RESOLUTION NO. 2017-326 RESOLUTION AUTHORIZING SALE AND CONVEYANCE OF A CERTAIN TRACT OF LAND KNOWN AS 525 EAST 4TH STREET (ALSO KNOWN AS 525 FRANKLIN STREET), IN THE AMOUNT OF $58,500.00 AND UP TO $2,000 IN CLOSING COSTS, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE NECESSARY DOCUMENTS. WHEREAS, the City of Waterloo, Iowa is the owner of real property in the City of Waterloo, Iowa, as describe below, and WHEREAS, an offer to purchase said certain parcels of real property in the amount of $58,500, plus up to $2,000 in closing costs has been made by First Presbyterian Church, Waterloo, Iowa, and WHEREAS, a public hearing was held on May 1, 2017 at 5:30 p.m. in the Harold E. Getty Council Chambers, City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to First Presbyterian Church, and WHEREAS, it is the opinion of this council that said sale and conveyance should be made as proposed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1. The following described real property, as fully described in the published notice in the Waterloo Courier on April 21, 2017 is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2. That the offer of First Presbyterian Church to purchase real property for the sum of $58,500, plus up to $2,000 in closing costs, is hereby accepted for real property described as follows: THAT THE SOUTHEASTERLY 95 FEET OF LOTS 8 AND 9, EXCEPT THAT PART OF SAID LOT 8 LYING EAST OF THEWEST LINE OF EAST FOURTH STREET DEEDED TO THE CITY OF WATERLOO, IA IN X TLD 485. A PART OF LOT 1 COMMENCING AT A POINT ON THE NORTHEASTERLY LINE OF SAID LOT 8 THAT IS 55 FEET SOUTHEASTERLY FROM THE MOST NORTHERLY CORNER OF SAID LOT 8; THENCE NORTHEASTERLY ALONG A LINE DRAWN AT RIGHT ANGLES TO THE NORTHEASTERLY LINE OF SAID LOT 8, 60 FEET; THENCE SOUTHEASTERLY ALONG A LINE THAT IS PARALLEL WITH THE NORTHEASTERLY LINE OF SAID LOT 8 TO THE WEST LINE OF EAST FOURTH STREET; THENCE SOUTH ALONG THE WEST LINE OF EAST FOURTH STREET TO THE NORTHEASTERLY LINE OF SAID LOT 8; THENCE NORTHWESTERLY ALONG THE NORTHEASTERLY LINE OF SAID LOT 8 TO THE POINT OF BEGINNING. ALL IN BLOCK 61 IN THE COOLEY ADDITION TO THE CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA. Resolution 2017-326 Page .2 3. That the City of Waterloo, Iowa conveys said parcels of real property described above to First Presbyterian Church, by deed. 4. That the Mayor and City Clerk are authorized and directed to execute said deed. 5. That the original of said deed, fully executed and acknowledged, is hereby approved and confirmed by this Council. 6. That the Community Planning and Development Director is authorized and directed to deliver said deed to the First Presbyterian Church upon receipt of $58,500 and closing costs.
