HomeMy WebLinkAbout2010-824-9/13/20104' RESOLUTION NO. 2010-824 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF APPROXIMATELY 3,180 SQUARE FEET OF MAPLEWOOD STREET RIGHT-OF-WAY AT THE INTERSECTION OF MAPLEWOOD STREET AND RIVERSIDE DRIVE LOCATED DIRECTLY WEST AND ADJACENT TO 903 RIVERSIDE DRIVE FOR $1,633.00, PLUS COSTS, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcels of real property in the sum of $1,633.00, plus costs, has been made by Janet Kendall, and WHEREAS, a public hearing was held on September 13, 2010, at 5:30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Janet Kendall, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1. The following described real property, as fully described in the published notice in the Waterloo Courier on August 31, 2010, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2. That the offer of Janet Kendall to purchase real property for the sum of $1,633.00, and costs, be and it is hereby accepted for real property described below: Survey of Parcel "C" That part of Maplewood Street (f.k.a. Greenwood Avenue, f.k.a. Hawthorne Avenue) lying West of Block No. 36 in Auditor Rainbows Cedar River Plat No.2 in the City of Waterloo, Black Hawk County, Iowa, described as follows: Beginning at the Southwest corner of Lot No. 4 in said Block No. 36, point being a found 1"o.d. iron pipe; thence South 76°24' West a distance of 31.25 feet to the Southeast corner of Lot No.1 in Block No. 7 in Division "A" of Cedar River Park, point being a found rebar; thence along the East line of said Lot No.1 and its Northerly extension Due North a distance of 108.0 feet to the Westerly extension of the North line of Lot No. 4 in said Block No. 36, point being a set '-1 " rebar with license #16264; thence along said extension North 89°53' East a distance of 30.4 feet to the Northwest corner of said Lot No. 4, point being a set " rebar with license #16264; Resolution No. 2010-824 Page 2 thence along the West line of said Lot No. 4 Due South a distance of 100.7 feet to the point of beginning. Containing 3,170 sq. ft. Subject to easements, restrictions, covenants, ordinances and limited access provisions of record and not of record. Note: The West line of Lot No. 4 in said Block No. 36 is assumed to bear Due South for this description, all in the City of Waterloo, Black Hawk County, Iowa; for $1,633.00, plus costs, and subject to a utility easement retained over the entire area. 3. That the City of Waterloo, Iowa, convey said parcels of real property to Janet Kendall by deed. 4. That the Mayor and City Clerk are hereby authorized to execute and deliver deed to Janet Kendall. 5. That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council. 6. That the City Clerk is authorized and directed to deliver said deed of conveyance to Janet Kendall upon receipt of the sum of $1,633.00, and costs.
