HomeMy WebLinkAboutAdvanced Enviromental Testing and Abatement, Inc-10/22/2012 (2)Please return this copy to: City Clerk & Finance Department 715 Mulberry Street Waterloo, IA 50703 AGREEMENT FOR REMOVAL AND DISPOSAL OF ASBESTOS FOR CDBG GROUP NO. 141 -AR -10 -22 -12 -NSP THIS AGREEMENT made this 22nd day of October, 2012, by and between ADVANCED ENVIRONMENTAL TESTING AND ABATEMENT, INC., a corporation organized and existing under the laws of the State of Iowa, hereinafter called the "CONTRACTOR", and the CITY OF WATERLOO, IOWA, acting through its COMMUNITY DEVELOPMENT BOARD, hereinafter called the "CITY". WITNESSETH, that the Contractor and the City for the consideration stated herein mutually agree as follows: ARTICLE 1. STATEMENT OF WORK. The Contractor shall furnish all supervision, technical personnel, labor, materials, machinery, services, and perform and complete within 30 calendar days after receipt of Notice to Proceed, all work required for the Removal and Disposal of Asbestos in an efficient and workmanlike manner, as required by the Iowa Department of Labor and the U.S. Environmental Protection Agency regulations. ARTICLE 2. THE CONTRACT PRICE. The City will pay the Contractor for the performance of the Contract in current funds, subject to additions and deductions as provided in the Section "Changes in the Work" under General Conditions, Part I, and subject to all other conditions set forth in the Contract Documents, the sum of Eleven Thousand, Eight Hundred Seventy -Nine and no/100 Dollars ($11,879.00), and in accordance with the contractor's bid. ARTICLE 3. CONTRACT. The executed Contract Documents shall consist of the following: a. This Agreement b. Addenda c. Invitation to Bid d. Instructions to Bidders e. Signed copy of Bids. f. General Conditions Part I, II, and III g. Special Conditions h. Technical Specifications i. Drawings as listed in the Schedule of Drawings THIS AGREEMENT, together with the other documents enumerated in this Article 3, which said other documents are as fully a part of the Contract as if hereto attached or herein repeated, forms the Contract between the parties hereto. In the event that any provision in any component part of this Contract conflicts with any provisions of any other component part, the provision of the component part first enumerated in this Article 3 shall govern, except as otherwise specifically stated. ARTICLE 4. IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed in three (3) original copies on the day and year first above written. All accounts subject to 1.5% monthly charge after 30 days. All work is guaranteed to be as specified. All work to be completed In a workmanlike manner according to specified practices. Any alteration or deviation from the above specifications involving extra costs will be executed only upon written orders and will become an extra charge above the estimate. All agreements contingent upon strikes, accidents or delays beyond our control. Owner to carry fire, tomado, and other necessary insurance. We carry general liability insurance and our workers are fully covered by workers compensation insurance. NOTE: This proposal may be withdrawn by us if not accepted within 30 days.
