REGULAR SESSION
September 16, 1968 - 7:30 P.M.
The City Council of the City of Waterloo, Iowa, met in Regular Session in the
Council Chambers of the City Hall in. said City at 7:30 P.M., on September 16,
1968.
Mayor Turner in the Chair.
Councilmen
Present: /Cavanaugh, Cohea, Dykeman, Keller, Miller and O'Connor.
Absent: None.
Msgr. E. P. Ament, Pastor of St. Mary's Church offered the Invocation.
55105 - Moved by Keller, seconded by Miller that the Agenda, as proposed, for
the Regular Session of September 16, 1968, at 7:30 P.M., be accepted
and approved.
Motion carried.
55106 - Moved by Cohea, seconded by O'Connor that the Minutes of the Regular
Session held September 9, 1968, at 7:30 P.M., be approved.
Motion carried.
55107 - Moved by Miller, seconded by Cavanaugh that the proof of publication
of the notice of proposal to dispose of real estate, being certain
streets and alleys in Logan Dale Heights and Enterprise Place in the
City of Waterloo, Iowa, as more fully described in the publication
in the Waterloo Daily Courier on August 22 and 29, 1968, to Chamberlain
Corporation, be received and placed on file.
Motion carried.
55108 - The Mayor announced the time had arrived to hear objections, if any,
and asked if any one present wished to be heard or make objections, or
if any written objections had been filed with the Clerk.
No one appeared to object orally, and the Clerk reported no written
objections had been filed.
Thereupon, it was moved by Cavanaugh, seconded by Dykeman that an
Ordinance be drawn and submitted vacating certain streets and alleys
in Logan Dale Heights and Enterprise Place, in the City of Waterloo,
Iowa, as fully described in the published notice in the Waterloo
Daily Courier on August 22 and 29, 1968.
Motion carried.
55109 - An Ordinance vacating certain streets and alleys in Logan Dale Heights
and Enterprise Place, in the City of Waterloo, Iowa, was read by the
Clerk.
Moved by Keller, seconded by Cohea that the said Ordinance be recorded
as having passed its first reading.
On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and O'Connor voted
Aye. Nay: None. Absent: None, Mayor declared the motion carried.
55110 Mayor Turner orally reported to the Council on the happenings in the City
in the last ten days, including the tension at East High School and
damage done, especially on the East Side. He told of the severe action
taken, thanked the Council for their backing, and said action would be
on a day to day basis. Further, the National Guard was called due to
the great amount of damage done and was here for security and law
enforcement purposes, which duties they are performing. The Police are
working on twelve hour shifts. The Highway Patrol, Deputy Sheriffs,
Sheriff Reserves and Auxiliary Police have all been helping. He
commended all of them for their help and complimented them on the way
they were handling the situations. The Mayor expressed belief that
with all the important action being taken and the Council support,
law and order could be maintained. The City Attorney and Staff were
working very closely with all the actions taken. He said lawlessness
will not be tolerated and the citizens and property of the community
will be protected. Mayor Turner thanked the Council for their support
and co-operation in this time of crisis.
55111 - Wallace Butler, Attorney, representing the citizens in the immediate
neighborhood, a one family single home area, bound by South Hackett
Road on the west, Knoll Street on the east, Highway #218 on the north,
and Black Hawk Road on the south, in Alabar Hills and Lockard Addition,
where the Catholic Charities, Inc. contemplate a multiple -family low-
cost housing project, objected to the erection of said project as it
would depreciate the value of the one -family dwellings, stating the
only objection was economics, and presented a petition containing 1251
signatures of persons against the Catholic Charities, Inc. building
said multiple -family low-cost housing as it will depreciate their
home valuations.
After discussion, it was determined that no action could be
by the Council other than contacting the Archbishop James Jo
Archdiocese of Dubuque, Dubuque, Iowa, and informing him of
feeling of the people in the area.

There was an urgent plea. for additional police protection as some persons
who circulated the petition have been threatened.
Councilman Dykeman mentioned the Council should (1) support the action
of the group, (2) strongly urge the Catholic Charities, Inc. to study
the petition, and (3) the City should check to be absolutely sure that
the structure would comply with the building code.
Councilman Miller commended the people for coming to the Council with
the petition and hoped a satisfactory solution would be arrived at.
Moved by Miller, seconded by Dykeman that the petition be received,
placed on file and forwarded to Archbishop James J. Byrne, Archdiocese
of Dubuque, Dubuque, Iowa.

55112 - Mr. Roger LaCoste, 2415 West 8th Street, appeared before the Council
with reference to Dry Run Creek permanent easement and presented a
petition signed by property owners along Dry Run Creek stating they
would not voluntarily grant the City a permanent easement along said
creek but would grant a temporary easement for straightening and
cleaning the channel for the duration of construction.

