RESOLUTION NO. 2015-214
RESOLUTION FIXING THE TIME AND PLACE OF
HEARING AND NOTICE TO BE GIVEN ON THE
VACATION OF A PORTION OF EAST SHAULIS ROAD
RIGHT-OF-WAY APPROXIMATELY 300' TO THE EAST
OF TEXAS STREET, AS APRIL 13, 2015, AT 5 : 30
P.M. IN HAROLD E. GETTY COUNCIL CHAMBERS,
CITY HALL, WATERLOO, IOWA, AND INSTRUCTING
THE CITY CLERK TO PUBLISH THE NOTICE OF
HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS FOLLOWS:
Section 1 . That the Council of the City of Waterloo, Iowa,
shall meet in the Harold E. Getty Council Chambers, City Hall, in
the City of Waterloo, Iowa, at 5 : 30 p.m. on the 13th day of
April, 2015, for the purpose of considering and acting upon a
proposal to vacate a portion of East Shaulis Road right-of-way
approximately 300' to the east of Texas Street, for the purpose
of straightening the right-of-way, and legally described as
follows :
Commencing at the Southwest Corner of Section 7,
Township 88 North, Range 12 West of the 5th P.M. , City
of Waterloo, Black Hawk County, Iowa; Thence North
89059' 14" East (Assumed Bearing) , 422 . 99 feet along the
South Line of the Southwest Quarter of said Section and
along the North Right-of-Way Line of East Shaulis Road
to the Point of Beginning of Public Right-of-Way to be
Vacated; Thence continuing North 89°59' 14" East, 140 . 84
feet along said Lines; Thence North 72021159" West,
148 . 00 feet; Thence South 00015129" East, 44 . 86 feet to
the Point of Beginning; Containing 0 . 073 Acre, subject
to easements of record.
Reference is hereby made to an Easement for Public
Highway granted to the City of Waterloo, Iowa, and
signed by Duke A. Shaulis, Avis E. Shaulis, and Lloyd
Kiefer, dated March 11, 1980, and recorded in Book 539,
Pages 298-300, on file in the Black Hawk County
Recorder' s office, Waterloo, Iowa.
Section 2 . That the City Clerk is hereby directed to
publish notice of the time and place of said hearing in the
Waterloo Courier.
