By signing this document, I hereby consent to the changing of Article III, Development Standards, of the Northeast
Industrial Park No. 1, No. 1 that currently reads:
1) Auto Parking. All auto parking requirements must be provided for within the property boundaries and shall set

RESOLUTION APPROVING AMENDMENT TO ARTICLE
III, NO. 1, DEVELOPMENT STANDARDS, OF THE
NORTHEAST INDUSTRIAL PARK PLAT NO. 1.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
that the amendment to Article III, No. 1, Development Standards,
of the Northeast Industrial Park Plat No. 1 be restated as
follows:
1. Auto Parking. All auto parking requirements must be
provided for within the property boundaries. On street
parking will not be permitted.

Industrial Deed of Dedication, in regards to parking setbacks in Article III, and authorizing
Mayor to sign and fully execute any needed documents.

Recommended City Council Action: Resolution approving amendment to Deed of
Dedication
Summary Statement: Back when the Northeast Industrial Park was platted, a Deed of
Dedication was included in the platting process. The Deed of Dedication included additional
setbacks for parking in Article III, above and beyond those normally necessary for other city
codes and ordinances.
In order to promote development in the area, and due to the area being zoned "M-2, P"
Planned Industrial District, which gives the City Council and staff the ability to review and
approve layouts of development anyway, the property owners are signing an amendment to
that original Deed of Dedication to eliminate the additional parking requirements. This
particular property owner spearheading the drive, Mr. Dave Nordyke, is the owner of 2550
GT Drive and is currently working to make improvements to the property to draw a new
tenant to the site. The area to put in parking (see attached) would still be over 24' from the
roadway, due to excessive right-of-way along Northeast Drive. City staff would still have the
ability, for any other changes, to review setbacks of parking for storm water, aesthetics, and
safety.

Background Information: The City of Waterloo started the Northeast Industrial Park to
help businesses locate and expand within the Waterloo community. The Deed of
Dedication was put in place to help establish good design methods for the development of
the industrial park.

Subject: Deed of Dedication Amendment for Property Located in the Northeast Industrial Park of Waterloo, Iowa.
This letter is being sent to you in -regards to a proposed re -use of the property at 2550 GT Drive as shown on the attached site plan.
As you may recall, as a part of the Deed of Dedication for the industrial park, there is a method for amending the existing Deed of
Dedication. This amendment process is as follows: "These restrictions may only be amended in writing by the agreement of not
less than 95% of the owners (in area) of the Land subject hereto. Any amendment to these restrictions shall be recorded"
I am sending this site plan and the attached document to amend Article III, No.1, Development Standards, of the Northeast
Industrial Park Plat No. 1, that currently, reads as follows:

I am asking that the Deed of Dedication be restated as follows:
1.) Auto Parking. All auto parking requirements must be provided for within the property boundaries. On street
parking will not be permitted.
In addition to the 15 foot set back called out for in the Deed of Dedication there is also a 25 foot right-of-way from the back of the
curb to the property line. So in essence, each of us needs to keep a 40 foot green space in front of our buildings along Northeast
Drive.
Attached is a drawing of the auto parking area, I wish to add in front of 2550 GT Drive. The parking would totally exist on my
property, but would not intrude into the current 25 foot right-of-way. This change in the Deed of Dedication would allow each
property owner to use all their property while still maintaining a 25 foot green space due to the right of way.
