Mayor Turner in the Chair. ' Present: Councilmen Cavanaugh, Cohea, Dykenan., Keller, Miller and Schmit. Absent: None. Rev. 0. Motion carried. 54297 - Moved by Cohea, seconded by Schmit that the Minutes of the Regular Session held April 22, 1968,.at 7:30 P.M., be approved. Motion carried. 54298 - Moved by Miller, seconded by Schmit that the proof of publication of the "Notice of Hearing on the Issuance of $53,000 Street Improvement Bonds of the City of Waterloo, Iowa", (Special Assessments) to be issued in anti- cipation of the deferred payment of assessments levied for the 1967 Pav- ing Program #2, known as Paving Contract No. 114, in the City of Waterloo, Iowa, be received and placed on file. Motion carried. - 2 54299 - The Mayor announced this was the time for public hearing on the matter of the issuance of $53,000 Street Improvement Bonds, and asked whether any written objections had been filed. No oral objections were offered and the City Clerk advised no written ob- jections had been filed. Moved by Cavanaugh, seconded by Dykeman that the proof of publication of the "Notice of Bond Sale" for the sale of $53,000 Street Improvement Bonds (Special Assessments) for the 1967 Paving Program #2, known as Paving Con- tract No. 114, in the City of Waterloo, Iowa, be received, and placed on file. Motion carried. 54300 - This also being the time and place for the opening of bids for the sale of said above described bonds, the meeting was thrown open for the receipt of bids for said bonds. Moved by Miller, seconded by Cohea that the following sealed bids be rec- eived, placed on file, but NOT OPENED: 1. Peoples Bank & Trust Co., Waterloo, Iowa 2. Carleton D. Dain, Kalman & Quail, Inc., Davenport, Iowa Motion carried. 54301 - Open bids were then called for, and there being none, it was moved by Mil- ler, seconded by Cohea that the sealed bids be opened, being as follows, and referred to the City Clerk and Auditor for checking and report back to the Council: Effective or Net Interest Rate 1. Dain, Kalman & Quail, Inc., Davenport, Iowa 4.9349 Motion carried. 54302 - The City Clerk and Auditor, having checked the bids submitted for the $53,000 Street Bonds being offered for sale in connection with the 1967. Paving Program #2, Contract No. 114, referred to him by Council Action # 54301 reported that after checking the bids, the bid of Peoples Bank & Trust Company of Waterloo, Iowa, being an effective interest rate of 4,85L30]-7owas the best bid received. After due consideration of the bids received, it was moved by Miller, se- conded by Cohea that Resolution No. 18843, directing the sale of $53,000 Street Improvement Bonds of Waterloo, Iowa, to Peoples Bank & Trust Com- pany of Waterloo, Iowa, for the 1967 Paving Program #2, known as Paving Contract No. 114, in the City of Waterloo, Iowa, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 54303 - Moved by Keller, seconded by Schmit that the communication from the City Engineer, recommending acceptance of the low bid of Hub Electric Company, Waterloo, Iowa, Contractors, in the amount of $14,985.00 for the 1968 Street Lighting Program, Contract No. 26, on ',rich Council action was de- ferred under C.R.#54263 of 4/22/68, be received, placed on file, bids re- jected and the City Engineer instructed to prepare new specifications, etc. from Washington Street to Franklin Street and submit same to the Council in thirty days. Mayor declared the resolution adopted. 54304 - Moved by Cavanaugh, seconded by Keller that the proof of publication of the Notice of Public Hearing on Re -zoning on the application of J. Byron Guernsey, on behalf of Wendell Lockard et al, upon the recommendation of the City Planning Commission, and the City Council's own motion, to re- zone all of Block 45, Original Plat Waterloo East, all of Block 5, Sulli- van Day's Addition, Lots 1 and 2 in Cooley's East Addition, Lots 1, 2 and 3 in Lane and Fowler's Second Addition and Lot 1, Block 9 in Lane and Fowler's Addition, as more fully described in Notice published April 15, 1968, in the Waterloo Daily Courier, from an R-2 Residence District to a C-2 General Commercial District, be received and placed on file. Motion carried. 54305 - The Mayor announced the time had arrived to hear objections, if any, and asked if anyone present wished to be heard or make objections, or if there were any written objections filed with the Clerk. The Clerk reported there were no written objections on file and no one appeared to object orally. After public hearing and no objections having been made or filed, it was moved by Cohea, seconded by Cavanaugh that an Ordinance be drawn and sub- mitted for said re -zoning. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted Aye. Nay: None. Absent: None. Mayor declared the motion carried. 