HomeMy WebLinkAboutAecom Technical Services-3/14/2011 (2)A=COM AECOM 319 232 6531 tel 501 Sycamore Street 319 232 0271 fax Suite 222 Waterloo, Iowa 50703 www.aecom.com CEDAR VALLEY RIVERFRONT RENAISSANCE WATERLOO VISION IOWA PROJECTS CONSTRUCTION -REVIEW SERVICES FOR BOTH THE RIVERWALK LOOP TRAIL FROM MULLAN TO PARK AVENUE (NORTH SIDE OF RIVER) AND FOR MARK'S PARK AND THE PERFORMANCE STRUCTURE SUPPLEMENTAL AGREEMENT NO. 12 WHEREAS, a Professional Services Agreement was entered into between the City of Waterloo, Iowa (Client), and AECOM Technical Services, Inc., formerly Earth Tech, Inc. (Consultant), of Waterloo, Iowa, dated September 22, 2003, for the preliminary design, final design and construction -related services for the Cedar Valley Riverfront Renaissance, Waterloo Vision Iowa Projects, including the three major projects known as the Riverwalk Loop, Cedar River Dam Improvements and the Cedar River Plaza and Amphitheatre in Waterloo, Iowa; and WHEREAS, Supplemental Agreement No. 1 was entered into between the Client and the Consultant dated January 24, 2005, for Phase II - Final Design Services of selected alternatives; and WHEREAS, Supplemental Agreement No. 2 was entered into between the Client and the Consultant dated October 10, 2005, for Phase III - Construction -Review Services for that portion of the project including floodwall modifications at the Lower Plaza and Waterloo Center for the Arts Youth Pavilion; and WHEREAS, Supplemental Agreement No. 3 was entered into between the Client and the Consultant dated September 18, 2006, for Phase III — Construction -Review Services for that portion of the project including the Riverwalk Loop Trail from East 6th Street to 18th Street; and WHEREAS, Supplemental Agreement No. 4 was entered into between the Client and the Consultant dated May 21, 2007, for Phase III — Construction Review Services for that portion of the project including the Waterloo Dam Rehabilitation and River Wall', Reconstruction; and WHEREAS, Supplemental Agreement No. 5 was entered into between the Client and Consultant dated June 15, 2007, for Phase III - Construction Review Services for that portion of the project including the Riverwalk Loop Trail from Cedar Bend Park to Mullan Avenue; and WHEREAS, Supplemental Agreement No. 6 was entered into between the Client and the Consultant dated September 2, 2008, for Phase III - Construction Review Services for that portion of the project including the Riverwalk Loop Trail Enhancements (Overlooks) along the north side of the Cedar River, from 6th Street to the Cedar River Dam; and WHEREAS, Supplemental Agreement No. 7 was entered into between the Client and the Consultant dated October 20, 2008, for Phase III - Construction Review Services for repairs of damage to portions of the project along the Cedar River caused by the flood of 2008; and WHEREAS, Supplemental Agreement No. 8 was entered into between the Client and the Consultant, dated August 17, 2009, for final design services for Mark's Park and additional design services for a Performance Structure for the amphitheatre area of the lower plaza; and A=COM Page 2 WHEREAS, Supplemental Agreement No. 9 was entered into between the Client and the Consultant, dated March 26, 2010, for Phase III - Construction Review Services for that portion of the project including the Riverwalk Loop Trail from West 6th Street to 18th Street on the south side of the Cedar River; and WHEREAS, Supplemental Agreement No. 10 was entered into between the Client and the Consultant, dated April 26, 2010, for Phase III - Constructed Review Services for that portion of the project including the Lower Plaza, additional construction review services for the Waterloo Dam Rehabilitation and River Wall Construction, and for additional design services for the Cedar Valley Riverfront Renaissance Waterloo Vision Iowa Projects; and WHEREAS, Supplemental Agreement No. 11 was entered into between the Client and the Consultant, dated December 13, 2010, for that portion of the project including electrical service modifications for the Cattle Congress Sanitary Pump Station; and WHEREAS, the Client and the Consultant now desire to enter into Supplemental Agreement No. 12 for Phase III - Construction -Review Services for that portion of the project including both the Riverwalk Loop Trail on the north side of the river from Mullan Avenue to Park Avenue and Mark's Park and the Performance Structure. NOW THEREFORE, it is mutually agreed to amend the original Professional Services Agreement as follows: Project Description The first project consists of the construction of the Riverwalk Loop from Mullan Avenue to Park Avenue on the north side of the Cedar River. This project includes approximately 2,000 feet of recreational trail construction, a connection to 3`d Street, overlook areas and amenities including benches, lighting and