On this% 2 day of J 0 It<L , 2015, this Agreement is made and entered into by and between
the City of Waterloo, Iowa (hereinafter "City") and Mohammad ILYAS (hereinafter
"Developer"), for and in consideration of the mutual promises and covenants herein contained
and for other good and valuable consideration, the receipt and sufficiency of which are hereby
acknowledged.
The terms of this Agreement are as follows:
1. The subject matter of this Agreement is:
Hallocks Plat of Outlots Lot 2 and Lot 3, Waterloo, Black Hawk County, Iowa;
locally known as 1104 Washington Street, Waterloo, Iowa, 50702.
2. The purpose of this Agreement is to confirm the requirement for, and provide for the
timely construction of, a Stormwater Management (SWM) plan required for this commercial
property.
3. In consideration of the requirement for SWM as per City Code of Ordinances Title 8
Chapter 4 Stormwater Management Program Article C Post Construction Stormwater
Management, the Developer agrees to construct a plan that complies with the City ordinance.
4. The construction plan to be used to complete the SWM plan for the subject property shall
be the plan prepared by VJ Engineering dated October 9, 2013.
5. The construction of this plan shall be completed by July 23, 2015.
6. In anticipation of this work being completed by the date herein stated, the City shall grant
the Developer a 30 day Temporary Occupancy permit for the new business known as the Gyro
Hut located at subject property.
7. On or before July 23, 2015, the City shall review the status of the construction of the
SWM plan to determine if this agreement has been met. If construction has proceeded in a
diligent manner, the City may consider an extension of the Temporary Occupancy permit, if
necessary. If progress is not being made to complete the SWM plan, the Temporary Occupancy
permit shall not be extended, and the Gyro Hut shall cease to operate until the SWM plan has
been completed.
8. This is the entire agreement between the parties, and this Agreement shall not be in any
manner modified without the express written consen both parties.

This agreement is being entered into with the developer of the
Gyro Hut at 1140 Washington Street to allow a 30 -day Temporary
Occupancy Permit while the Storm Water Management Plan is
being constructed, which is required to be in place before a
Permanent Occupancy Permit is granted.
