City of Waterloo Public Records Request Policy
Statement of Policy
This policy is intended to implement the provisions of Iowa Code Chapter 22 by assisting
citizens requesting examination of public records and to employees in fulfilling those requests.
The goal is to facilitate broad access to public records and assure that responses to open records
requests are made appropriately and timely.
Parameters
The City of Waterloo is committed to the concept of open government exemplified by Iowa
Code Chapter 22. Records deemed confidential pursuant to Iowa Code Section 22.7, or other
applicable statutes, are not required to be released in response to a request. In addition, the City
of Waterloo is not required to permit access to data processing software developed by the City or
a nongovernment body and used by the City. Other portions of federal law may govern access to
public records. Any changes to Iowa Code Chapter 22 shall supersede provisions of this policy.
City Website
Many records (i.e., reports, budget information, agendas, minutes, resolutions, and ordinances)
are in the public domain and can be viewed and printed from the City's website at
www.cityofwaterlooiowa.com without submitting a request to access the records. Computers
with internet access are available at the Waterloo Public Library, located at 415 Commercial
Street.
Custodian of Records
For the purposes of this policy, Custodian means the person lawfully designated by the City to
act for the City in implementing Iowa Code Chapter 22. The Custodians are as follows:

The Custodian will coordinate the response to all requests and may designate an employee to
assist with completing a request. All employees and elected officials must immediately direct all
public records requests to the appropriate Custodian.
Making a Request for Public Records
Citizens may submit requests for access to public records in any format but are encouraged make
requests in writing using the City of Waterloo Public Records Request form (Exhibit B). Unless
otherwise required by law, anyone may make a request for public records without providing
identification, reason, or motive for the request. The custodian shall not require the physical
presence of a person requesting or receiving a copy of a public record.

Formatting Records
A record will be made available in the format in which it is readily accessible to the City,
provided the foi,uat is usable with commonly available data processing or database management
software. If the City chooses to provide the record in a different format for the requestor, the
City may charge the reasonable costs of any required processing, programming, or other work
required to produce the public record in the specific format in addition to any other actual costs
allowed.
Security of Record
No person, with exception of the Custodian, may search or remove any record from the City of
Waterloo's files or remove any record from city property. Examination of records will be
supervised by the Custodian or a designee.
Calculation of Fees and Amounts Due
The fee for document retrieval, review, and duplication will be calculated based on the following
criteria:
A. The cost to duplicate city records will be calculated based on fees set forth in the
Schedule of Fees (Exhibit A).
B. The Requestor will not be billed for the first fifteen minutes of labor for document
retrieval and review services.
C. The wage of the Custodian, designee, or any other employee used in document location,
identification, and duplication shall be itemized and billed in fifteen -minute increments.
D. The wage of the Custodian, designee, or any other employee reviewing the documents for
relevance or redactions due to confidentiality will be billed in fifteen -minute increments.
E. The time the Custodian, designee, or any other employee supervises the requester while
viewing documents will be billed in fifteen -minute increments.
F. Fifty percent of the estimated cost of a request shall be payable prior to comrnencing
work on a request. The Custodian must receive full payment prior to releasing the
requested documents.
G. The cost to copy records to a DVD/CD will be calculated as the cost of the document
plus the cost of the CD/DVD. Labor charges, if applicable, shall be in addition to this
cost.

Please be as specific as possible; include names, dates, document type, topic, resolution and ordinance
numbers, project names, sent and/or received emails, key search words, etc.
Iowa Code Chapter 22 gives every citizen the right to examine public records and to copy those
records unless the record is exempt according to provisions of said chapter. The City of
Waterloo staff should not be expected to abandon or neglect their regular public duties to
comply with record requests and thus need sufficient time to make and deliver any requested
information. If the requested material potentially contains confidential information or is
otherwise exempt from disclosure, additional time may be required for review and possible
redacting of the material. All requests will be processed in accordance with applicable
procedures and rules. Note: If a deposit is required, no work will begin on the request until
a deposit of 50% of the estimated cost is received.

