HomeMy WebLinkAboutJDE Engineering-9/12/2011ENGINEERING (319464-7913 September 7, 2011 SOO 11Iain St, La Porte City, Lk SO6:+1 jdeeng@ netins.net DELANE AVENUE WATERSHED STORM WATER DETENTION AREA DEVELOPMENT AND DEVELOPMENT OF PRELIMINARY PLANS AND SPECIFICATIONS FOR IMPROVEMENTS PROFESSIONAL SERVICES AGREEMENT WHEREAS, the City of Waterloo, Iowa ("City") desires to develop a storm water detention area south of Devonshire Drive between Delane Avenue and Wenner Drive within Waterloo, Iowa, and WHEREAS, JDE Engineering, PLC ("Consultant") of Waterloo, Iowa desires to provide professional engineering services related to the development of the storm water detention area, NOW THEREFORE, it is mutually agreed that this Professional Services Agreement shall consist of the following: SCOPE OF SERVICES The scope of services shall consist of the following: Obtain Drainage Basin Information - Gather Existing Data • Obtain the most up-to-date aerial photography for the area, • Obtain 2 -foot contour information for the area, • Establish the overall drainage area boundary for the drainage basin, • Gather existing storm sewer records, • Gather existing as -built construction records, • Gather information regarding other utilities within the area (sanitary sewer, water main, electric, gas, telephone, fiber, cable), 1 • Obtain and incorporate parcel and property information from Black Hawk County IT Department, • Obtain right-of-way information, • Obtain existing drainage and utility easement information from Ridgeway Avenue to Delane Avenue, • Gather property owner mailing addresses, • Divide the drainage basin into major subsections based on major storm sewer pipe branches, • Obtain the most up-to-date floodplain mapping for the drainage basin, • Identify recent development and storm water drainage detention methods for each development, • Compile a listing of undeveloped areas within the basin, and • Initiate discussions with, and obtain preliminary permitting for the proposed work from, the following agencies that have jurisdiction in the area of the proposed project: Iowa Department of Natural Resources, U.S. Army Corps of Engineers, and Black Hawk County Soil and Water Conservation District. Obtain Field Survey Information • Obtain a field survey of the area to obtain storm sewer data (i.e. top of intake or manhole, gutter elevation, flowline, type of structure, condition, pipe diameter, pipe material, location of existing detention basins, flowline of detention basins, top of detention basins, detention basin outlet structure type and size), • Obtain photos of existing drainage structures (i.e. manhole and inlet locations, detention basins), • Conduct a mailing to property owners within the drainage basin requesting permission to survey on private property, where needed, • Obtain a field survey of existing building structures within the floodplain limits to obtain information such as edges of home foundation, corresponding low -opening elevation, first floor elevation, • Obtain open -channel cross-sections to review floodplain limits, • Obtain pipe outlet information within the basin, • Obtain a topographic and boundary survey of the Devonshire School Site, • Conduct a field review to verify survey data. Analyze Drainage Data • Incorporate research and data collection information into the StormNET analysis software within AutoCAD Civil 3D, 2 • Obtain drainage basin flow volume characteristics from the analysis of the data, • Calculate runoff coefficient, rainfall intensity, drainage area size, and time -of -concentration information within the basin, • Calculate runoff volumes for the 2, 5, 10, 25, 50, 100, 250, and 500 -year flood events, • Calculate flood levels for 100 -year flood event and compare to current flood mapping, • Conduct analysis presuming undeveloped sites are in a development condition, • Determine preliminary size for the proposed detention basin, • Determine size of property necessary for development of the detention basin, • Determine area of excess property beyond the proposed detention basin footprint, and • Submit results of the drainage analysis to the Iowa Department of Natural Resources to allow base flood elevations to be determined, and allow a map revision to occur for the drainage basin. Public Input and Informational Meetings • Complete a mailing to property owners within the drainage basin to inform them of input and informational meetings regarding the drainage study and proposed improvements, and • Conduct 2 to 3 public input and informational meetings with property owners. Develop Preliminary Plans and Specifications • Develop preliminary plans related to the selected improvements, • Develop preliminary specifications booklet related to selected improvements, • Develop preliminary cost estimates for construction, and • Develop property acquisition and easement plats related to the preliminary detention basin design to allow the property acquisition task to commence. 