AND SITE CLEARANCE SERVICES (NO RACM) GROUP 1
This First Amendment to Contract for Demolition and Site Clearance Services No RACM Group 1
is made as of the latest date set forth below by and between the City of Waterloo, Iowa ("City") and
Kelly Demolition, LLC ("Contractor").
WITNESSETH:
WHEREAS, the City and the Contractor have heretofore entered into a certain Contract for
Demolition and Site Clearance Services [no Regulated Asbestos Containing Materials (no RACM)
Group 1] dated May 1, 2011 (the "Agreement") for the Contractor to provide demolition and site
clearance services to the City pertaining to the City of Waterloo's Hazard Mitigation Grant Program
(HMGP) Property Acquisition Project; and,
WHEREAS, pursuant to the Agreement, the Agreement may not be modified or amended except
pursuant to the mutual written agreement of the parties; and,
WHEREAS, the City has determined that there are four (4) additional water service lines that
were not known at the time the bid specifications were prepared by the City and therefore were not
included in said specifications or in the bid submitted by the Contractor, but Waterloo Water Works
requires that the water service lines be properly disconnected, and the cost to disconnect the
additional service lines is not part of the scope of work covered by the Agreement; and,
WHEREAS, the Contractor has provided bid tabs for Change Order No. 1, as set forth on Exhibit
"A" attached hereto, with a net increase of $2,400 for work performed under the Agreement.
NOW, THEREFORE, the parties hereby amend the Agreement to approve Change Order No. 1
with a next increase of $2,400 for work performed under the Agreement, for a revised contract limit
and total actual expenses allowed by the Agreement not to exceed $200,804.95. All other terms and
conditions of the Agreement shall remain in full force and effect, without modification.
IN WITNESS WHEREOF, the parties have caused this First Amendment to Contract for
Demolition and Site Clearance Services (no RACM) Group 1 to be executed by their duly
authorized representatives.