Dear Mayor Hart:
I am writing you to express my support to save the canopy over the Fourth Street bridge in Downtown Waterloo and asking you to show
your support for repairing the canopy at the upcoming City Council meeting on Monday, February 13, 2017.
Not only does the canopy visually symbolize Downtown Waterloo and the business community and tourism interests, it's part of our
history. In Waterloo, we've been too quick to tear down structures that we think are blemishes to the community instead of investing the
money to repair the structure. This is exactly the case here.
From what I understand, the options are pay $850,000 to remove the canopy from the existing bridge (and there is no commitment from
the gaming commission to support this endeavor) or pay $750,000 and a matching $750,000 from the gaming commission to repair the
canopy. This results in an extra $100,000 cost to taxpayers, like me, to remove the structure and lose part of the history at the same
time.
Even if there was no cost savings for the taxpayer, I would be in favor of saving this iconic, important structure that's part of the
Waterloo landscape. I myself have purchased a small building in Downtown Waterloo to save it from potentially being demolished or
falling into further disrepair, so I have invested in this same kind of endeavor. Old structures like the buildings and bridges that continue
to be torn down in Waterloo represent a real loss to us as a community in cultural, economic and environmental terms. Culturally, we
lose our history and the rich legacy of our community and the generations before us who struggled to build it. Economically, there are
many impacts of tearing down structures that attract new businesses, who prefer older buildings to newer ones, and consumers and
tourists who are attracted by a dynamic and vibrant downtown. Environmentally, the process of building, tearing down and building new
is not a sustainable practice and represents a wasteful way of thinking. It's our job as citizens of this community to support it and
nurture its growth for future generations. We are but stewards.
Again, I ask you to show support to save and repair the canopy over the Fourth Street Bridge at the Waterloo City Council vote on
Monday, February 13, 2017.

Dear Mr. Mayor,
This letter expresses our opinion about the future of the 4th street bridge canopy here in Waterloo. We recognize
we live outside city limits but for the last 45 years, we have worked, gone to church, and done 95% of our
business in Waterloo so we do have feelings about this issue.
The canopy has been identified as being in very poor repair and is a receptacle for garbage and human
refuse/waste and is frankly not safe to be in. The cost to repair it is huge at 1.5 million even though half would
be covered by the grant from the Blackhawk County Gaming Association. That still leaves $750K to be covered
by the city of Waterloo for now. And we all know it will require costly repairs in the future also. So we offer the
following suggestions:
1. Redo the bridge similar to the 18th St. bridge —the lighting and rails are beautiful and the maintenance
would certainly be less costly.
2. Better yet —have a contest — invite Waterloo residents to submit ideas/plans for redoing the canopy in the
most aesthetic and economical manner You may be surprised at the ideas you receive! And offer a cool prize,
i.e. a trip, $1000, etc.
3. Use the money proposed for the canopy to help repair the Park Avenue bridge — a far better use of the
taxpayers' money.
In this day of shrinking dollars and increasing taxes public officials need to be accountable stewards of public
funds — while it is nice to have some of the " frills and fluff', you need to be realistic and spend dollars wisely.
We believe the suggestions above would help accomplish that purpose.
At the council meetings we attended you started them off with a prayer and we COMMEND you for doing
that—please continue to do so, as well as the fine job you are doing as mayor.

I think the focus for the city should be on the current budget and this project should be tabled before
another round of bids. In the early 1970s we had a business / hiring boom and with the increased
population, the tax base grew and the bridge may of made sense then, but not in todays environment.
In my 6 May email: "...On the current 4th Street Bridge restoration project, it is simpler and cheaper to
remove the bridge, delete the bridge photo from City of Waterloo advertising materials and replace it
with the Veterans Museum photo. Who wants a symbol of the past when the current administration
wants to move Waterloo forward...".
Why was the 4th street bridge initially constructed without a sidewalk?
What is the current usage? 10 persons per day? - 100 persons per day? or?
I assume that there are nearby cameras that can document actual usage.
In my 21 May email I thought that the US63 pedestrian bridge was not needed or used and therefore
a tunnel was not needed and that cost could be avoided: "...Could the city and/or the railroad install
cameras for 10 days or 2 weeks or a month +/- to document the actual usage rate on the pedestrian
bridge and document the improper usage by pedestrians on the railroad bridge right-of-way?...".
It has been stated that the Park Avenue bridge must be replaced soon, yet the city is focusing on a
little used pedestrian bridge.
I see that the Park Avenue could be easily converted to a pedestrian only bridge and the lifespan
extended for many decades while the lifespan of the canopy 4th Street pedestrian bridge can also be
extended for decades as -is.
Also the canopy bridge could be removed entirely and the 4th Street bridge be modified to be a single
lane, one-way bridge (Northbound into downtown) with a dedicated walkway / bike path section.
There appears to be no pressing need to redo this pedestrian bridge.
Also the Park Avenue bridge could be modified to be a single lane, one-way bridge (Southbound out
of downtown) with a dedicated walkway / bike path section.
As a council that is responsible to monitor and approve spending, please always rank the capital
projects and carefully consider both the Park Avenue bridge replacement plans and the pedestrian
bridge plans.
