RESOLUTION NO. 2011-1005 RESOLUTION APPROVING ENCROACHMENT AGREEMENT WITH MDKJ INVESTMENTS, LLC AND DIRECTING EXECUTION OF SAID ENCROACHMENT AGREEMENT BY MAYOR. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, that the Encroachment Agreement dated October 17, 2011, to allow 2 feet of a frost footing for a proposed new building at 186 West 15th Street to encroach into a platted public alley adjacent to Lot 10 in Block 10 of Hayes' Addition, legally described as follows: Legal Description of 186 West 15th Street A survey of the Southeasterly 47 feet of Lot 9, and Lot 10, except the Southeasterly 57.15 feet of the Southwesterly 76.80 feet; and the Northeasterly 14.25 feet of the Southwesterly 91.05 feet of the Southeasterly 49.50 feet of Lot 10, all in Block 10 of Hayes' Addition to the town (now City) of Waterloo, Black Hawk County, State of Iowa. Le al Description of Encroachment Adjacent to 186 West 15 Street The Southwesterly 2 feet of the alley lying adjacent to Lot 10 in Block 10 of Hayes' Addition, all in the City of Waterloo, Black Hawk County, State of Iowa; by and between MDKJ Investments, LLC and the City of Waterloo, Iowa, be and the same is hereby approved, and the Mayor and City Clerk authorized to execute the same in behalf of the City of Waterloo, Iowa.
