PURPOSE: The purpose of this Agreement shall be to permit the participating public agencies to enter into a joint controlling board for the purpose of establishing, maintaining, and governing the Black Hawk County Criminal Justice Information System (CJIS) pursuant to Chapter 28E, Code of Iowa. II. DURATION: The effective date of this Agreement shall be at the time all parties have signed it, and the Agreement has been filed with the Secretary of State. This Agreement shall remain in effect for one year and shall continue in effect from year to year (July 1 through June 30) unless terminated as provided in Section IV. III. ORGANIZATION: The legal entity created by this Agreement shall be known as the Board of Directors of Black Hawk County Criminal Justice Information System and shall consist of representatives of the participating public agencies. The Members of the Board of Directors shall be the: Black Hawk County Board of Supervisors Representative Black Hawk County Sheriff Chief of Police of Cedar Falls Chief of Police of Evansdale Chief of Police of La Porte City Chief of Police of Waterloo Each Member or their Designee shall have one vote on the Board of Directors. The Board of Directors hereby created shall have the power to promulgate bylaws to govern its operation in compliance with this Agreement and applicable State and Federal laws and regulations. Actions of the Board of Directors shall be determined by a majority of the voting Members. Each voting Member may appoint a Designee who may vote in the absence of said voting Member. The Board of Directors shall have the power to perform all actions necessary to establish, maintain, and govern the Criminal Justice Information System, including entering into agreements with other agencies toward that end. The Board of Directors may permit additional public agencies to participate in the Criminal Justice Information System as non-voting Members. IV. FINANCING: The Board of Directors shall receive no compensation for their participation in addition to their regular compensation from their respective agencies. The fiscal year cost of participation in the Black Hawk County Criminal Justice Information System shall be determined by each participant's system requirements and a pro rata share of the operational costs based upon the actual and projected system usage. The cost for system expansion and one-half of the operating expenses shall be assessed to the governing bodies on or about July 1 of each year. The second half of operating expenses shall be assessed on or about January 1 of each year. There shall be no cost assessed to non-voting Members. The Board of Directors shall have the power to apply for grants from State or Federal sources for the purpose of funding the Criminal Justice Information System and for its staffing and operation and shall have the power to receive and disburse those funds. V. EXPANSION: The Board of Directors shall determine by a majority vote what additional public agencies and/or non-voting Members shall be permitted to enter into this Agreement and to participate in the Criminal Justice Information System. The manner and scope of such participation and the cost of such additional public agencies and/or non-voting Members shall be determined by a majority vote of the Board of Directors. VI. TERMINATION: A public agency may terminate its participation in the Criminal Justice Information System by providing written notification to the CJIS Board of Directors 120 days prior to the beginning of a fiscal year. Property of the Criminal Justice Information System in the possession of a terminating member shall revert to the CJIS Board of Directors for disposition. The Board of Directors may take official action to terminate this Agreement and the Criminal Justice Information System and, in that event, shall determine by formal action the appropriate disposition of any assets of the Criminal Justice Information System. VII. COMMITTEES: The Board of Directors may establish one or more committees, including but not limited to a user group and may appoint Members or other persons to such committees. VIH. EFFECTIVE DATE: This Agreement shall become effective when approved and signed by proper representatives of each governmental agency and when it is filed and recorded as provided by law.
