published in the Waterloo Courier on March 23, 2007, be received and placed on

125116 - This being the time and place of public hearing, the Mayor called for written
and oral objections.
Valentina Martin, licensed real estate broker for the State of Iowa, stated she
is helping to get the Islamic Cultural Center started on Ridgeway Avenue, and
they are agreeable to everything. Ms. Martin stated they have worked out
everything except one engineering problem they would like to get approval. They
signed the form that they would agree with whatever has to be done, and the
traffic has been approved. Ms. Martin distributed copies of information put
together by the applicant.
Don Temeyer, Community Planning & Development Director, asked if the Islamic
Foundation is agreeing to do whatever the Engineering Department recommends.
Ms. Martin responded they are hoping to work something out, but they are willing
to do whatever it takes.
Mr. Temeyer reported the disagreement is whether a left turn is needed, which
the Engineering Department has recommended be put there. It is up to the
restrictive covenants and the Islamic Center has to agree to the conditions.

Hearings continued
Irbahim Sehata, President of the Islamic Foundation of Iowa, stated the paper
Mayor Hurley has, which has been signed and agreed upon, was due to the Planning
and Zoning Commission. Those were the three conditions put forth for their
approval, the sewer, water and as well as dealing with the right turn and left
turn. Mr. Sehata stated they addressed with Mohammad Elahi, Traffic Engineer,
the large radius and the re -layout of the parking area, so they fulfilled these
improvements. What is being talked about is Mr. Thorson would like them to have
a left lane in addition to the two existing lane so a slow lane, where we have
about eight left turns existing between Deere Road until the new site. The
Traffic Engineer had an analysis done, and he is not recommending to have these
left lanes, and these little details need to be agreed upon, everything else is
being agreed upon.
Dennis Gentz, Assistant City Engineer, stated he has discussed this with Eric
Thorson, and as mentioned already his recommendation is for the eastbound
traffic on Ridgeway to have the left turn lane entering into this site. For
westbound traffic there is a current left turn lane at Greyhound Drive and one
that is actually on the council tonight for approval at Cyclone Drive that will
be west of the Greyhound Drive intersection. That will go into the Greenbelt
Center subdivision to serve the Gold's Gym area and the Mauer Eye Center.
Looking at the Islamic Center site, its really for the eastbound traffic to have
the left turn lane. There are no other accesses to the north at this time other
than a parking lot to the Greenbelt itself. There is a median opening near the
location as proposed for the Islamic Center entrance as well. Mr. Thorson's
concern is about the speed of traffic and potential for accidents for left turn
traffic.
Mayor Hurley asked then we need a left turn median on eastbound from Cedar Falls
towards Waterloo. Mr. Gentz responded yes, that is the recommendation.
Mr. Sehata stated there are eight left turns coming from the west to east, and
one of them is right beside the entrance for the new site, which is the Katoski
Park, and right next to them is the 26 acres of land. There are eight of them
that don't have any left slow lane. It is only for this site that they are
requiring this slow lane. Mr. Sehata stated there already is a median cut
existing so all that is needed is just to enlarge it a little bit to accommodate
the entrance for the Islamic site.
Mr. Gentz stated he has not seen Mr. Elahi's recommendations so he can't really
speak to what he is recommending.
Councilperson Getty asked if he is correct in assuming that we are going to have
to pour an extra lane of road along there which would then run up and be a right
turn lane to the Mauer Eye Clinic and the Gold Gym. Mr. Gentz stated only the
access to Cyclone Drive that is proposed would be basically the same as the
access to Greyhound Drive for westbound traffic. It would just be the two lanes
that would be moved over to accommodate the westbound left turn lane.
Councilperson Getty stated he doesn't know how we are going to put a left turn
lane unto their property without pouring another lane of traffic. Mr. Gentz
stated they would have to widen it to the south or the eastbound traffic would
have to be moved over to the south somewhat to provide the space for the
westbound left turn.
Mayor Hurley stated we are very close and he wants this project to keep moving,
but he doesn't think council can be the Engineers or the Traffic Engineers.
Mayor Hurley stated he thinks we need to call a time out and .get back to this
next week, and in the meantime let Engineering and Traffic straighten this out
with the applicants.
Councilperson Getty stated he would like to see it tabled for a week so that
they can get together with Traffic and Engineering.
Mr. Sehata stated that Mr. Elahi already addressed the right lane issue, that
was Mr. Elahi's main concern, and that e-mail was sent last week before the
Board of Adjustment and they have seen it in Planning and Zoning. They have
been working with Mr. Elahi for the last month or so.
Mayor Hurley stated that Mr. Sehata signed this today and it needs to be
notarized but it says that he agrees to the following conditions: 1) That the
left turn median improvements, right turn deceleration lane and parking layout
are constructed as determined by the Engineering and Traffic Departments; 2)
That infrastructure is properly provided to the site and that the applicant
agrees to hook onto city services now or in the future when they are within the
code requirements; and 3) That the building be appropriately designed to blend
in with surrounding developments, etc.

Therefore it is agreed by the owners any proposed change in the use or
conditions of the property. Mayor Hurley stated the owners have agreed that the
left turn median improvements, right turn deceleration lane and parking layout
are constructed as determined by Engineering and Traffic Departments.
Mr. Sehata stated this issue with the Traffic Engineer has already been
addressed, he is not requiring the right lane. He came up with second.
Mr. Temeyer stated the difference is the Engineer has recommended we keep the
left turn lane so there is a disagreement between Traffic and Engineering, and
that is what we have to work out with Mr. Elahi and Mr. Thorson.
Mr. Sehata stated the only thing that he is requesting and he is bringing it to
the council is that Mr. Thorson is telling them that if they are not agreeing on
that, he is going to close it, even for the Greenbelt, Katoski Park entrance.

drop the speed limit.

Prior to a vote on the above motion, the following comments were heard.
Councilperson Getty inquired what safety improvements are they are going to do
on Parker and U.S. 63.
Sandie Greco, Superintendent of Traffic Operations, responded they are going to
do modifications, move back a couple of signals, and install some poles and
heads.

ORAL PRESENTATIONS
125143 - Forest Dillavou, 1725 Huntington Road, stated his son lives at 1304 Ansborough
Avenue, he owns a house there and there was a large wood carving in the front
yard. Sunday, at about 5:00 p.m., someone backed into the front yard, cut a
chain that was holding this wood carving and stole the wood carving in broad
daylight. Earlier in the week, his grandson had his bicycle off of University
on Sager, first house off of University in broad day light. He and another kid
pulled their bicycles in and within 15 minutes someone stole the two bicycles.
These are broad daylight thefts, and Mr. Dillavou suggested that the citizens of
Waterloo, if they see something suspicious, please report it to the Police
Department.
