transfer of various streets in conjunction with Relocated U.S. 2.18), be received, placed on file and "Resolution approving said agreement", be adopted and Mayor and Clerk/Auditor instructed to execute same.
