The Council of the City of Waterloo, Iowa, met in Regular Session at City Hall
Council Chambers, Waterloo, Iowa, at 7:00 p.m. on December 1, 1986. Mayor
Pro Tem Jack Seeber in the Chair. Roll call: Budak, Lichty, Wright, Angel, Dowie,
and Miller.
Invocation by: Reverend Robert Langholz, Our Saviour's Lutheran Church.
Pledge of Allegiance.

that the Agenda, as proposed, for the Regular Session of December 8, 1986, at
7:00 p.m., be accepted and approved.
Motion carried.
89792 - Moved by Angel, seconded by Lichty
that the Minutes of the Regular Session held December 1, 1986 at 7:00 p.m. be
approved.
Motion carried.
HEARING
89793 - Moved by Wright, seconded by Angel
that proof of publication of notice of public hearing for special permit request of
Waterloo Metropolitan Transit Authority to place three (3) bus shelters on public
right-of-way as published in the Waterloo Courier on November 21, 1986, be received
and placed on file.
Motion carried.
89794 - HOLD NEARING --This being the time and place of public hearing, the Mayor Pro Ten
called for written and oral objections and there were none.

that the recommendation of the Planning, Programming and Zoning Commission be
received and placed on file.

that "Resolution approving special permit request of Waterloo Metropolitan Transit
Authority to place three (3) bus shelters on public right-of-way", be adopted.
Ayes: Seven.

that rules requiring ordinances to be considered and voted for passage at two prior
meetings, be suspended, and that the following ordinance be recorded as having been
considered and passed for the second and third times and now placed on its final
adoption. Ayes: Seven.

89805 - Moved by Wright, seconded by Miller
that "an Ordinance Amending the Traffic Code by Repealing Subsection (85d)
San Marnan Drive of Section 541, Increasing Speed Limits in Certain Areas; and
enacting in lieu thereof new Subsections (85d) and (85e) San Marnan Drive to
Section 541, Increasing Speed Limits in Certain Areas", be adopted. Ayes: Seven.
Ordinance adopted and upon approval by Mayor Pro Tem assigned Ordinance No. 3464.

that "an Ordinance amending the Traffic Code by repealing Subsection (17) Hammond
Avenue of Section 569, Truck Traffic Prohibited on Certain Streets; and by enacting
in lieu thereof a new Subsection (17) Hammond Avenue of Section 569, Truck Traffic
Prohibited on Certain Streets", be received, placed on file, passed and considered

UNFINISHED BUSINESS
89814 Gary DeBoer, operator of Foxy's Bar at 715 Sycamore Street, stated that he would be
willing to pay the City for the bar and sign an agreement that he would guarantee
that he would resell the property to the City when future development was prepared
to take place.
Councilperson Lichty and Councilperson Angel both stated that the petition
submitted against allowing Foxy's to continue to exist in the downtown Waterloo
area would not have a bearing on their vote in consideration of not renewing the
release for Foxy's Bar.
Councilperson Seeber stated that he would base his vote on the police record.
Councilperson Wright stated that it was again the recommendation of the Building
and Grounds Committee that the lease not be renewed beginning March 1, 1987.
Moved by Wright, seconded by Angel
that the petition from the downtown business owners, property owners, and other
concerned citizens of the City of Waterloo requesting that Foxy's Bar lease not be
extended and renewed be received, placed on file and "Resolution directing the
Mayor and City Clerk/Auditor not to renew the lease for Foxy's Bar at 715 Sycamore
Street beyond March 14, 1987", be adopted. Ayes: Six. Abstain: Lichty.
Resolution adopted and upon approval by Mayor assigned No. 1986-680.
