REGULAR SESSION
March 18, 1968 - 7:30 P.M.
The City Council of the City of Waterloo, Iowa, met in Regular Session in the
Council Chambers of the City Hall in said. City at 7:30 P.M., on March 18, 1968.
Mayor Turner in the Chair.
Present: Councilmen Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit.
Absent: None
Rev. Kent Naylor, Pastor of South Waterloo Church of Brethren, offered
the Invocation.
54020 - Moved by Cohea, seconded by Dykeman that the Agenda, as amended, for the
Regular Session of March 18, 1968, at 7:30 P.M., be accepted and approved

54021 - Moved by Schmit, seconded by Miller that the Minutes of the Regular Ses-
sion held March 11, 1968, at 7:30 P.M., be approved as corrected.
Motion carried.
54022 - Moved by Miller, seconded by Keller that the proof of publication of the
Notice of Public Hearing on Plans and Specifications of the construction
of Ansborough Avenue Bridge in the City of Waterloo, Iowa, and the Takin
of Bids for the Improvement, known as Bridge Contract No, 3, be received',
and placed on file.
Motion carried.
54023 - The Mayor announced the time had arrived to hear objections, if any, to
the proposed plans and specifications, etc., for the construction of Ans-
borough Avenue Bridge, known as Bridge Contract No. 3, and asked if any
one present wished to be heard or make objection, or if there were any
written objections filed with the Clerk.
No one appeared to object orally, and the Clerk reported no written obj-
ections had been filed,
There being no objections made or filed, it was moved by Dykeman, secon-
ded. by Cohea that Resolution No. 18754, confirming the approval of the
plans, specifications, etc. for the construction of the Ansborough Avenu
Bridge, known as Bridge Contract No. 3, in the City of Waterloo, Iowa,
be adopted.
On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted
Aye, Nay: None. Absent: None. Mayor declared the resolution adopted.
54024 - Moved by Keller, seconded by Miller that Resolution No. 18755, ordering
the construction of Ansborough Avenue Bridge, in the City of Waterloo,
Iowa, known as Bridge Contract No. 3, be adopted.

54029 - After reviewing all the objections received, the Council found and deter-
mined that no remonstrance, pursuant to the provisions of Section 391.23
of the Code of Iowa, 1966, was filed with the Council, pertaining to any
of the sewer lines proposed to be constructed as set out in said Resolu-
tion of Necessity as originally proposed.
Whereupon, it was moved by Schmit, seconded by Cohea that Resolution No,
18756, overruling the objections to the 1968 Hansen -Noble District Storm
Sewer Program known as Contract No. 71, as proposed, be adopted.
On roll call, Cavanaugh, Cohea, Keller, Miller and Schmit voted Aye. Nay:
Dykeman. Absent: None. Mayor declared the resolution adopted.
54030 - Moved by Cavanaugh, seconded by Miller that Resolution No. 18757, adopting
the Resolution of Necessity, (as proposed) for the 1968 Hansen -Noble Dis-
trict Storm Sewer Program in the City of Waterloo, Iowa, known as Contract
No. 71, be adopted.

54031 - Moved by Miller, seconded by Schmit that Resolution No. 18758, ordering
construction and directing advertisement for bids and hearing on the
plans, specifications, form of contract, etc., for the 1968 Hansen -Noble
District Storm Sewer Program, in the City of Waterloo, Iowa, known as Con-
tract Noo 71, be adopted.
On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted
Aye. ,Nay: None. Absent: None. Mayor declared the resolution adopted.
54032 - The Engineers, having checked the bids for the construction of the Ansbor-
ough Avenue Bridge, Bridge Contract No. 3, reported that after checking
the extensions and totals of the bids submitted, the bid of Godbersen-
Smith Construction Co, of Ida Grove, Iowa, in the amount of $318,801.92
is the lowest legal bid received.
Moved by Miller, seconded by Cohea that Resolution No. 18759, accepting
the bid of Godbersen-Smith Construction Co. of Ida Grove, Iowa in the
amount of $318,801.92 for the construction of the Ansborough Avenue Bridge
known as Bridge Contract No. 3, be adopted, and the City Clerk instructed
to retain the certified checks of the two lowest bidders until a signed
contract and bond is approved by the Council, and authorized to return the
certified checks of the other unsuccessful bidders.

54033 - Moved by Miller, seconded by Cohea that the proof of publication of the
Notice of Public Hearing on Adoption of an Ordinance Regulating Mobile
Home Parks, as published in the Waterloo Daily Courier on February 29
and March 7, 1968, be received and placed on file.
Motion carried.
54034 - The Mayor then announced the time had arrived to hear objections, if any,
and asked if any one present wished to be heard or make objections, or
if there were any written objections filed with the Clerk.
The Clerk reported no written objections had been filed, and no one
appeared to object orally.
Thereupon, it was moved by Dykeman, seconded by Miller that Resolution
No. 18760, adopting an Ordinance Regulating Mobile Home Parks in a loose
leaf complete municipal code, providing minimum requirements with res-
pect to the use of Mobile Homes and Trailers, Mobile Home Parks; pro-
viding the standards therefore; providing for permits, licensing and
fixing of fees therefore; providing for the revocation of permits and
licenses; providing for the correction of existing conditionsand provid-
ingfor the enforcementard penalties for violation of the provisions of this
ordinance, be adopted.