Moved by O'Connor, seconded by Miller that the above mentioned petition
be received, placed on file and referred to the City Attorney for
temporary easement.

55113 Mr. Lloyd Jurgensen, 2073 Plymouth Avenue, appeared before the Council
and spoke on several subjects, including suggestions for the Police
Department, flood gate at Byron Avenue sewer inlet, and repainting of
street signs in the parking lots.
55114 Mrs. Ruth B. Anderson, 1503 Newell Street, spoke to the Council about
three critical areas in Waterloo, namely housing, education and jobs,
and supported the multiple family low-cost housing project, expressing
the hope that the Council will have the courage to take advantage of
this opportunity, that the project will have the support of every
concerned citizen in Waterloo and that the 1,251 citizens might change
their attitudes so that their concern might be more than just economic.
55115 Moved by Dykeman, seconded by Cohea that the communication from the
City Engineer, transmitting a petition from Roland and Dorothy
Winkelpleck, 647 Kirkwood Avenue, et al, representing 857 of the
assessable cost, for concrete curb and gutter on Kirkwood Avenue from
Bismark Avenue to Stratford Avenue, as shown on the attached plat,
and recommending denial, be received, placed on file, recommendations
approved, petition denied, and the City Engineer, upon the completion
of the Hansen -Noble storm sewer in said area, instructed to include
said street in a future street improvement program.

55116 - Moved by Keller, seconded by Cavanaugh that the communication from the
City Engineer, transmitting the request of Iowa Public Service Company
for permission to hang a 12" gas line on the Ansborough Avenue Bridge,
as shown on the attached sketch, and recommending approval with 10c
per lb., per foot, be charged, be received, placed on file, recommenda-
tions approved, permission granted in accordance therewith and the
City Clerk directed to bill Iowa Public Service Company as recommended.

55117 - Moved by Cohea, seconded by O'Connor that the communication from the
City Engineer, transmitting a letter from the Iowa Public Service
Company, together with six (6) copies of Iowa State Highway Commission
application #562, with sketch attached, for underground construction
of a gas main along Highway #57 and Burton Avenue, and recommending
approval, be received, placed on file, approved and the City Clerk
authorized to sign said application on behalf of the City of Waterloo,
Iowa.

City Engineer, transmitting the request of Alvin C. Franzen and Mrs.
Florence Smith by Lenore DeGrief, Conservator, with five (5) copies of
Iowa State Highway Commission Application Form #559 with attached
sketch, for permission to widen an existing 18' entrance to a 24' Joint
Type "C" (Residential) entrance to North -Bound U.S. Highway #63

Mulberry Street, and recommending approval subject to the provisions of
his letter, and at no cost to the City, be received, placed on file,

sign said application on behalf of the City of Waterloo, Iowa.

Engineer, transmitting the request from Ernie Matthias, Jr. for two
35' curb cuts to be left at the time concrete paving is installed on
Hammond Avenue for the Grace Baptist Church property, as shown on the
attached sketch, and recommending approval, be received, placed on file
and approved.

City Engineer, transmitting the request of Richard Manfull for
permission to construct a temporary asphalt driveway without regard
to sidewalk grade at 144 Lichty Road, Waterloo, Iowa, together with
$3000 in currency for recording a waiver, and recommending approval
subject to the provisions of his letter, be received, placed on file,
request approved and Resolution No. 19178, granting permission and
authorizing construction irrespective of a later official grade, be
adopted.

City Engineer, transmitting the request of George A. Dewey for
permission to construct a temporary asphalt driveway without regard
to sidewalk grade at 4006 Midway Drive, Waterloo, Iowa, together with
$3.00 incurrency for recording a waiver, and recommending approval
subject to the provisions of his letter, be received, placed on file,
request approved and Resolution No. 19179, granting permission and
authorizing construction irrespective of a later official grade, be
adopted.

permissionto construct a temporary concrete driveway without regard
to sidewalk grade at 507 Cornwall Avenue, Waterloo, Iowa, together
with $3.00 in currency for recording a waiver, and recommending
approval subject to the provisions of his letter, be received, placed
on file, request approved and Resolution No. 19180, granting permission
and authorizing construction irrespective of a later official grade,
be adopted.

City Engineer, transmitting a Preliminary Study and Report as prepared
by Brice, Petrides & Associates, Inc., Engineers, Waterloo, Iowa, for
the Construction of Virden Creek Enclosure and Dam from Reservoir to
Existing Enclosure, and recommending said report be studied further
and the provisions in this report be reviewed with U.S, Corps of
Engineers for recommendations of the overall flood control plan for
Virden Creek, be received, placed on file, recommendations approved,
and the City Engineer instructed to study same further and to proceed
with the work needed now.

the City Engineer, transmitting an Easement from Building Land Company
for construction of storm sewer in connection with Crossroads
Shopping Center, Contract Noo 79, and recommending approval, be
received, placed on file, easement approved and accepted, and the City
Clerk instructed to have same recorded.

