HomeMy WebLinkAboutPatrick Moore-11/15/2010RIGHT OF ENTRY AGREEMENT The undersigned, hereinafter called the "OWNER", grants to the City of Waterloo, Iowa, hereinafter called the "CITY" a RIGHT -OF -ENTRY "in consideration of the mutual covenants in this Agreement and for other good and valuable consideration, the receipt and sufficiency of which are acknowledged." 1. The property subject to this Right -of -Entry Agreement is located at the northeast corner of Jefferson Street and W. 6th Street, Waterloo, Iowa 50704 and is legally described as: ORIGINAL PLAT WATERLOO WEST LOT 6 BLK 37 NW 10 FT LOT 7 BLK 37. 2. The Owner grants to the City, its employees, agents and contractors, an irrevocable right to enter upon the Owner's property legally described above, to the extent necessary to complete the restoration of the above described property along the biketrail currently under construction by the City. The purpose of this Right -of -Entry Agreement is to facilitate the construction of the biketrail abutting the Owner's property in conjunction with the F.Y. 2010 Riverfront Renaissance Trail — W. 6th Street to W. 18th Street, Contract No. 761, Waterloo, Iowa 3. All tools, equipment, improvement and other items taken or placed upon the above referenced property by the City or its contractors shall remain the property of the City or its contractors and may be removed by them at any time during the period of this Right -of -Entry Agreement, but must be removed within seven (7) days after the expiration of this Right -of -Entry Agreement. 4. The Right -of -Entry Agreement shall expire when the construction of the biketrail abutting the Owner's property is completed. 5. Liability: The City shall be responsible to, pay, protect, and defend the Owner against all liability, which may arise out of this Agreement, provided that it is as a result of the acts or omissions of the City, its employees, agents or contractors.
