AN ORDINANCE AMENDING ORDINANCE NO. 5079, AS
AMENDED, CITY OF WATERLOO ZONING ORDINANCE, BY
AMENDING THE OFFICIAL ZONING MAP REFERRED TO IN
SECTION 10-4-4, APPROVING A REQUEST BY CGA ENGINEERING
ON BEHALF OF BCS PROPERTIES, LLC AND GAC REAL ESTATE,
LLC FOR A REZONE OF APPROXIMATELY 17.92 ACRES FROM
"A-1" AGRICULTURAL DISTRICT AND "M -2,P" PLANNED
INDUSTRIAL DISTRICT TO "C-2" COMMERCIAL DISTRICT, FOR
THE PURPOSES OF DEVELOPING A COMMERCIAL SUBDIVISION,
LOCATED WEST OF 1850 WEST RIDGEWAY AVENUE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA
AS FOLLOWS:
Section 1. That the Official Zoning Map referred to in Section 10-4-4, Rezoning Certain
Property, of Ordinance no. 5079, as amended, City of Waterloo Zoning Ordinance, be amended to
rezone the property legally described as follows:
THAT PART OF THE SOUTHWEST 1/4 OF THE SOUTHWEST 1/4 OF SECTION 33,
TOWNSHIP 89 NORTH, RANGE 13 WEST OF THE 5TH P.M. 1N THE CITY OF
WATERLOO, IOWA LYING SOUTHEASTERLY AND EASTERLY OF U.S.
HIGHWAY NO. 63, EXCEPT THE SOUTH 50 FEET THEREOF CONVEYED FOR
STREET PURPOSES AND EXCEPT THAT PART DEEDED TO THE CITY OF
WATERLOO, IOWA IN 557 LD 80.
AND
A CERTAIN PARCEL OF LAND LOCATED IN THE SOUTHEAST 1/4 OF THE
SOUTHWEST 1/4 OF SECTION 33, TOWNSHIP 89 NORTH, RANGE 13 WEST OF
THE 5TH P.M., IN THE CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA AND
DESCRIBED AS PARCEL "J" AND RECORDED IN BOOK 332, PAGE 723 IN THE
OFFICE OF THE RECORDER, BLACK HAWK, COUNTY, IOWA, EXCEPT THE
SOUTH 275.00 FEET OF THE EAST 100.00 FEET OF SAID PARCEL "J". SUBJECT
TO EASEMENTS AND RESTRICTIONS OF RECORD, IF ANY.
now zoned on the Official Zoning Map of Waterloo, Iowa, approximately 17.92 acres generally
located west of 1850 West Ridgeway Avenue, as "A-1" Agricultural District, and "M -2,P" Planned
Industrial District be and the same is hereby rezoned as "C-2" Commercial District, as above
described.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF CITY OF
WATERLOO, STATE OF IOWA:
That the City Clerk is hereby authorized and directed to file a certified copy of this
ordinance with the Recorder of Black Hawk County, Iowa.
