REGULAR SESSION

The City Council of the City of Waterloo, Iowa, met in Regular Session in the
Council Chambers of the City Hall in said City at 7030 P.M. on February 26, 1968
Mayor Turner in the Chair,
Present: Councilmen Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit.
Absent. None.
Rev. Kent Naylor, Pastor of South Waterloo Church of Brethren, offered
the Invocation.
53919 - Moved by Schmit, seconded by Miller that the Agenda, as amended., for the
Regular Session of February 26, 1968, at 7,30 P.M., be accepted and
approved..
Motion carried.
5.3920 - Moved by Cavanaugh, seconded by Keller that the Minutes of the Regular
Session held February 19, 1968, at 7030 P.M., be approved.

53921 - Moved by Miller, seconded. by Schmit that the Acting City Clerk be in-

Asst. City Engineer, transmitting the petition of Gerald. T. Hotzel,
1209 East Donald Street, et a1, representing 57% of the assessable costs
requesting sanitary sewer on East Donald Street between Moline Road and
1,960 west, together with sketch, and recommending that 1,200 be ap-
proved, be .received, placed on file, the City Engineer's recommendations
approved and said sewer ordered included in the 1968 sanitary sewer
assessment programa

53927 - Moved by Cavanuagh,seconded by Cohea that the communication from the
City Planning Commission, transmitting the request of Co Lee Fox on
behalf of Dunn's Sure Save, for the City Council to rezone on its own
motion all of Lot 16, Block 3, except the S 3' in Cowin's Second Addi-
tion, known as 1963 Franklin Street and as shown on the attached print,
from an R-2 Residence Dis trict to a C-2 General Commercial District,
and recommending approval, be received, placed on file, recommendation
approved, date of hearing set as March 18, 1968 at 7:30 P.M., and. the
City Clerk instructed to publish the necessary notice.

53928 - Moved by Dykeman, seconded by Miller that the communication from the
City Planning Commission, transmitting the request of Ronald P. McGee
for the City Council on its own motion to rezone Lot 5, Block 1 in
Summit Addition, known as 248 Sullivan Avenue, as shown on the attached
sketch, from an R-1 Residence District to an R-2 Residence District,
and recommending approval, be received, placed on file, recommendation
approved, date of hearing set as March 18, 1968 at 7030 P.M., and the
City Clerk instructed to publish the necessary notice.

53929 - Moved by Miller, seconded by Schmit that Permit No. 68-34-S for 1792'
of 8" S.P. for Carriage Hill Subdivision, and Permit No. 68-31-S for
1021' of 8" S.P. for the Garden Apartment Development, from the Iowa
State Department of Health, subject to certain conditions and require-
ments, be received and placed on file.
Motion carried.
53930 Under Council Action #53909 of 2/19/68 action was deferred until
February 26, 1968, on the City undertaking a spray program to slow the
spread of dutch elm disease to elm trees, at an estimated cost of
$1000 to $1025 per tree, and was now presented for consideration.
The City Arborist gave an oral report on information he had secured
at Ames, Iowa, earlier in the day.
Mr. John Osness, 320 Columbia Circle, President of the Audubon Society,
appeared before the Council and spoke against spraying in the Spring
but would reconsider spraying in the Fall.
After further discussion, it was moved by Dykeman, seconded by Miller
that the said spray program be not undertaken.

53931 - Moved by Miller, seconded. by Keller that the report of the Police and
Public Buildings Committee re offering for sale the houses located on
the properties known as 1824, 1515 and 1516 Ansborough Avenue and 1119
Black Hawk Road (referred. to them under C.R. #53913 of 2/19/68), be
received, placed on file, the City Clerk instructed to hire an auction-
eer to sell said houses, and. Resolution No. 18725, authorizing the sale
of said houses at public auction and the terms thereof, be adopted.

