Mr. Jacobs arrived at 4:59 p.m. Moved by Welper seconded by Schmitt that the Agenda, as proposed, be approved. Ayes: Six. Motion carried. An amendment to the Proposed Code Enforcement Changes were discussed. Dave Zellhoefer, City Attorney, provided an overview of the proposed code changes. Mr. Schmitt questioned if this only applies to weeds. Dave Zellhoefer confirmed. Mr. Schmitt questioned if this is in compliance with state code. Dave Zellhoefer confirmed that the changes are in compliance with state code. Mr. Schmitt questioned who is responsible for notifications when a nuisance exists. Dave Zellhoefer explained the process. Mr. Lind questioned if administrative fees will remain. Dave Zellhoefer explained that the continuance of administrative fees are still under review. Mr. Morrissey questioned, while looking at the attachment, if the items in red are being discussed at this time. Dave Zellhoefer clarified which item is being discussed. Kelley Felchle, City Clerk, clarified that anything in red, or that has been crossed out, is what is proposed. Mr. Morrissey commented that he would like to see the proposed changes move forward and read some of the changes. Dave Zellhoefer explained that a definition for chronic nuisance would be added in the future. Mr. Morrissey commented he thought the proposed changes that were attached would be what was to be moved to full council. Mr. Morrissey requested that the language for chronic nuisances be included in the change. Dave Zellhoefer stated that he was not aware that council had received the language on chronic nuisances and does not believe the suggested wording adequately defines a chronic nuisance. Mr. Schmitt asked if part of the proposal is to move the responsibility from one department to another. Dave Zellhoefer explained that previously sanitation had been taking care of these and is now being addressed by code enforcement. Mr. Schmitt questioned how they were originally covering this. Dave Zellhoefer explained that it was written in the city code a long time ago. Mr. Schmitt expressed concern for the amount of work on code enforcement. Ordinance Committee February 6, 2017 Page 2 Dave Zellhoefer explained that cutting down on the amount of notices will improve efficiency. Mr. Amos questioned if this is anticipated to increase the cost of contract mowing. Dave Zellhoefer confirmed that it may as it would cause properties to need to be mowed more often. Mr. Amos questioned if the properties are put on a schedule, could the contract costs increase going forward. Dave explained that getting the nuisance properties on a schedule, such as the right-of-ways and viaducts, it would eliminate the time and money it takes to get out all of the notices. Mr. Morrissey asked for confirmation that the mowing's would need to be done even without a schedule, as they are repeat offenders. Dave confirmed that to be so. Motioned by Mr. Welper, seconded by Lind to table the item for one week. Voice -vote — Ayes: Seven.
