RESOLUTION NO. 2011-1131 RESOLUTION AUTHORIZING THE CONVEYANCE OF CITY-OWNED PROPERTY PROPERTY AND AUTHORIZING MAYOR AND CITY CLERK TO EXECUTE AND DELIVER DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, legally described as follows : The East 1722 feet of the North Half of the Northwest Quarter of Section 26, Township 88 North, Range 13 West of the 5th P.M. , Black Hawk County, Iowa, except the North 55 feet thereof (50 acres more or less) . WHEREAS, a public hearing was held on December 12, 2011, at 5: 30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, regarding the proposal to exchange and convey premises owned by the City of Waterloo, Iowa, for property owned by L and H Farms, Ltd. , and WHEREAS, an Offer to Exchange Agreement by and between L and H Farms, Ltd. , and the City of Waterloo, Iowa, transferring twenty-four and a half (24 . 5) acres of development property located at the southeast corner of the intersection of U. S. Highway 20 and Ansborough Avenue in exchange for said fifty (50) acres of City owned property, was approved by Resolution No. 2011-1130, and WHEREAS, it is the opinion of this Council that exchange and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on December 8, 2011, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2 . That the conveyance of City owned property in conjunction with said Exchange Agreement be and it is hereby accepted. 3 . That the City of Waterloo, Iowa, convey said parcels of real property to L and H Farms, Ltd. , by deed. 4 . That the Mayor and City Clerk are hereby authorized to execute and deliver deed to L and H Farms, Ltd. 5 . That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council. 6. That the City Clerk is authorized and directed to deliver said deed of conveyance to L and H Farms, Inc. , upon execution of said Exchange Agreement.
