On this \J day of c I , 2015, this Agreement is made and entered into by and between
the City of Waterloo, Iowa (hereinafter "City") and Damir Brakic (hereinafter "Owner"), for and
in consideration of the mutual promises and covenants herein contained and for other good and
valuable consideration, the receipt and sufficiency of which are hereby acknowledged.
The terms of this Agreement are as follows:
1. The subject matter of this Agreement is:

MAYWOOD RD (NOW KNOWN AS OSAGE AVE) TH W TO BEG, Waterloo, Black Hawk
County, Iowa; locally known as 3105 Lafayette Street, Waterloo, Iowa, 50707.
2. The purpose of this Agreement is to grant permission, with conditions, to hard
surface/pave the parking (area between the northerly edge of Lafayette Street roadway and
property line) along the Lafayette Street side of subject commercial property, approximately 200
feet x 22 feet.
3. The Owner's purpose for hard surfacing/paving the parking is for beautification purposes,
and to improve drainage, and understands the area is not to be used for parking.
4. In consideration of the restriction for parking on the parking as per City
Traffic Code Sec. 273.16, the Owner agrees to refrain from parking on the parking with any
vehicle or trailer that is owned by the Owner, the Owner's employees, or the Owner's
customer(s) in compliance with the City Traffic Code.
5. The Owner's request to pave, and the concept construction plan to be used to complete
hard surfacing/ paving of the parking adjacent to the subject property shall be the plan submitted
by the Owner and attached hereto as Exhibit A. Surface material shall be a minimum of 2"
HMA (asphalt) or 4" PCC (concrete).
6. The contractor performing this work shall have a current Right Of Way Construction
Bond with the City of Waterloo, and shall obtain a driveway permit prior to construction. The
Owner understands that a driveway permit being issued does not permit its use as a driveway,
but is for record purposes regarding who performed the work and when it was constructed.

7. The words "NO PARKING ANYTIME", in block letters a minimum of 24" tall, shall be
painted on the paved area at a minimum of three (3) locations approximately equally spaced, and
maintained in a legible condition. In addition, a minimum of three (3) "No Parking Anytime"
signs shall be placed on private property near the property line along the Lafayette Street side,
and maintained in a legible condition.
8. The Owner understands he is subject to enforcement of this Agreement, and applicable
Codes and Ordinances, and will be issued citations for any violations thereof.
9. This is the entire agreement between the parties, and this Agreement shall not be in any
manner modified without the express written consent of both parties.
10. This Agreement shall be recorded and shall be considered binding on future owners,
successors and assigns.

Dear City of Waterloo:
I'm writing to ask for a permission to have part of city property paved or as they call it black top in front
of the building. Also I would like to have the gravel part filled with recycled rock to fill in holes and cover
the mud that gets created on rainy days. Marked on the map provided is what I would like to have done.
There will be no vehicles parked on this part of pavement it is mainly for beautifying the lot as I will have
the whole parking lot redone this coming up summer.
I would like to note that I'm not asking you to pay for this in any way but only a permission to have it
paved to make the property look more presentable in the near future.
