RESOLUTION NO. 2017-192
RESOLUTION APPROVING AN ENCROACHMENT
AGREEMENT WITH BW GAS & CONVENIENCE REAL
ESTATE, LLC TO REPLACE A 10 FT X 4 FT SIGN CABINET
ON AN EXISTING 20 FT POLE THAT ENCROACHES 5.14 FT
INTO THE PUBLIC RIGHT-OF-WAY, LOCATED AT 1976
FRANKLIN STREET.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, that
the Encroachment Agreement, with BW Gas & Convenience Real Estate, LLC dated March 13,
2017, to replace a 10 ft. x 4 ft. sign cabinet on an existing 20 ft. pole that encroaches 5.14 ft. into
the public right-of-way, located at 1976 Franklin Street and legally described as follows:
LOTS 13 AND 14 IN BLOCK 4, IN COWIN'S SECOND ADDITION TO
WATERLOO, IOWA, EXCEPT THE SOUTH 44 FEET THEREOF AND IN
ROADWAY AND ALSO EXCEPT THAT PART THEREOF CONVEYED TO
THE STATE OF IOWA BY WARRANTY DEED RECORDED IN TOWN LOT
RECORD 372 AT PAGE 17 OF THE RECORDS OF BLACK HAWK
COUNTY, IOWA.
By and between BW Gas & Convenience Real Estate, LLC and the City of Waterloo,
Iowa, is hereby approved and the Mayor and City Clerk are authorized and directed to execute
said agreement on behalf of the City of Waterloo.
