RESOLUTION FIXING THE TIME AND PLACE OF
HEARING AND NOTICE TO BE GIVEN ON THE
PROPOSED DEVELOPMENT AGREEMENT WITH BCS
PROPERTIES, LLC TO SELL AND CONVEY FOR $1 . 00,
PLUS COSTS, CITY-OWNED PROPERTY LOCATED AT
1850 WEST RIDGEWAY AVENUE, FOR THE
CONSTRUCTION OF AN APPROXIMATELY 15, 000
SQUARE FOOT COMMERCIAL BUILDING, AS MARCH 30,
2015, AT 5 : 30 P.M. IN HAROLD E. GETTY COUNCIL
CHAMBERS, CITY HALL, WATERLOO, IOWA AND
INSTRUCTING THE CITY CLERK TO PUBLISH THE
NOTICE OF HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS FOLLOWS:
Section 1 . That the Council of the City of Waterloo, Iowa
shall meet in the Harold E. Getty Council Chambers, City Hall,
in the City of Waterloo, Iowa at 5: 30 p.m. on the 30th day of
March, 2015, for the purpose of considering and acting upon a
proposed Development Agreement with BCS Properties, LLC to sell
and convey for $1 . 00, plus costs, City-owned property located at
1850 West Ridgeway Avenue, for the construction of an
approximately 15, 000 square foot commercial building, and
legally described as follows:
That part of the Southwest Quarter of Section 33,
Township 89 North, Range 13 West of the 5th P.M. , Black
Hawk County, Iowa, described as follows :
Commencing at a point on the South line of said
Southwest Quarter which is 138 . 6 feet West of the
Southeast corner of said Southwest Quarter; thence
North 01003' 40" West, 33 feet, to the North line of
Ridgeway Avenue and point of beginning; thence North
90000' 00" West, 557 . 22 feet, along said North line;
thence North 01°40' 30" West, 1, 293 . 86 feet, to the
South line of Lot 9, Jane Second Addition, Waterloo,
Iowa, at a point which is 19. 53 feet East of the
Southwest corner of said Lot; thence South 89051' 10"
East, along the South line of said Jane Second Addition
and Jane Addition in the City of Waterloo, Black Hawk
County, Iowa, 715 . 25 feet, to the East line of said
Southwest Quarter; thence South 00049' 20" East, along
said East line, 999 . 57 feet; thence North 90000' West,
139 . 93 feet; thence South 01003' 40" East, 292 . 0 feet,
to the point of beginning. The South line of said
Southwest Quarter is assumed to bear North 90000' West.

thence North 01°03' 40" West, 657 . 27 feet; thence North
90000100" East 140 . 47 feet, to the East line of said
Southwest Quarter; thence South 00053155" East, along
said East line, 657 . 24 feet, to the point and
beginning, and further excepting Parcel "1" of Plat of
Survey 328 Misc 28 of part of the Southwest Quarter of
Section 33, Township 89 North, Range 13 West of the 5th
P.M. , Black Hawk County, Iowa.

Also, that part of the Southeast Quarter of the
Southwest Quarter of Section No. 33, Township No. 89
North, Range No. 13, West of the Fifth Principal
Meridian, in the City of Waterloo, Black Hawk County,
Iowa, described as follows :
Commencing at the Southeast corner of said Southeast
Quarter of the Southwest Quarter; thence North 90
degrees West along the South line of said Southeast
Quarter of the Southwest Quarter 696. 31 feet (Record
695 . 82 feet) ; thence North 1 degree 40 minutes 30
seconds West 50 . 02 feet to a point on the North line of
Ridgeway Avenue, said point being the point of
beginning; thence North 1 degree 40 minutes 30 seconds

Quarter of the Southwest Quarter; thence North 90
degrees West along the South line of said Southeast
Quarter of the Southwest Quarter 696. 31 feet (Record
695 . 82 feet) ; thence North 1 degree 40 minutes 30
seconds West 50 . 02 feet to a point on the North line of
Ridgeway Avenue; thence West along said North line 88
feet, to the point of beginning; thence West along said
North line 88 feet; thence North 1 degree 40 minutes 30
seconds West 400 feet; thence North 90 degrees East 88
feet; thence South 1 degree 40 minutes 30 seconds East
400 feet to the point of beginning.
AREA TO BE CONVEYED
That part of the Southwest Quarter (SW 1-4) of Section
Thirty-three (33) , Township Eighty-nine North (T89N) ,
Range Thirteen West (R13W) of the Fifth Principal
Meridian, City of Waterloo, Black Hawk County, Iowa,
more particularly described as follows :
Beginning at the Southwest corner of Parcel "K",
Document No. 2003-27008 in the Black Hawk County
Recorder' s Office, which is also the Southeast corner
of Parcel "J", Misc. Book 332, Page 723, said
Recorder' s Office; thence N89058' 48"E One Hundred
Seventy-six (176. 00) feet along the South line of said
Parcel "K"; thence S01027' 09"E Ten and Thirty-three
Hundredths (10 . 33) feet along South-East line of said
Parcel "K" to a point on a line Ten and Thirty-three

Section 2 . That the City Clerk is hereby directed to
publish notice of the time and place of said hearing in the