54306 - An Ordinance amending Ordinance No. 1734, as amended, by adding Sub -Sec- tion No. 113 to Section 2 of said Ordinance as amended by Ordinance No. 2239 rezoning certain property in the City of Waterloo, Iowa, was read by the Clerk. Moved by Dykeman, seconded by Keller that the said Ordinance be recorded as having passed its first reading. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted Aye. Nay: None. Absent: None. Mayor declared the motion carried. 54307 - Moved by Miller, seconded by Cohea that the proof of publication of the Notice of Public Hearing on Proposal to Sell Real Estate in the City of Waterloo, Iowa, to Warren Transport, Inc., known as Disposal Parcel No. 9 in the Westfield -Virden Urban Renewal Area, Project No. Iowa R-7, in the City of Waterloo, Iowa, for the sum of $23,0J0.00, as fully described in the said notice published in the Waterloo Daily Courier on April 4, 1968, be received and placed on file. Motion carried. 54308 - The Mayor announced the time had arrived to hear objections, if any, and asked if anyone present wished to be heard or make objections, or if any written objections had been filed with the Clerk. No one appeared to object orally, and the Clerk reported there had been no written objections placed on file. May 6, 1968 4 54308 - (Continued) After public hearing and no objections having been made or filed, it was moved by Keller, seconded by Dykeman that Resolution No. 18844, a reso- lution approving the sale of Disposal Parcel No. 9 in the Westfield -Vir- den Urban Renewal Area, Project No. Iowa R-7, and authorizing the execu- tion of the necessary contract for sale of land for private redevelopment and deed, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 54309 - Mr. Lonnie Moore, 123 Ash Street, presented to the Council a petition re- questing the 100 block of Ash Street, starting from corner of Ash and Douglas Streets going south, be paved or asphalted. Moved by Cavanaugh, seconded by Cohea that the above petition be received, placed on file and referred to the City Engineer. Motion carried. 54310 - Moved by Dykeman, seconded by Cohea that the communication from the City Engineer, transmitting the petition from Warren and Mary Amo, 915 Shef- field Avenue, et al, representing 46% of the total assessable property, requesting installation of sanitary sewer on Sheffield Avenue from Regal Avenue to Mitchell Avenue, as shown on the attached print, reporting the estimated cost for said improvement is approximately $6,000 of which $5,000 would be assessable, same would be feasible and could be scheduled for a future program, be received, placed on file, approved and said san- itary sewer ordered included in a future program. Motion carried. COUNCILMAN MILLER NOW ABSENT 54311 - Moved by Keller, seconded by Schmit that the communication from the Heat- ing Inspector, transmitting the request of the Home Improvement Company, Des Moines, Iowa, for a refund of Certificate of Competency fee in the amount of $100.00, as no Longer in the heating business in Waterloo, Iowa, and recommending approval, be received, placed on file, and refund gran- ted. On roll call., Cavanaugh, Cohea, Dykeman, Keller and Schmit voted Aye. Nay: None. Absent: Miller. Mayor declared the motion carried. 54312 - Moved by Dykeman, seconded by Keller that the communication from the Hea- ting Inspector, transmitting the request of R.E. Morris, 3560 Lafayette Road, Evansdale, Iowa, for refund of Certificate of Competency fee in the amount of $100000, as no longer in the heating business in Waterloo, Io- wa, and recommending approval, be received, placed on file and refund granted. On roll. call, Cavanaugh, Cohea, Dykeman, Keller and Schmit voted Aye. Nay: None. Absent: Miller. Mayor declared the motion carried. 54313 - Moved by Cohea, seconded by Schmit that the communication from the City Engineer, transmitting a letter from the Iowa State Highway Commission with five (5) copies of Application Form #559 with attached print, from Robert C. & Joyce E. Broshar, for permission to construct an 18' Type "C" (Residential) entrance to U.S. Highway #63 at Sta. 328+18.5, on the south- erly side, and recommending approval subject to. provisions of his letter and at no cost to the City, concurred by the Police Department, be recei- ved, placed on file, recommendations approved and the Mayor and City Clerk May 6, 1968 5 54313 - (Continued) authorized to sign said application on behalf of the City of Waterloo, Iowa. Motion carried. 