Aye. Nay: None. Absent: None. Mayor declared the resolution adopted.
54035 - An Ordinance repealing all ordinances and parts of ordinances in con-
flict with the Ordinance Regulating Mobile Home Parks, and enacting in
lieu thereof, was read by Clerk.
Moved by Keller, seconded by Schmit that the rules requiring ordinances
to be read in full on three separate days be suspended, that said ord-
inance be recorded as having passed its first, second and third reading
and 'be now placed on its final adoption.

Aye. Nay: None. Absent: None. Mayor declared the motion carried.
54036 - Moved by Miller, seconded by Keller that Ordinance No. 2449, an ordin-
ance repealing all ordinances and parts of ordinances in conflict with
the Ordinance Regulating Mobile Home Parks, and enacting in lieu thereog
be adopted.
On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted
Aye. Nay: None. Absent: None. Mayor declared the ordinance adopted.
54037 - Moved by Cavanaugh, seconded by Dykeman that the proof of publication
of the Notice of Public Hearing on Re -zoning, upon the request of C. Lee
Fox on behalf of Dunn's Sure Save, upon the recommendation of the City i
Planning Commission and the City Council's own motion, to rezone Lot 16,
Block 3, except the S 31, in Cowin's Second Addition, known as 1963
Franklin Street, as fully described in said Notice published in the
Waterloo Daily Courier on February 29, 1968, from R-2 Residence District
to C-2 General Commercial District, be received and placed on file.
Motion carried.
54038 - The Mayor announced the time had arrived to hear objections, if any, and
asked if any one present wished to be heard or make objections, or if
there were any written objections filed with the Clerk.
The Clerk reported there were no written objections, and no one appeared
to object orally.
After public hearing, and no objections having been made or filed, it
was moved by Schmit, seconded by Miller that an Ordinance be drawn and
submitted for said re -zoning.

An Ordinance amending Ordinance No. 1734, as amended, by adding Sub -Sec-
tion No. 111 to Section 2 of said Ordinance as amended by Ordinance No.
2239, re -zoning certain property in the City of Waterloo, Iowa, was read
by the Clerk.
Moved by Cavanaugh, seconded by Keller that said Ordinance be recorded
as having passed its first reading.

Aye. Nay: None. Absent: None. Mayor declared the motion carried.
54040 - Moved by Schmit, seconded by Miller that the proof of publication of the
Notice of Public Hearing on Re -zoning, upon the request of Ronald P.
McGee, upon the recommendation of the City Planning Commission and the
City Council's own motion, to rezone Lot 5, Block 1 in Summit Addition,
known as 248 Sullivan Avenue, as fully described in said Notice publish-
ed in the Waterloo Daily Courier on February 29, 1968, from R-1 Residen-
ce District to R-2 Residence District, be received and placed on file.
Motion carried.
54041 - The Mayor announced the time had arrived to hear objections, if any, and
asked if anyone present wished to be heard or make objections, or if
there were any written objections filed with the Clerk.
The Clerk reported there were no written objections, and no one appeared
to object orally.
After public hearing, and no objections having been made or filed, it
was moved by Keller, seconded by Cohea that an Ordinance be drawn and
submitted for said re -zoning.

54042 - An Ordinance amending Ordinance No. 1734, as amended, by adding Sub -Sec-
tion No. 112 to Section 2 of said Ordinance as amended by Ordinance No,
2239, re -zoning certain property in the City of Waterloo, Iowa, was read
by the Clerk.

having passed its first reading.

54043 - Moved by Miller, seconded by Schmit that the proof of publication of the
Notice of Proposal to Dispose of Real Estate of E 50' of W 150' of Lot
45, Auditor Barnes Plat of Maywood Addition, known as 1011 Roosevelt
Street, to Ruth E. Rooff, as fully described in the Waterloo Daily
Courier Notice published February 22 and 29, 1968, be received and
placed on file.

and asked if any one present wished to be heard or make objection, or if
there were any written objections filed with the Clerk.

objections had been filed.
Thereupon, it was moved by Keller, seconded by Dykeman that Resolution
No. 18761, a resolution authorizing the sale and conveyance of the pre-
mises known as 1011 Roosevelt Street, and directing and authorizing the
Mayor and City Clerk to execute and deliver a Deed to Ruth E. Rooff, be
adopted.

the Notice of Public Hearing on Proposal to Sell. Real Estate in the City
of Waterloo, Iowa, to Richard Parker and Royce G. Parker, husband and
wife, known as Disposal Parcel. No, 15-2 in the Logan Avenue Urban Ren-
ewal Area, Project Noo Iowa R-2, as fully described in said notice pub-
lished in the Waterloo Daily Courier on February 15, 1968, be received
and placed on file.

