RESOLUTION NO. 2017-207 RESOLUTION AUTHORIZING SALE AND CONVEYANCE OF 1003 LAFAYETTE STREET TO IOWA HEARTLAND HABITAT FOR HUMANITY, IN THE AMOUNT OF $130,000, AND AUTHORIZE THE MAYOR AND CITY CLERK TO EXECUTE ALL NECESSARY DOCUMENTS, AND RESCINDING RESOLUTION NO. 2017-127, ORIGINALLY APPROVED ON FEBRUARY 20, 2017. WHEREAS, the City of Waterloo, Iowa is the owner of real property in the City of Waterloo, Iowa, as describe below, and WHEREAS, an offer to purchase said real property in the sum of $130,000, has been made by Iowa Heartland Habitat for Humanity, and WHEREAS, a public hearing was held on March 20, 2017 at 5:30 p.m. in the Harold E. Getty Council Chambers, City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Iowa Heartland Habitat for Humanity, and WHEREAS, it is the opinion of this council that said sale and conveyance should be made as proposed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1. The following described real property, as fully described in the published notice in the Waterloo Courier on March 10, 2017 is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2. That the offer of Iowa Heartland Habitat for Humanity, to purchase real property for the sum of $130,000, is hereby accepted for real property described as follows: THE NORTHWESTERLY 101 FEET OF LOTS 7 AND 10 IN BLOCK 24, EXCEPT THE NORTHEASTERLY 35 FEET OF THE NORTHWESTERLY 50 FEET OF SAID LOT 7; ALL IN THE ORIGINAL PLAT ON THE EAST SIDE OF THE CEDAR RIVER IN THE CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA. 3. That the City of Waterloo, Iowa conveys said parcels of real property described above to Iowa Heartland Habitat for Humanity by deed. 4. That the Mayor and City Clerk are authorized and directed to execute said deed. 5. That the original of said quit claim deed, fully executed and acknowledged, is hereby approved and confirmed by this Council. 6. That the Community Development Department is authorized and directed to deliver said deed to Iowa Heartland Habitat for Humanity upon receipt of $130,000. BE IT FURTHER RESOLVED that Resolution No. 2017-127 be hereby rescinded in its entirety. PASSED AND ADOPTED this 20th day of March 2017. RESOLUTION NO. 2017-127 RESOLUTION AUTHORIZING SALE AND CONVEYANCE OF 1003 LAFAYETTE STREET TO KARINA VALDEZ, IN THE AMOUNT OF $130,000, AND AUTHORIZE THE MAYOR AND CITY CLERK TO EXECUTE SAID DOCUMENTS. WHEREAS, the City of Waterloo, Iowa is the owner of real property in the City of Waterloo, Iowa, as describe below, and WHEREAS, an offer to purchase said certain parcels of real property in the sum of $130,000, has been made by Karina Valdez, and WHEREAS, a public hearing was held on February 20, 2017 at 5:30 p.m. in the Harold E. Getty Council Chambers, City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Karina Valdez, and WHEREAS, it is the opinion of this council that said sale and conveyance should be made as proposed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1. That the offer of Karina Valdez, to purchase real property for the sum of $130,000, is hereby accepted for real property described as follows: THE NORTHWESTERLY 49 FEET OF THE SOUTHEASTERLY 98 FEET OF LOTS NOS. 7 AND 10 IN BLOCK 24 IN THE ORIGINAL PLAT ON THE EAST SIDE OF THE CEDAR RIVER IN THE CITY OF WATERLOO, BLACK HAWK COUNTY,IOWA. 3. That the City of Waterloo, Iowa conveys said parcels of real property described above to Karina Valdez by deed. 4. That the Mayor and City Clerk are authorized and directed to execute said deed. 5. That the original of said deed, fully executed and acknowledged, is hereby approved and confirmed by this Council. 6. That the City Attorney is authorized and directed to deliver said deed to Karina Valdez upon receipt of $130,000. PASSED AND ADOPTED this 20th day of February 2017.
