The City Council of the City of WG':erloo, Iowa, met in Regular Session in the Council Chambers of the City Hall in said City at 7:30 P M., on March 25, 1968. Mayor Turner in the Chair. Present: Councilmen Cavanau`z, Cohea, Dykeman, Keller, Miller and Schmit. Absent: None. Rev. Kent Naylor, Pastor of South Waterloo Church of Brethren, offered the Invocation 54065 - Moved by Miller, seconded by Keller that the Agenda, as amended, for the Regular Session of March 25, 1968, at 7:30 P M., be accepted and approved Motion carried. 54066 - Moved by Schmit, seconded by Miller that the Minutes of the Regular Ses- sion held March 18, 1968, at 7:30 P M , be approved Motion carried. 54067 - Moved by Cavanaugh, seconded by Cohea that the certification of the City Clerk as to the posting and mailing of the Notice of Public Hearing to determine whether the Community Action Council of Black Hawk County, Iowa be designated as the authority within the City of Waterloo, Iowa, to ad- minister the existing office of Economic Opportunity Programs and any further programs under the Economic Opportunity Act, be received, and placed on file. Motion carried. 54068 - The Mayor then announced the time had arrived to hear objections, if any, and asked if any one present wished to be heard or make objection, or if there were any written objections filed with the Clerk, No oral objections were made and the Clerk reported no written objections had been filed Thereupon, it was moved by Cavanaugh, seconded by Schmit that Resolution No. 18768, being a resolution under the provisions of the 1967 amend- ments to the Economic Opportunity Act designating the Community Action Council of Black Hawk County, Iowa, as the authority within the City of Waterloo, Iowa, to administer the existing Economic Opportunity Programs and any further programs under the Economic Opportunity Act, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 54069 - Mr. Richard Conerd, 1026 Fulton Street, appeared before the Council and reported that Howard S Tournier was operating an auto salvage and junk yard at 900 Fulton Street without a license. Mr. Clarence "Mac" McCombs, also spoke, explaining he was running a legi- timate auto salvage yard at 620 Short Street, same being licensed, where- as Mr. Tournier was operating illegally. - 2 - 54070 - Moved by Miller, seconded by Cohea that the comnunication from the City Engineer, transmitting the request of Iowa Public Service Company, with six (6) copies of Iowa State Highway Commission Form 562 with sketch attached, for approval of underground construction of gas main to cross Highway #63 at Shaulis Road, and recommending approval, be received, placed on file, approved and the City Clerk authorized to sign said App- lication on behalf of the City of Waterloo, Iowa. Motion carried. 54071 - Moved by Miller, seconded by Cavanaugh that the communication from the City Planning Couuuission, transmitting a petition from Luella Cranston, et al, requesting that the East-West road couuuonly called Forty and Eight Road, in the recently annexed area, be named, reporting the Streets and Alleys Committee recommended the name Ranchero Road, and recommending approval of said street name, be received, placed on file, the name of Ranchero Road approved, and an Ordinance o-dered draw.i and submitted. Motion carried. 54072 - An Ordinance naming a certain unnamed street, commonly called Forty and Eight Road, to Ranchero Road, in the City of Waterloo, Iowa, was read by the Clerk. Moved by Dykeman, seconded by Keller that said Ordinance be recorded as having passed its first reading. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted Aye. Nay: None. Absent: None. Hastings, M.D. and Marion B. Hastings, 110 Sunset Road Jack and Lori White, 147 South Hackett Road Motion carried. 54074 - Moved by Keller, seconded by Cohea that the communication from the Asst. Chief of Police, reporting on the request for installation of a school signal at East 4th and Adams Streets, referred to the Police Department under C.R.#53993 of 3/11/68, be received, placed on file, and request denied. Motion carried. 54075 - Moved by Keller, seconded by Cavanaugh that the Contract and Bond of Er- nster & Company, Inc., Waterloo, Iowa, Contractors, for the relocation of Sanitary Sewer for U.S. Highway #63, known as Minor Contract No. 38, be received, placed on file, and Resolution No. 18769, approving said contract and bond, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. March 25, 1968 - 3 - 54076 - Moved by Cohea, seconded by Schmit that the communication from the City Attorney, transmitting a Discrimination in Housing Ordinance, as instr- ucted by Council Action #53998 of 3/11/68, be received and placed on file. Motion carried. 54077 A Discrimination in Housing Ordinance, being an ordinance defining un- fair or discriminatory practices inhousing within the City of Waterloo, Iowa, setting out procedures for filing of complaints, hearings thereon, the issuance of orders to cease and desist from any discriminatory or unfair practices in housing including orders to take affirmative actions and providing for judicial review, was read by the City Clerk. Moved by Miller, seconded by Keller that the said Ordinance be recorded as having passed its first reading. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted Aye. Nay: None. Absent: None. Mayor declared the motion carried. 54078 - An Ordinance amending Ordinance No. 1537, as amended, prohibiting the discharge of firearms within the City of Waterloo, Iowa, by adding Sec- tion 3 to said Ordinance as amended, prohibiting the discharge and car- rying of air rifles, pellet guns, sling shots, or similar devices capa- ble of discharging any leaden or other dangerous missile or substance within the City of Waterloo, Iowa, was read by the Clerk. Moved by Schmit, seconded by Miller that said Ordinance be recorded as having passed its second reading (the first having passed under Council Action #54051 of 3/18/68). On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted Aye. Nay: None. Absent: None. Mayor declared the motion carried. 54079 - An Ordinance amending Ordinance No. 1734, as amended, by adding Sub -Sec- tion No. 112 to Section 2 of said Ordinance as amended by Ordinance No. 2239, re -zoning certain property in. the City of Waterloo, Iowa, was read by the Clerk. Moved by Dykeman, seconded by Cohea that said Ordinance be recorded as having passed its second reading (the first having passed under CORD# 54042 of 3/18/68). On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted Aye. Nay: None. Absent: None. Mayor declared the motion. carried.. 54080 - An Ordinance amending Ordinance No. 1734, as amended, by adding Sub -Sec- tion No. 111 to Section 2 of said Ordinance as amended by Ordinance No. 2239, re -zoning certain property in the City of Waterloo, Iowa, was read by she Clerk. Moved by Cavanaugh, seconded by Cohea that the rules requiring ordinances to be read in full on three separate days be suspended, said OrdiAance be recorded as having passed its second and third readings (the first having passed under C0Ro#54039 of 3/18/68) and be now placed on its fi- nal adoption. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted Aye. Nay: None. Absent: None. Mayor declared the motion carried. March 25, 1968 - 4 54081 - Moved by Cohea, seconded by Keller that Ordinance No. 2450, an Ordinan- ce amending Ordinance No. 1734, as amended, by adding Sub -Section No.111 to Section 2 of said Ordinance as amended by Ordinance No. 2239, re- zoning certain prop€.ty in the City of Waterloo, Iowa, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted Aye. Nay: None. Absent: None. Mayor declared the ordinance adopted. 54082 - Moved by Keller, seconded by Schmit that Resolution No. 18770, being a Resolution confirming and ratifying the execution of a Quit Claim Deed to J. R. Morrison dated November 6, 1956, conveying Lots 1 and 2, Block 1, Peek's Second Addition, with exceptions as described in said Deed, in the City of Waterloo, Iowa, by Glenn S. Stech, the then. Mayor of the City of Waterloo, Iowa, and Alvin C. Schmanski, the then Acting City Clerk, of the City of Waterloo, Iowa, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 54083 - Moved by Schmit, seconded by Miller that the communication from the City Engineer, transmitting a statement dated 3/15/68, for engineering ser- vices from Robinson Engineering Company, Waterloo, Iowa, in connection with the Storm and Sanitary Sewer Program, Contract No. 79, in the City of Waterloo, Iowa, and recommending approval, be received, placed on file, and Resolution No. 18771, approving the statement of said firm and authorizing payment accordingly, be adopted, On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted Aye. Mayor declared the resolution adopted, 54084 - Moved by Miller, seconded by Cohea that the communicationfrom the City Engineer, transmitting Progress Report, pictures and Partial Payment Estimate #6 Report prepared by Brice, Petrides & Associates, Inc., En- gineers, as to work performed and ma' _als furnished by J. F. Brennan Company, Inc., LaCrosse, Wisconsin, Contractors, for the Virden Creek Enclosure from Edwards Street to Cedar River, Contract No. 76, in the City of Waterloo, Iowa, be received, placed on file, and Resolution No. 18772, approving the report of the Engineers and authorizing payment accordingly, be adopted. Mayor declared the resolution adopted. 54086 - Moved by Schmit, seconded by Dykeman that the communication from Mayor Turner submitting for Council approval the appointment of Art Carter, 725 Adams Street, to fill a vacancy on the Zoning and Planning Commis- sion, with term to expire on October 21, 1972, be received, placed on file, and appointment approved. Motion carried. March 25, 1968 - 5 - 54087 - Moved by Keller, seconded by Miller that communication from Mayor Turner submitting for Council approval the name of Harry Blindman, for re -appoi- ntment to the Urban Renewal Board for a five-year term expiring on March 1, 1973, be received, placed on file and re -appointment approved.