3 II. TIME OF BEGINNING AND COMPLETION The project shall begin following approval of the City Council and execution of this agreement by the Mayor of the City of Waterloo. The preliminary design with plans and specifications for this project will be submitted to the City by June 29, 2012. Below is an anticipated schedule for development of the project: • Approval of the Development Agreement September 2011 • Obtain Existing Information for the Drainage Basin September - October 2011 • Obtain Field Survey Information October - November 2011 • Input Field Data in StormNET Software and Analyze Data December 2011- March 2012 • Public Input and Informational Meetings April 2012 • Develop Preliminary Plans and Specifications May - June 2012 • Submittal of Preliminary Plans and Specifications June 2012 III. COMPENSATION The fee for the work detailed under "Section I. Scope of Services" is based on anticipated time -and - materials necessary to complete the work. The total cost of this project is estimated to be $158,500. This fee is considered a maximum not -to -exceed cost. IV. TERMS AND CONDITIONS The attached Terms & Conditions are considered part of this agreement. Clark, Mayor Gt/194904 Date 4 Standard Terms and Conditions JDE Engineering (hereinafter referred to as the "Firm") shall perform the services outlined in this agreement for the stated compensation noted. Following are general items applicable to this agreement: Access to Site: The Firm shall have site access to perform all services necessary in completing a project. The Firm agrees to take necessary precautions to minimize damages caused by such activities. Unless otherwise agreed, costs of restoration shall be borne by the Firm and are not included in the fee arrangement. Warranties: The Firm shall provide the best professional services in accordance with accepted standards of practice, and shall maintain high professional standards for all work performed in conjunction with the project. Other than the above, the Firm makes no warranty, express or implied, as to its professional services rendered under this agreement. Fees: The anticipated fee for time and materials, if stated, shall be understood to be an estimate. All expenses relating to the project agreed upon here may be invoiced back to the client. These expenses may include, but are not limited to, mileage, legal fees, software fees, plotting fees, copying fees, permitting fees, and travel expenses. During the course of the project, if time and materials expended are more than the estimated fee, the Client will be contacted with an explanation of the fee overage and provided a change order form to sign to allow work to proceed. Where the fee arrangement is to be on an hourly basis, the rates shall be those that prevail at the time services are rendered. The not -to -exceed cost shall not be expended prior to written consent of the City. Current rates are as follows: Owner / Project Engineer $95 per hour Invoices/Payments: Invoices for the Firm's services shall be submitted, at the Firm's option, as per one of the following schedules: The Firm may submit invoices either upon completion of the services, or the Firm may submit invoices throughout the life of the project. Invoices shall be paid within 30 days of the invoice date. If the invoice is not paid within 30 days, the Firm may terminate all services free of liability. The Project Engineer/Owner will have the authority to enter into alternative payment agreements. Late Payments: Invoices that are not paid within 45 days of the invoice date may be assessed a Late Fee. The client shall pay all cost including court costs and reasonable attorney fees associated with collecting any unpaid balances. Indemnification: The Client shall indemnify and hold the Firm harmless from and against any and all claims, losses, and expenses (including reasonable attorney's fees) arising out of, or resulting from, the performance of the services, provided that any such claim, damage, loss, or expense is caused in whole or in part by the negligent act, omission, and/or strict liability of the Client, it's employees, or agents (except the firm). Termination of Service: Ownership of Documents: This agreement may be terminated by the Client or the Firm should the other fail to perform its obligation hereunder. In the event of termination, the Client shall pay the Firm for all services rendered to the date of termination, reimbursable expenses, and reimbursable termination expenses. All documents produced by the Firm under this agreement shall remain the property of the Client, unless otherwise stated in writing. Applicable Laws: The agreement shall be governed by the laws of the State of Iowa.