City Engineer, transmitting four (4) copies of Contract for Engineering
Services with Brice, Petrides & Associates, Inc., Engineers, Waterloo,
Iowa, for the design, preparation of plans, specifications and estimates
for sanitary sewer extension along U.S. Highway #20 west to City
Limits, and recommending approval, be received, placed on file, approved
and Resolution No. 19181, approving and directing the execution of
said Contract by the Mayor and City Clerk on behalf of the City of
Waterloo, Iowa, be adopted.

Iowa, for the design, preparation of plans, specifications, and
estimates for repairs to, Park Avenue Bridge and Approaches, and
recommending approval, be received, placed on file, approved and
Resolution No. 19182, approving and directing the execution of said
Contract by the Mayor and City Clerk on behalf of the City of Waterloo,
Iowa, be adopted.

55127 - Moved by Keller, seconded by Cohea that the communication from the City
Planning Commission transmitting Preliminary Plat of PROSPECT CIRCLE
ADDITION in the City of Waterloo, Iowa, the Engineer's Certificate of
Survey, Deed of Dedication, City Engineer's Report, and City Planning
Commission's resolution of approval, and recommending approval, be
received, placed on file and Resolution No. 19183, approving said
Preliminary Plat, be adopted.

55128 - An Ordinance providing for the regulation, licensing, inspection and
operation of ambulances; for the licensing of ambulance drivers,
attendants, and attendant -drivers; providing for renewal and revocation
of licenses; requiring written records and reports; providing traffic
regulations for ambulances, and establishing penalties for violation
of its provisions, was read by the Clerk.

as having passed its first reading.

resolution accepting and approving certain offers to sell real
properties to the City and accepting and approving certain deeds
(Urban Renewal), be adopted.

City Engineer, transmitting a statement dated 9/10/68 for engineering
services from Brice, Petrides & Associates, Inc., Engineers, Waterloo,
Iowa, in connection with the Ansborough Avenue Bridge, in the City of
Waterloo, Iowa, and recommending approval, be received, placed on
file and Resolution No. 19185, approving the statement of said firm
and authorizing payment accordingly, be adopted.

Waterloo, Iowa, for the Fire Sub -Stations Nos. 3, 4, 6 and 8
(Mechanical Contract), in the City of Waterloo, Iowa, and recommending
approval, be received, placed on file and Resolution No. 19188, approving
the report and authorizing payment accordingly, be adopted.

City Engineer in connection with petitions for a new crossing of Highway
#63 to serve residences west of Ansborough Avenue and north of new
Highway #63 (see C.R. #54317 of 5/6/68), transmitting an approval
letter from the Iowa State Highway Commission for an approved crossing
which extends Movilla Street south to connect with Martin Road, together
with print, and recommending if approved crossing is approved by City
that the City Engineer be instructed to proceed with the acquisition
of right-of-way and the negotiations with the railroad for the crossing,
be received, placed on file and recommendations approved.

55141 - Moved by Miller, seconded by Cohea that the report of the City
Attorney, advising that the bonds filed with the City Clerk up to the
close of business on September 16, 1968, as shown on the list attached
to said report, have been approved by him, be received, placed on file,
and the report and bonds approved.

55142 - Moved by Cohea, seconded by Miller that the Council adjourn to meet
as a Board of Health.

BOARD OF HEALTH MEETING
September 16, 1968 - 9:05 P.M.
The City Council of the City of Waterloo, Iowa, met as a Board of Health in
the Council Chambers of the City Hall in said City on September 16, 1968, at
9:05 P.M.
Mayor Turner in the Chair.
Present: Councilmen Cavanaugh, Cohea, Dykeman, Keller, Miller and O'Connor.
Absent: None.
Moved by Cohea, seconded by Miller that the communication from the
City Planning Commission, transmitting proposed development plans
for the Iseman Corporation Mobile Home Park, together with application
for Iowa State Department of Health permit to establish a mobile
(home park on a tract of land lying West of intersection of U.S.
Highway No. 20 and Canfield Road, known as 1608 Canfield Road,
and letters from George Keith, Atty. for Iseman Corporation and
the City Engineer, and recommending approval subject to the
provisions of the above mentioned letters, be received, placed
on file and plans and application approved.
Motion carried.
There being no further business, it was moved by Keller, seconded
by Dykeman that the Board of Health adjourn.