54314 - Moved by Schmit, seconded by Keller that the communication from the City Engineer, transmitting the request of Charles Granger, for permission to construct a curb cut on South Street to serve 525 West Fifth Street and to asphalt pave the balance of parking area on South Street, as shown on attached sketch, and recommending approval subject to provisions of his letter with existing curb cuts on Fifth Street to be closed and new full height curb and gutter installed and approach be portland cement con- crete, concurred by the Police Department, be received, placed on file, recommendations approved and permission granted in accordance therewith and at no cost to the City. Motion carried. 54315 - Moved by Dykeman, seconded by Cohea that the communication from the City Engineer, transmitting the request of Gerald Deuth, Architect, in behalf of the Waterloo Public Libraries, for permission to widen the existing curb cut on South Street at the rear of the West Public Library, as shown on the attached sketch, and recommending approval subject to the provis- ions of his letter, with approach to be portland cement concrete, con- curred by the Police Department, be received, placed on file, approved and permission granted in accordance therewith, at no cost to the City. Motion carried. 54316 - Moved by Schmit, seconded by Cohea that the communication from the City Engineer, transmitting the request of United Auto Workers Local 838 for permission to construct three (3) temporary asphalt driveways, two (2) on Rainbow Drive, and one (1) on Ansborough Avenue, as shown on the at- tached print, and recommending approval with asphalt construction, sub- ject to the provisions of his letter, concurred by the Police Department, be received, placed on file, recommendations approved and permission granted in accordance therewith at no cost to the City. Motion carried. 54317 - Moved by Dykeman, seconded by Cohea that communication from the City En- gineer, transmitting two petitions from Mr. and Mrs. Vernon Bunce, 208 Carrington Avenue, and Mr. and Mrs. Robert Wade, 240 Carrington Avenue, et al, requesting an intersection and crossing of new Highway #63, one request for Movilla Street to Upland Drive, the other at a location be- tween Campbell Avenue and Movilla Street, and recommending he be instruc- ted to present said petitions to the Iowa State Highway Commission, toge- ther with his study of possible crossings, to determine if arrangements can be made with said Commission to provide the crossing for the new highway, be received, placed on file, and recommendations approved. Motion carried. COUNCILMAN MILLER NOW PRESENT 54318 - Moved by Miller, seconded by Keller that the communication from the City Engineer, transmitting the request of Ray J. Neisen, 245 Letsch Road for permission to install a temporary septic tank at 245 Letsch Road, and advising same could be allowed providing connection to the new sewer line is completed as soon as same is ready, and the report of the Administra- tor of Inspections, be received, placed on file, and permission granted in accordance with the City Engineer's report. Campbell, 3922 Sager Avenue, et al, to open Sager Avenue east of Progress Avenue to South Hackett Road, referred to him under C,R.#54260 of 4/22/68, stating that addi- tional right-of-way is required, be received, placed on file, and addi- tional time allowed to secure same. Motion carried. 54320 - Moved by Keller, seconded by Dykeman that the communication from the Urban Renewal Administrator, submitting for Council consideration the offer of W. T. Smith and Annie Smith, Husband and Wife, to purchase Dis- posal Parcel No. 15-6 and Part of 15-5, all of Tract E and Tract F, in the Logan Avenue Urban Renewal Area, Project No. Iowa R-2, in the City of Waterloo, Iowa, for the sum of $1,350.00, together with Map No. 7, and reporting the Urban Renewal Board approved said disposal, be recei- ved, placed on file, Resolution No. 18845, authorizing the sale of said Disposal Parcel No. 15-6 and Part of 15-5, all of Tract E and Tract F, be adopted, and the date of hearing set as June 10, 1968, at 7:30 P0Mo On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted Aye. Mayor declared the resolution adopted. 54321 - Moved by Schmit, seconded by Cohea that the petition of Mr. and Mrs. Norman James Brimmer, 159 Rebecca Lane, et al, offering to deed 60' of land unto the City of Waterloo, Iowa, for street purposes in return for grading, making of ditches, rocking of road, oiling and general mainten- ance of Rebecca Lane, be received, and placed on file, and referred to the Mayor for further study. Motion carried. 