AFFIDAVIT OF POSSESSION
TO WHOM IT MAY CONCERN: STATE OF IOWA, BLACK HAWK COUNTY, ss:
The undersigned, being first duly sworn on oath, deposes and states as follows:
That City of Waterloo, Iowa is now the record titleholder of the following described real estate
situated in Black Hawk County, Iowa:
That part of the real estate described on Exhibit "A" attached hereto that lies
Northeasterly of the Northeasterly line of Parcel "E" of Plat of Survey Doc. No, 2009-
15639 in the Original Plat, on the West Side of the Cedar River, City of Waterloo, Iowa.
That said City of Waterloo, Iowa is now in complete actual and sole possession of all of said real
estate except as may be herein stated. That this affidavit is made from the personal knowledge of the
undersigned, who is familiar with said real estate, its titleholders, and its parties in possession; and that
this affidavit is for the purpose of confirming title to the above-described real estate under the
provisions of Sections 614.17 and 614.17A, Code of Iowa, and other statutes relative thereto.

RESOLUTION NO. 2017-567
RESOLUTION APPROVING A PERMANENT EASEMENT
AGREEMENT WITH GRAND INVESTMENTS, LLC, FOR THE
PURPOSE OF ALLOWING ACCESS TO CITY OWNED
FLOOD WALL LOCATED WEST OF 425 CEDAR STREET,
AND AUTHORIZE MAYOR AND CITY CLERK TO EXECUTE
SAID AGREEMENT.
WHEREAS, the Permanent Easement Agreement, dated July 17, 2017, of the following
described parcel, is to allow the City of Waterloo to construct, inspect, maintain, repair, operate,
or remove a City owned flood wall located west of 425 Cedar Street.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the Permanent Easement Agreement with Grand Investments, LLC
and the City of Waterloo, Iowa, for parcel described below, all of which is situated in the City of
Waterloo, Black Hawk County, State of Iowa, is accepted and approved:
DESCRIPTION: PERMANENT EASEMENT
PARCEL "H" OF PLAT OF SURVEY DOC. #2017-15863 FILED MARCH 13,
2017 AND AS CORRECTED BY DOC. #2017-16486 FILED MARCH 24,2017,
BEING PART OF LOTS 1 & 2 IN BLOCK 2, AS PART OF VACATED CEDAR
STREET, A PART OF VACATED WEST 3RD STREET AND ALSO A PART
OF PARCEL "E" OF PLAT OF SURVEY DOC. #2009-15639; ALL IN THE
ORIGINAL PLAT OF THE WEST SIDE OF THE CEDAR RIVER.
