HomeMy WebLinkAboutKelly Demolition LLC-8/1/2011 (2)SECOND AMEND 1 NT TO CONTRACT FOR DEMOLITION AND SITE CLEARANCE SERVICES (NO RACM) GRC UP 1 This Second Amendment to Contract for Demolition and Site Clearance Services (No RACM) Group 1 is made as of the latest date set forth below by and between the City of Waterloo, Iowa ("City") and Kelly Demolition, LLC ("Contractor"). WITNESSETH: WHEREAS, the City and the Contractor have heretofore entered into a certain Contract for Demolition and Site Clearance Services [no Regulated Asbestos Containing Materials (no RACM) Group 1] dated May 1, 2011 (the "Agreement") for the Contractor to provide demolition and site clearance services to the City pertaining to the City of Waterloo's Hazard Mitigation Grant Program (HMGP) Property Acquisition Project; and, WHEREAS, pursuant to the Agreement, the Agreement may not be modified or amended except pursuant to the mutual written agreement of the parties; and, WHEREAS, the City has determined that there are additional retaining wall/terrace systems on the rear (riverfront) of the following properties: 128 Sans Souci Drive, 164 Sans Souci Drive, 168 Sans Souci Drive, 176 Sans Souci Drive, 132 Sans Souci Drive and 136 Sans Souc` Drive, and that the City of Waterloo would like the scope of work of the contract amended to include their removal and necessary earthwork, seeding and erosion blankets for the area in question; and, WHEREAS, the Contractor has provided bid tabs for Change Order No. 2, as set forth on Exhibit "A" attached hereto, with a net increase of $15,250 for work performed under the Agreement. NOW, THEREFORE, the parties hereby amend the Agreement to approve Change Order No. 2 with a next increase of $15,250, for work performed under the Agreement, for a revised contract limit and total actual expenses allowed by the Agreement not to exceed $216,054.95. All other terms and conditions of the Agreement shall remain in full force and effect, without modification.
