The City Council of the City of Waterloo, Iowa, met in Regular Session in the Council Chambers of the City Hall in said City at 7:30 P.M., on October 21, 1968. Mayor Turner in the Chair. Present: Councilmen Cavanaugh, Cohea, Dykeman, Keller and Miller. Absent: Councilman O'Connor. Rev. Stuecker, Pastor of St. Ansgar Lutheran Church offered the Invocation. 55326 - Moved by Keller, seconded by Cohea that the Agenda, as proposed, for the Regular Session of October 21, 1968, at 7:30 P.M., be accepted and approved. Motion carried. 55327 - Moved by Dykeman, seconded by Miller that the Minutes, corrected as follows, of the Regular Session held October 14, 1968, at 7:30 P.M,, be approved: Council Action 55278 From: Waterloo Insurance Co. Waterloo, Iowa (No $57,247.00 Umbrella) To: Waterloo Insurance Co. Motion carried. Waterloo, Iowa (Umbrella) $57,247.00 55329\- Moved by Cavanaugh, seconded by Cohea that the above bids be received, placed on file, and referred to the City Arborist and the Public Grounds and Health Committee to check and report back to the Council on October 28, 1968. 55328V Motion carried. Des Moines, Iowa Motion carried. $13,749025 $12,390.00 $13,832.00 55330 - The Fire Chief and Fire Department Conmdttee, having checked the bids for the purchase of one (1) Motorized Unit for use by the Fire Department (referred to them by C0R0 #55283) , recommend the accept- ance of the bid of Schukei Motor Company of Waterloo, Iowa in the amount of $3,125.57, both quality and price being taken into consideration. Moved by Dykeman, seconded by Miller that the above recommendation be received, placed on file, the bid of Schukei Motor Company of Waterloo, Iowa in the amount of $3,125.57 for one (1) Motorized Unit for use by the Fire Department, both quality and price being taken into consideration, be accepted and the City Clerk be directed and authorized to issue a purchase order and warrant in payment for same° On roll call, Cavanaugh, Cohea, Dykeman, Keller and Miller voted Aye. Nay: None, Absent: O'Connor. Mayor declared the motion carried. 55331 - The Street Commissioner and the Streets and Alleys Committee, having checked the bids for one (1) Cinder Spreader and one (1) Front End Loader to be used by the Street Department (referred to them by C0Re#55281) recommend the acceptance of the bid of Ardick Equipment Co. of Des Moines, Iowa in the amount of $2,237000 for the one (1) Cinder Spreader, and the bid of All Wheel Drive Co. of Cedar Falls, Iowa inthe amount of $13,386056 for one (1) Front End Loader, both quality and price being taken into consideration.. Moved by Cohea, seconded by Keller that the above recoil aendations be received, placed on file, the said bids accepted and the City Clerk instructed and authorized to issue purchase orders and warrants in payment for same accordingly. On roll call, Cavanaugh, Cohea, Dykeman, Keller and Miller voted Aye. Nay: None. Absent: O'Connor. Mayor declared the motion carried. 55332 - Mr. Laurence Smith, speaking to the Council on behalf of Jens Olesen & Sons Construction Co., requested permission to dynamite the area in the western portion of Crossroads Center, Inc., property approximately 700' southeast of Highway 412 and approximately 3/8ths of a mile southwest of Highway 218 in order to lay sanitary sewer and water lines, and presented a written request for permission. Moved by Keller, seconded by Miller that said request be received, placed on file and permission grantedto use dynamite in said area subject to the supervision and recommendations of the City Engineer, and that a letter be submitted to the City of Waterloo by Jens Olesen & Sons Construction Co. relievingthe City of any liability before said dynamiting is done. Motion carried° October 21, 1968 - 3 - 55333 - Mr. Carl Kessel, 1964 Independence Avenue, asked the Council if there was any solution to the problem on Blowers Creek. Mayor Turner indicated the City has not as yet heard from the Iowa Resources Council. 55334 - Mr. William Walker, 429 East Ridgeway Avenue, a home builder, spoke to the Council in regard to the new zoning ordinance and requested reconsideration of the change from five foot minimum side yard to 20% of total lot. Moved by Miller, seconded by Keller that the above oral request be received and placed on file. Motion carried. 55335 - Mr. Don Slaughter, 1231 Bishop Avenue, reported to the Council there was water on Bishop Avenue near Rooff Road and would like to have relief. 55336 - Moved by Cavanaugh, seconded by Cohea that the communication from the City Engineer, transmitting the request of Hinson Division - Royal Industries with five (5) copies of Iowa State Highway Commission Form #559 with print attached, for permission to construct a 45' Type "B" (Commercial) entrance to U.S. 20 and Iowa 57 at Sta. 159+63, on the north side, and recomwending approval subject to provisions of his letter and at no cost to the City, concurred by the Police Depart- ment, be received, placed on file, recommendations approved and the Mayor and City Clerk authorized to sign said application on behalf of the City of Waterloo, Iowa. Motion carried. 55337 - Moved by Dykeman, seconded by Cavanaugh that the communication from the City Engineer, transmitting the request of James A. Melendy for permission to construct a temporary asphalt driveway without regard to sidewalk grade at 305 Downing Avenue, Waterloo, Iowa, together with $3.00 check for recording a waiver, and recoluwending approval subject to the provisions of his letter, be received, placed on file, request approved and Resolution No. 19266, granting permission and authorizing construction irrespective of a later official grade, was adopted. Mayor declared the resolution adopted. 55338 - Moved by Miller, seconded by Cohea that the Contract and Bond of Denman Phillips Construction Co., Waterloo, Iowa, for the Demolition of Old Buildings in 500 Block of Commercial Street, in the City of Waterloo, Iowa, being Demolition Contract No. 3, be received, placed on file and Resolution No. 19267, approving said Contract and Bond, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller and Miller voted Aye. Nay: None. Absent: O'Connor. Motion. carried. 55341 Moved by Cohea, seconded by Dykeman that the coniuiunicati.on from the City Engineer, transmitting Estimate #3 Report, together with progress report and picture, submitted by Brice, Petrides & Associates, Inc., Waterloo, Iowa, Engineers, as to work performed and materials furnished by Godbersen-Smith Construction Co., Contractors, Ida Grove, Iowa, for the construction of the Ansborough Avenue Bridge, known as Bridge Contract No. 3, in the City of Waterloo, Itwa:,.and recommend- ing approval, be received, placed on file aridResolution, No. 19269, approving the Estimate #3 Report of the said firm and authorizing payment accordingly, be adopted. Mayor declared the resolution adopted. 55342 - Moved by Miller, seconded by Dykeman that the conounication from the City Engineer, transmitting Estimate #2 Report, together with progress report and picture, submitted by Brice, Petrides & Associates, Inc., Waterloo, Iowa, Engineers, as to work performed and materials fur- nished by Godbersen-Smith Construction Co., Contractors, Ida Grove, Iowa, for the construction of Ansborough Avenue, Approaches, Paving, Sewers & Incidentals, known as Contract No. 116, in the City of Waterloo, Iowa, and reconuffiending approval, be received,, placed on file and Resolution Noo 19270, approving the Estimate #2 Report of the said firm and authorizing payment accordingly be adopted.