54046 - The Mayor announced the time had arrived to hear objections, if any, and
asked if any one present wished to be heard or make objection, or if any
written objections had been filed with the Clerk.
No one appeared to object orally, and the Clerk reported there had been
no written objections placed on file.
After public hearing and no objections having been made or filed, it was
moved by Schmit, seconded by Dykeman that Resolution Noo 18762, a reso-
lution approving the sale of Disposal Parcel Noo 15-2 in the Logan Ave -
nue Urban Renewal Area, Project Noo Iowa R-2, and authorizing the execu-
tion of the necessary contract for sale of land for private redevelop-
ment and deed, be adopted.
On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted
Aye. Nay: None. Absent: None, Mayor declared the resolution adopted,
54047 - The Street Commissioner and the Streets and Alleys Committee, having
checked the bids for the purchase of two (2) Wheel Loader Tractors for
use by the Street Department (referred to them by C.Ro#53992) recommend
the acceptance of the bid of Power Equipment, Inc. of Waterloo, Iowa in
the total amount of 38490,00 for two (2), both quality and price being
taken into consideration.
Moved by Schmit, seconded by Miller that the above recommendation be
received, placed on file, the bid of Power Equipment, Inc. of Waterloo,
Iowa in t otal a m oint of S8490.00 for two (2) Wheel Loader Tractors for use
by the Street Department, both quality and price being taken into consi-
deration, accepted and the City Clerk directed and authorized to issue a
purchase order and warrant in payment for same.

54048 Attorney Upton Kepford, on behalf of the Iowa and Blackhawk County Phar-
maceutical Association, spoke to the Council in support of adoption of
an ordinance to regulate the sale and distribution of contraceptives and
venereal prophylactics.
Moved by Schmit, seconded by Miller that the petition from the Blackhawk
County Pharmaceutical Association, Waterloo, Iowa, for a law to restrict
and regulate rubber prophylactics, drugs, medicinal preparations, ap-
pliances, devices or other articles having special utility for the pre-
vention of venereal disease, so that they may be dispensed and sold only
by duly licensed physicians and in duly licensed drugstores, be received,
placed on file and referred to the City Attorney to draft an ordinance
and submit to the Council on April 1, 1968.

54049 - Moved by Dykeman, seconded by Cohea that the communication of the Pur-
chase and Financing Committee recommending entering into a contract with
Den Hartog, Rogers & Company to make a study as to the possibility and
feasibility of the City of Waterloo using data processing (see C,RO#
53978 of 3/4/68)at a cost which should not exceed 51,000, be received,
placed on file and recommendation approved.

54050 - Moved by Miller, seconded by Cavanaugh that the Agreement between Becker -
Chapman Post 138 of the American Legion and the City of Waterloo, Iowa,
as presented by James R. Wilson, Commander of said Post, covering the
services of American Legion Municipal Band for year 1968 at a sum of
$7,900.00, be received, placed on file, approved and Mayor and City Clerk
authorized to sign said Agreement for the City of Waterloo, Iowa.

54051 - An Ordinance amending Ordinance No. 1537, as amended, prohibiting the dis-
charge of firearms within the City of Waterloo, Iowa, by adding Section 3
to said Ordinance as amended, prohibiting the discharge and carrying of
air rifles,Pelietguns, sling shots, or similar devices capable of dischar-
ging any leaden or other dangerous missile or substance within the City
of Waterloo, Iowa, was-r2ad by the Clerk.
Moved by Schmit, seconded by Keller that said Ordinance be recorded as
having passed its first reading.

54052 - Moved by Miller, seconded by Cohea that the communication from the Urban
Renewal Administrator, transmitting an appropriate resolution authorizing
the Waterloo Board of Park Commissioners to act on behalf of the City of
Waterloo to accept an Open Space Grant of $153,900 for the acquisition
and development of the Hawkeye Park, be received, placed on file and
Resolution No. 18763, a resolution approving and providing for the execu-
tion of a proposed contract for a Federal Grant to acquire and/or develop
open -space land, numbered contract No. Iowa-OSC-19 (G), by and between
the City of Waterloo, Iowa, acting through its Board of Park Commission-
ers and the United States of America, represented by the Secretary of
Housing and Urban Development, be adopted.

the minutes of the Waterloo Urban Renewal Board for their regular meetings
held on February 6 and 27, 1968, in the City of Waterloo, Iowa, be adop-
ted,

Street Commissioner, recommending a deadline date of April 10, 1968,
for the filing of all petitions for new oiling of streets to be inclu-
ded in the 1968 Oiling Program, be received, placed on file, approved
and date set as recommended

54058 - Moved by Cavanaugh, seconded by Keller that the communication from the
City Engineer, transmitting a copy of the City of Waterloo application
to the Iowa Natural Resources Council for the construction of the Ans-
borough Avenue Bridge over Black Hawk Creek, Bridge Contract No. 3, and
Iowa Natural Resources Council Order No. 68-50 granting their approval
subject to the conditions stated in the order, together with a set of
approved plans, be received, placed on file and the said conditions set
out in the Council Order No. 68-50, approved.
