This General Agreement is made and entered into this J day of , 2011, by and
between Howard L. Allen Investments, Inc. ("Allen") and the City of Waterloo, Iowa ("City").
WHEREAS, Allen and City entered into a Development Agreement dated October 4,
2010 and amended by an Agreement to Amend dated May 23, 2011, that includes a Development
Incentive Payment to Allen for the demolition of 123 Stanley Court, Waterloo ("Facilities").
WHEREAS, both parties wish to further expand the definition of the demolition of
Facilities.
NOW THEREFORE, the parties agree as follows:
1) The demolition of Facilities will include removal of the building, foundation
systems, flooring, and footings.
2) The hole dug to accomplish the removal of the building, foundation systems,
flooring and footings may be left open, and Allen shall not be required to fill the
same.
3) Except as amended herein, all other terms in the Development Agreement shall be
unaffected and stay in full force and effect.
