RESOLUTION NO. 2015-220 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF CITY-OWNED PROPERTY GENERALLY LOCATED 1850 WEST RIDGEWAY, FOR $1 . 00, PLUS COSTS, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property has been made by BCS Properties, LLC in the sum of $1 . 00, plus costs, and WHEREAS, a public hearing was held on March 30, 2015, at 5: 30 p.m. in the Harold E. Getty Council Chambers, City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to BCS Properties, LLC, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on March 23, 2015, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2 . That the offer of BCS Properties, LLC to purchase real property for the sum of $1 . 00, and costs, be and it is hereby accepted in accordance with the Development Agreement for real property described below: Legal Description of Property That part of the Southwest Quarter of Section 33, Township 89 North, Range 13 West of the 5th P.M. , Black Hawk County, Iowa, described as follows: Commencing at a point on the South line of said Southwest Quarter which is 138 . 6 feet West of the Southeast corner of said Southwest Quarter; thence North 01003' 40" West, 33 feet, to the North line of Ridgeway Avenue and point of beginning; thence North 90°00' 00" West, 557 . 22 feet, along said North line; thence North 01040130" West, 1, 293 . 86 feet, to the South line of Lot 9, Jane Second Addition, Waterloo, Iowa, at a point which is 19 . 53 feet East of the Southwest corner of said Lot; thence South 89051' 10" East, along the South line of said Jane Second Addition and Jane Addition in the City of Waterloo, Black Hawk County, Iowa, 715 . 25 feet, to the East line of said Southwest Quarter; thence South 00049120" East, along said East line, 999. 57 feet; thence North 90000' West, 139. 93 feet; thence South 01°03' 40" East, 292 . 0 feet, to the point of beginning. AREA TO BE CONVEYED That part of the Southwest Quarter (SW 1-4) of Section Thirty-three (33) , Township Eighty-nine North (T89N) , Range Thirteen West (R13W) of the Fifth Principal Meridian, City of Waterloo, Black Hawk County, Iowa, Resolution No. 2015-220 Page 3 more particularly described as follows : Beginning at the Southwest corner of Parcel Document No. 2003-27008 in the Black Hawk County Recorder' s Office, which is also the Southeast corner of Parcel "J", Misc. Book 332, Page 723, said Recorder' s Office; thence N89°58' 48"E One Hundred Seventy-six (176. 00) feet along the South line of said Parcel "K"; thence SO1°27' 09"E Ten and Thirty-three Hundredths (10 . 33) feet along South-East line of said Parcel "K" to a point on a line Ten and Thirty-three Hundredths (10 . 33) feet South of and parallel to aforesaid South line; thence S89°58' 48"W One Hundred Seventy-five and Ninety-six Hundredths (175 . 96) feet along said parallel line to the Southerly extension of the East line of aforesaid Parcel "J"; thence N01040103"W Ten and Thirty-three Hundredths (10 . 33) feet along said Southerly extension to the point of beginning containing 1818 square feet . 3 . That the City of Waterloo, Iowa convey said parcel of real property to BCS Properties, LLC by deed. 4 . That the Mayor and City Clerk are hereby authorized to execute and deliver deed to BCS Properties, LLC. 5 . That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council . 6. That the City Clerk is authorized and directed to deliver said deed of conveyance to BCS Properties, LLC upon receipt in the sum of $1 . 00, and costs .
