HomeMy WebLinkAboutAment Inc-2/20/2012DEDICATION AND CONSENT TO PLAT FOR WATERLOO RX FIRST & FRANKLIN SUBDIVISION WATERLOO, BLACK HAWK COUNTY, IOWA KNOW ALL MEN BY THESE PRESENTS: That Iowa CVS Pharmacy, L.L.C., an Iowa limited liability company (the "Owner"), being desirous of platting the land which is legally described in the attached Final Plat of Waterloo Rx First & Franklin Subdivision by Ament, Inc., dated the day of (0.0 -ML, , 2012 (the "Property"), does by these presents designate and set apart the Proper as a subdivision of the City of Waterloo, Black Hawk County, Iowa, the same to be known as: WATERLOO RX FIRST & FRANKLIN SUBDIVISION WATERLOO, BLACK HAWK COUNTY, IOWA, all of which is with the free consent and desire of the Owner. DEDICATION OF RIGHT OF WAY Owner does hereby dedicate that potion of the Property described on the attached Plat as Lot `B' to the public for a public street right of way. EASEMENT Owner does hereby grant and convey to all future owners of any Lot in the Waterloo Rx First & Franklin Subdivision, and their respective successors and assigns, an easement for the use of that portion of the Property described on the attached Plat as Lot 'A' for private stormwater detention. The owner of Lot 1 in the Waterloo Rx First & Franklin Subdivision shall have the obligation to maintain the stormwater detention facilities on Lot A, subject to a right of reimbursement from the owners of the other Lots in the Waterloo Rx First & Franklin Subdivision, other than Lot `B', in accordance with and as provided in a Declaration of Easements, Covenants, Conditions and Restrictions which shall be recorded against all Lots in the Waterloo Rx First & Franklin Subdivision, other than Lot 'B'.
