Contractor Agreement
This Agreement is of _27_ day of Aug_ 2010 _by and between Konomi constructions LLC_
Here after called the contactor and City of Waterloo_ between after called the Owner
WITNESSSETH that the Contractor and the Owner for the conditions name agree as follows
Scope of Work: Fire Station Window Replacement #1-#3-#4-#6
The Contractor shall furnish all material and perform of the work on the property at (1)425 E 3rd

Work Performed
_Install new Pella windows per Pella Spec. In the existing openings 68 windows total Windows were
negotiated by the city of waterloo with Pella windows to be included in the bid. Contractor to supply all
the sealants needed to install windows. Pella is to supply fasteners with the windows
Contract Price
The Owner shall pay the Contractor for material and labor under the sum of _$98,000.00
Progress Payments 90% of labor and materials and materials on site
Payments of contract Price shall be made as follows _materials delivered on site Balance to be paid
upon completion

RE: WINDOW REPLACEMENT - WATERLOO FIRE STATIONS 1, 3, 4, & 6
The City of Waterloo is requesting bids to provide labor and material to replace the
windows in Fire Stations 1, 3, 4, and 6, in the following locations:
Fire Station #1 — 425 E 3`d St.

GENERAL REQUIREMENTS
1. The bidder shall provide labor and equipment to remove 66 existing windows and
prep openings to receive new windows.
2. Bidder shall provide labor and material to install new windows according to
manufacturer's specifications.
a. The approved window is the Pella Impervia fiberglass or duracast frame
material or approved equal.
b. Glazing shall be low E with Argon gas, with tempered glass where
required by code. The exterior glass panel shall be gray. Glass panel
shall have a minimum thickness of one (1) inch.
c. The color of frame shall be brown or dark bronze. Frame shall be finished
with a factory -applied powder -coat paint prior of arriving on job site.
d. Frame and glass shall be factory assembled before being delivered to job
site.

e. A full size or partial full size sample of window illustrating glazing system,
quality of construction and color of finish shall be submitted for review.
f. Shop drawings shall be submitted showing dimension, construction,
component connections and locations, anchorage methods and locations,
hardware locations and installation details.
g. Windows shall be stored in a clean and dry storage area to protect
windows from weather and direct sunlight until installation.
h. All sealants used shall be compatible with window frame and building
material in rough opening.
i. Insect screens shall be provided. Screen frame shall be finished to match
window frame.
j. Sliding sash rollers shall have the same warranty as the window and
frame.
k. Two (2) self -aligning cam -action locks shall be provided for each sliding
sash.
3. The contractor will be responsible for interior finish disruption. Interior finishes
will be brought back to the existing level before installation of new windows
begins.
4. Bidder is responsible to clean up work area inside and outside after installation is
complete.
5. Bidder is responsible to dispose of all removed windows.
BIDDING REQUIREMENTS
1. Mandatory pre-bid meeting will be on Thursday, July 29, 2010 at 1:30 p.m. in the
1st Floor Conference Room at City Hall, 715 Mulberry Street.
2. Bids will be due Monday, August 9, 2010 by 3:00 p.m. at the Waterloo City Hall,
715 Mulberry Street, in the City Clerk's Office, 1st floor.
3. Only sealed bids will be accepted.
4. A five percent (5%) bid bond shall accompany the bid in a separate envelope.

5. The outside of the bid envelope must be clearly marked "window replacement -
waterloo fire stations ".
6. Bids will be opened at the Waterloo City Council meeting on August 9, 2010 at
5:30 p.m. in the City Council Chambers, City Hall.
7. The project will be awarded to the lowest responsible bidder.
8. The project will be awarded Monday, August 16, 2010.
9. Notice to proceed will be issued Tuesday, August 17, 2010. Work will not
commence until contracts have been signed and payment/performance bond and
insurance have been submitted.
10. Completion date will be October 29, 2010.
11. Contractors and subcontractors must ensure that any laborers and mechanics
employed on projects funded or assisted in whole or in part by Recovery Act
funds are paid prevailing wages as determined by the Secretary of Labor for
construction, alteration, and/or repair (including painting and decorating).
12. EECBG Program projects using Recovery Act funds must incorporate the most
current DOL Wage Determination(s) as found at http://www.wdol.gov/Index.aspx
for the worker classifications applicable to the work being performed by
employees or contractors. Please also note that the rates posted at the DOL site
are minimums.
CONDITIONS
1. Bidder shall provide a payment/performance bond for the total bid price of the
project.
2. All work can be performed during normal business hours.
3. Bidder shall provide a working schedule so the office can notify the Fire Station
on the replacement schedule.
4. Contractor shall be responsible to clean interior and exterior of window and frame
of mastic and/or dirt before owner acceptance.
PAYMENT
1. A five percent (5%) retainage will affect all billings.
2. Retainage shall be paid within thirty (30) days of job acceptance.
