These grants would support the development of a new supermarket and seek funding to address the Virden Creek issue with the Army Corps of Engineers. The combined resources of Richard F. Warren & Associates (RFW), Allynn Howe of Government Relations Consultants and Calvin Brockington of Optimum Business Solutions represents a team with experience in urban economic development, demonstrated success in obtaining significant federal support for its clients and special knowledge of Waterloo and the region. Mr. Brockington ran the Office of Community Services (OCS) for many years before his retirement from federal public service. Specifically, this proposal is to write and obtain an additional $800,000 grant from the Office of Community Services within the Department of Health and Human Services an additional grant for the same project from the Economic Development Administration (EDA) and another EDA grant to address the Virden Creek issue. EDA grants are currently funded in the $1 million to $2 million range. We will also continue to seek any and all federal funds possible and provide on-going funding strategy and support to the City. Background In the current federal political environment, members of Congress have become more active on the agency level, working with officials to help support competitive grants applications. EDA grants applications now require more interaction with the agency to meet the terms and conditions of funding For example, some of these grants require a match or are distributed as rotating loans. One key is to work with the agency to find "in kind" contributions and matches from other federal grants. We are proposing a six month engagement for lobbying, representation and writing three grants for a total of $48,000. We have been filing lobbying reports with the Congress since such disclosure forms were required. Biographical Information Richard F. Warren Mr. Warren is the former President of the Community Marketplace Development Institute, (CMDI), and a non-profit intermediary, formed to bring retail development to distressed communities. In that capacity, he raised millions of dollars for community development projects and provided technical assistance to CDCs, local governments, HUD, and the Office of Community Services (OCS). CMDI helped develop retail in over a dozen cities in the past three years. Prior to that, he was the state and local lobbyist for the International Council of Shopping Centers. In that capacity, he created the highly successful Alliance Program that brought together retailers, developers and city officials that now bring retail development to urban locations Allynn L. Howe Allynn Howe began his career in Washington, D.C. as a legislative representative for labor organizations representing federal and state employees, where he was integrally involved in efforts to incorporate community input into the Base Realignment and Closure (BRAC) process. From there, he went on to become the Legislative Director of the United Brotherhood of Carpenters, and, thereafter, Vice -President for Government Affairs of the National Lumber and Building Materials Dealers' Association. In those positions, he was responsible for creating legislative and administrative solutions for a wide range of issues, including the economic impact of federal environmental mandates, OSHA requirements, and federal regulatory restrictions on 3 small businesses. While representing retail lumber, Mr. Howe became a leading spokesperson for a coalition advocating for the elimination of trade restrictions on Canadian softwood lumber. In 2000, Allynn Howe formed Government Relations Consultants (GRC) in order to expand his legislative and political consulting services. His grasp of the legislative funding process is reflected in GRC's successful representation of such diverse clients as AfriHub, an American technology company providing cutting-edge communications services to African universities, and Native American tribal entities seeking support for business development. His most significant legislative accomplishments have been on behalf of municipal entities such as Laredo, Texas, and Gateway Cities in California, for whom he has successfully pursued funding for a variety of projects necessary to sustain increased economic development, including in -fill development projects, housing alternatives and important transportation projects. AGREEMENT FOR GRANT WRITING SERVICES TO PREPARE AN APPLICATION FOR GRANTWRITING, LOBBYING AND CONSULTING A. General workplan requirements Consultant will assist with information gathering (via phone, fax, e-mail, overnight delivery or letter), analysis, packaging and preparation of the grant application and attachments. This includes providing Client with a list of information and a questionnaire it must provide (or respond to) for consultant's use in preparing the grant application. Based on prior agency requirements, within 10 days of signing the agreement, consultant will provide an additional list after it publishes its request for proposal. Consultant will provide Client with a list of actions and instructions that it must execute to be ready for the proposed grant project. This includes, but is not limited to, providing written draft agreements (for inclusion in grant application) that must be concurred to and signed by the relevant City officials and other parties that may include a partner, local job coordinator, evaluator and others. The consultant will mail, overnight, or deliver the draft and final application to Client. Client is responsible for properly signing and delivering the appropriate set of documents to the delivery point required by the agencies before the submission deadline. I. B. Other Client actions required under this agreement The Client will provide the above requested information and respond to questions expeditiously, by whatever means may be necessary, including: e-mail, regular mail, or overnight delivery to consultant. It is critical that the Client have a knowledgeable representative available to answer general or follow-up questions by phone or by e-mail for within one working day or the request. Client shall have such a person available to the consultant within 10 days of signing of this agreement. Additionally, the knowledgeable person will be available for periodic communication throughout the engagement. 4 C. Payment of fee The fee for Consultant's services is $48,000, $24,000 of which to be paid at the signing of the contract, the remaining $24,000 , to be paid monthly for the six month period of this engagement. . D. Effective period The effective date of this agreement is from the date of signing this contract to September 31, 2013, or a six month period beginning on the date of signing, whichever is longer. E. Warranty and other terms The consultant does not guarantee that Client will receive the grant but warrants that the application will be prepared in a complete and comprehensive manner based on information received from Client. The consultant will update the application at no additional fee for the next round of funding should Client not receive funding during this round. The terms herein constitute the entire agreement regarding services we will provide and supersede all prior agreements, understandings, negotiations and discussions between us, whether written or oral. This agreement may be supplemented only by other written agreements. We are serving as consultants and you may accept or reject our recommendations. Our maximum liability relating to services rendered under this agreement regardless of form of action whether in contract negligence or otherwise shall be limited to the charges paid to us for the portion of services or work products giving rise to the liability. In no event shall we be liable to consequential, special, incidental or punitive loss, damage or expense (including without limitation, lost profits, opportunity costs or etc.) even if we have been advised of their existence. The services described in the foregoing agreement are in accordance with our requirements and we understand the terms, conditions and limitations recited above.