landscaping. The second project consists of the construction of Mark's Park and the Performance Structure. Mark's Park will be constructed on the Lower Plaza area near U.S. Bank. The Performance Structure will be constructed just north of the amphitheatre which is being constructed under the Lower Plaza project. Mark's Park will include creating a space in the current plaza area for a children's park that will include water features and other play equipment. The Performance Structure will be used by performers within the amphitheatre. II. Scope of Services The Scope of Services will encompass and include services, materials, equipment, personnel and supplies necessary to provide construction staking, field review, materials testing and contract administration during the construction phase for the project defined above. The Scope of Services is further defined as follows: A=COM Riverwalk Loop North Side - Mullan to Park Page 3 Task 1. Conduct a preconstruction conference attended by representatives of the Contractor, Client, Consultant and affected utilities. Task 2. Provide construction -staking for horizontal and vertical controls for the project as follows: a. Set Project Control b. Set Stakes at 50 -Foot Intervals for Grading c. Set Stakes for Silt Fence d. Set Stakes for Storm Sewer and Adjustment of Fixtures e. Set Stakes at 25 -Foot Intervals for Paving Trail f. Set Stakes for Retaining Wall g. Set Stakes for Steps h. Set Stakes for Lights, Handholes and Signs Set Stakes for Overlook Areas j. Set Stakes for Railing k. Set Stakes for Bollards Task 3. Review shop drawings and other submittals as required of the Contractor by the contract documents for conformance with the design concept of the project and compliance with the information given in the contract documents. Task 4. Answer design interpretation questions from the Client, Contractor, review staff and appropriate agencies. Task 5. Prepare bi-weekly applications for payment based on information provided by field review staff and Contractor and forward to the Client for execution with recommendation for approval and payment. Task 6. Perform construction site visits by design personnel at appropriate stages of construction to review the quality of the work and to determine whether the work conforms to the contract documents. Task 7. Prepare and assist the Client and Contractor in processing contract change orders. Task 8. Provide periodic field observation during construction to review the work of the Contractor to determine if the work is proceeding in general accordance with the contract documents and that completed work appears to conform to the contract documents. Staffing requirements may be adjusted during the project in relation to the level of construction activity. Task 9. Report to the Client any work believed to be unsatisfactory, faulty or defective or does not conform to the contract documents, and advise the Client of any work that should be corrected or rejected. Task 10. Consider and evaluate Contractor's suggestions for modifications and report them with recommendations to the Client. Task 11. Participate in a review of the project with the Client and review staff near project completion and prepare a list of items to be completed or corrected. A=COM Page 4 Task 12. Participate in a field observation of the completed project with the Client and review staff before a final application for payment is processed for the Contractor. Task 13. Maintain files for correspondence, reports of the job conferences, shop drawings and sample submissions, reproductions of original contract documents including addenda, change orders, field modifications, additional drawings issued subsequent to the execution of the contract, Engineer clarifications and interpretations of the contract documents, progress reports and other project -related documents. Task 14. Provide the Client with a copy of revised drawings of the construction plans (record drawings) for the project based on the construction observation records of the field review staff and the Contractor showing those changes made during construction considered significant. Task 15. Prepare and assist the Client with the final close-out documentation received from the Contractor. Mark's Park and Performance Structure Task 16. Compensation Compensation for the above services will be on an hourly basis in accordance with Part III of the original agreement. Estimated fees for the services are as shown below and shall not be exceeded without authorization of the Client. Riverwalk Loop Trail from Mullan to Park Avenue (North Side) Mark's Park and Performance Structure $123,000.00 $58,000.00 Total $181,000.00 IV. In all other respects, the obligations of the Client and the Consultant shall remain as specified in the Professional Services Agreement dated September 22, 2003; and subsequent amendments.