54322 - Moved by Schmit, seconded by Cohea that the communication from the City Planning Commission, transmitting a request from Mayor M. Sidney Leder- man of the City of Evansdale, Iowa, for consideration of the City of Wa- terloo, Iowa, to an adjustment in the Ely City Limits Line involving property East of West line of North Evans Road between. Highway #20 and Waterloo Railroad R -O -W, and recommending the City not contest the le- gal action if instigated by the City of Evansdale and at no cost to the City of Waterloo, also the triangle of land formed by the Cedar River, River Forest Road and Central Avenue if extended to the West be inclu- ded, as shown on the attached print, be received, placed on file and said recommendations approved with legal descriptions to be approved and confirmed by the City Engineer and the City Attorney before consent is communicated to the City of Evansdale, Iowa. Lang, conveying unto the City of Waterloo, Iowa, a sixty (60) foot frontage road East of Sheerer Avenue and South of U.S. Highway No. 218, together with sketch, and recommending approval, be received, placed on file, and Resolution No, 18848, approving and accepting said Deed, and directing the City Clerk to have same recorded, be adopted. Motion carried. 54329 - Moved by Cohea, seconded by Miller that the communication from the City Engineer, transmitting construction plans for improvements to be placed in the Subdivision to be known as "SOUTHGATE THIRD ADDITION", and repor- ting same are ready for Council approval, be received, placed on file and approved. Mayor declared tneresolution adopted. 54332 - An Ordinance amending Ordinance No. 2446 known as the Milk Ordinance repealing all of Item 17p. Cooling of Milk under Section 7. Standards for Milk and Milk Products and enacting in lieu thereof a new Item 17p. Cooling of Milk providing for cooling requirements for milk and milk products. Said Ordinance further repeals Item 21p. Vehicles which is a part of Section 7. Standards for Milk and Milk Products and enacts in lieu thereof a new Item 21p. Vehicles which provides for the con- struction and maintenance of vehicles transporting pasteurized milk. and milk products, was read by the Clerk. Moved by Cohea, seconded by Schmit that the rules requiring ordinances to be read in full on three separate days, be suspended, that said ordinance be recorded as having passed its first, second and third readings, and be now placed on its final adoption. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit vo- ted Aye. Nay: None. Absent: None. Mayor declared the motion carried. 54333 - Moved by Schmit, seconded by Cohea that Ordinance No, 2456, an ordin- ance amending Ordinance No. 2446 known as the Milk Ordinance repealing all of Item 17p. Cooling of Milk under Section 7. Standards for Milk and Milk Products and enacting in lieu thereof a new Item 17p. Cooling of Milk providing for cooling requirements for milk and milk products. Said ordinance further repeals Item 21p. Vehicles which is a part of Section 7. Standards for Milk and Milk Products and enacts in lieu thereof a new Item 21p. Vehicles which provides for the construction and maintenance of vehicles transporting pasteurized milk and milk pro- ducts, be adopted. Chief of Police and Chief of Detectives, and establishing the rank of Bureau Commander in lieu thereof, was read by the Clerk. Moved by Cavanaugh, seconded by Dykeman that said Ordinance be recorded as having passed its third reading (the first having passed under Coun- cil Action #54225 of 4/15/68, the second under Council Action #54268 of May 6, 1968 9 54334 - (Continued) 4/22/68) and be now placed on its final adoption. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted Aye. Nay: None. Absent: None. Mayor declared the motion carried. 54335 Moved by Keller, seconded by Cohea that Ordinance No. 2457, an Ordinance repealing in its entirety Ordinance No. 1444, the establishment of the office of Assistant Chief of Police Department; abolishing the ranks and positions of Assistant Chief of Police and Chief of Detectives, and es- tablishing the rank of Bureau Commander in lieu thereof, in the City of Waterloo, Iowa, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and Schmit voted Aye. Nay: None. Absent: None. Mayor declared the ordinance adopted. 54336 - An Ordinance Adding a New Sub -Section Titled (g) to Section 12 of Ordin- ance No. 1540 Waiving a License Fee to Distribute or Post Advertising Matter if the Same is Done by a Bona Fide Non -Profit Organization or Du- ly Chartered Non -Profit Corporation and Adding a New Sub -Section Titled (f) to Section 14 of Ordinance No. 1540 Waiving a Peddler's License Fee if the Same is Done by a Bona Fide Non -Profit Organization or Duly Char- tered Non -Profit Corporation, was read by the Clerk. Moved by Cohea, seconded by Dykeman that the rules requiring ordinances to be read in full on three separate days be suspended, said Ordinance be recorded as having passed its second and third readings (the first having passed under Council Action #54269 of April 22, 1968) and be now placed on its final adoption.