5393.2 - Moved by Cavanaugh, seconded by Miller that the communication from the
Assistant City Engineer, transmitting a report for the Idaho sewer ex-
tension in preparation for the 1968 Paving Program at an estimated cost
of $12,741.00 of which $9,500.00 would be assessable, and recommending
same be included in the next sanitary assessment program prior to the
1968 Paving Program, be received., placed on file, approved and same
ordered included in the next sanitary sewer assessment program prior to
the 1968 Paving Program.

53933 - Moved by Keller, seconded by Dykeman that the communication from the
City Engineer, transmitting an Agreement between the City of Waterloo
and the Iowa State Highway Commission wherein the said Commission agrees
to participate in the cost of repairs to the Park Avenue Bridge in the
maximum amount of $17,500.00, subject to certain requirements, and re-
commending approval, be received, placed on file, approved and the Mayor
and City Clerk authorizedto sign said. Agreement on behalf of the City
of Waterloo, Iowa.

53934 - Moved. by Miller, seconded by Keller that the communication from the City
Engineer, transmitting Change Order #4 for an extension of time on the
Logan Avenue Urban Renewal Project, Contract No. 112, submitted by
Brice, Petrides & Associates, Inc., Engineers, and recommending approval,
be received, placed on file, approved and the Mayor directed to sign
same on behalf of the City of Waterloo, Iowa.
On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted
Aye. Nay: None. Absent: None. Mayor declared the motion carried.
53935 - An Ordinance providing minimum requirements with respect to the use of
mobile homes and trailers, mobile home parks; providing the standards
therefor; providing for permits, licensing and fixing of fees therefore;
providing for the revocation of permits and licenses; providing for the
correction of existing conditions and providing for the enforcement and
penalties for the violation of the provisions of this ordinance, was
read by the Clerk.
Moved by Cohea, seconded by Dykeman that the above proposed Ordinance
be recorded as having passedits third and final reading (the first
having passed on 2/12/68 under C.R.#53856, the second under C.R.#53900
on 2/19/68).

a date for public hearing on the adoption of an Ordinance Regulating Mo-
bile Home Parks for the City of Waterloo, Iowa, be adopted.

lution accepting and approving certain offers to sell real properties to
the City and accepting and approving certain deeds (Urban Renewal), be
adopted.

53938 - Moved by Keller, seconded by Miller that Resolution No. 18728, a resolu-
tion approving the Municipal Street Finance Report to the Iowa State
Highway Commission for the Year 1967 covering the various expenditures
for Street and Parking Purposes on Municipal Streets and Parking in the
City of Waterloo, Iowa, be adopted.

53939 - Moved by Miller, seconded. by Schmit that the communication from the City
Engineer, transmitting a statement dated 2/16/68, for engineering ser-
vices from Robinson Engineering Company, Waterloo, Iowa, in connection
with the Storm and. Sanitary Sewer Program, Contract No. 79, in the City
of Waterloo, Iowa, and recommending approval, be received, placed on
file, and.Resolution No. 18729, approving the statement of said firm and
authorizing payment accordingly, be adopted.

Turner submitting for Council approval the re -appointment of Gerald Cun-
ningham, to the Board of Adjustment for a five year term to expire on
December 8, 1972, be received, placed on file and said re -appointment
approved.

submitting for Council approval the appointment of Craig Shirey, with
term to expire on October 21, 1971, and. Leonard. Philp, with term to ex-
pire on October 21, 1972, to fill vacancies on the Planning and Zoning
Commission, be received, placed on file and appointments approved.

Inc., Engineers, Waterloo, Iowa, be instructed, to prepare proposed plans
and specifications, estimated cost, form of proposal, form of contract
and bond, etc. for the construction of the Ansborough Avenue Bridge, to
be known as Bridge Contract No. 3, in the City of Waterloo, Iowa.

form of contract, estimate of cost, etc. for the construction of the
Ansborough Avenue Bridge, Bridge Contract No. 3, in the City of Waterloq
Iowa, be received, placed on file and. Resolution No. 18731, preliminari-
ly approving the plans and specifications, etc. for said bridge, be
adopted.
