Summary Statement This is an Amendment to the Financial Assistance Award from the EDA. This amendment changes the date that construction must begin to May 1, 2013. This agreement is available in the City Clerk's office if you wish to review it in its entirety. Expenditure Required N/A Source of Funds N/A Policy Issue These pump stations will pump storm water from locations that flooded in 2008. The City has already accepted the EDA grant in 2010. The Amendment revises the Project Scope of Work, the Project Development Time Schedule and allows the project to be completed in two phases. The project Scope of Work has been revised to reflect decisions that were made during the design phase. The new scope of work consists of constructing improvements to the existing upstream detention ponds instead of constructing a lift station, as originally planned. The Time Schedule has been revised to extend the deadline for the start of construction to May 1, 2013. The City indicated that the additional time is necessary to complete the design, and to obtain the required approval and environmental permits. Please be advised that the City needs to take all necessary actions to move this project forward as quickly as possible. If the project is not started prior to May 1, 2013, the City may be in jeopardy of this award being terminated. The approval for project phasing allows the project to be completed in two phases. Phase I consists of the Virden Creek, Vinton/18th Street and Westfield pump stations, and may proceed independently of Phase II. Phase II consists of the Blowers Creek pump station and Dry Creek Run detention basin improvements, and requires that a revised environmental narrative be submitted and approved, prior to EDA's approval of construction documents. All other terms and conditions of the Financial Assistance Award shall remain in full force and effect. The revised scope of work replaces the originally planned stormwater lift station in the Dry Creek Run drainage basin with improvements to the upstream detention basins. The revised time schedule extends the Construction Start date from Aug. 3, 2012 to May 1, 2013. The project is also phased into two phases for construction. All other terms and conditions of the Financial Assistance Award shall remain in full force and effect. (Revised) PROJECT DESCRIPTION: The project will construct four (4) Storm Water Lift Stations with the capacity to pump water from the City's storm sewer system into the Cedar River. The lift stations are in the Virden Creek, Vinton/18th Street, Westfield and Blowers Creek drainage basins. The project will also construction improvements to the Highway 20 and Liberty Park detention basins to reduce flows into the Dry Creek Run drainage basin. 2. The Start of Construction date in the Project Development Time Schedule (Special Award Condition No. 1) is revised to be May 1, 2013. 3. (New) Special Award Condition No. 19. REVISED ENVIRONMENTAL NARRATIVE Prior to EDA's approval of the bid documents for Phase II, the Recipient shall provide a revised environmental narrative for EDA's review and approval. The Environmental Narrative shall update the original Environmental Narrative to address the additional areas that are impacted by the revised scope of work improvements within the Dry Creek Run basin. The Recipient shall provide evidence satisfactory to EDA, that any permits or outstanding environmental requirements that are identified in the revised Environmental Narrative have been obtained prior to EDA's approval of the bid documents. 4. (New) Special Award Condition No. 20 PHASING The project will be completed in two phases. Phase I includes three (3) Storm Water Lift Stations in the Virden Creek, Vinton/18th Street, Westfield drainage basins. Phase II includes one (1) Storm Water Lift Station in the Blowers Creek drainage basin, and improvements to the Highway 20 and Liberty Park detention basins upstream of the Dry Creek Run drainage basin. The total project budget has been separated for Phase I and Phase II. In the event the budget for either Phase is exceeded, the Recipient agrees that funds cannot be transferred between the phases until all of the construction contracts have been executed for each phase. The Recipient acknowledges that they are required to commit the additional funds necessary if a contract that exceeds the budget for that phase is awarded. Once all of the contracts have been executed, and the costs for each phase are known, the Recipient may transfer costs between phases. Disbursements for construction costs will not be made until all of the construction contracts for both phases of the project have been executed.
