The City Council of the City of Waterloo, Iowa, met in Regular Session in the Council Chambers of the City Hall in said City at 7:30 P.M., on November 25, 1968. Mayor Turner in the Chair. Present: Councilmen Cavanaugh, Cohea, Dykeman, Miller and O'Connor. Absent: Councilman Keller. Urban Renewal Administrator, George Griebenow offered the Invocation. 55502 - Moved by Miller, seconded by Dykeman that the Agenda, amended as follows, for the Regular Session of November 25, 1968 at 7:30 P.M. be accepted and approved: Adding after HEARING (page 1) VACATION OF CERTAIN STREETS ETC. the following: INFORMAL BIDS PURCHASE ONE 1969 4 -DOOR TWO SEAT STATION WAGON - FIRE DEPARTMENT Open sealed informal bids. Receive bids, file and refer to Fire Chief and Fire Dept. Committee. Receive recommendation and accept bid. Adding after NEW BUSINESS (page 2) OILING - 1968 Attend Function Police Chief for two Patrolmen to attend Police -School Liaison Program, Flint, Michigan and Evanston, Illinois, December 1 thru 7, 1968, inclusive° Motion carried. 55503 - Moved by Cohea, seconded by Miller that the Minutes of the Regular Session held November 18, 1968 at 7:30 P.M. and the Board of Health Meeting held November 18, 1968 at 9:00 P.M., be accepted and approved. Motion carried. 55504 Moved by Dykeman, seconded by O'Connor that the proof of publication of the Notice of Public Hearing on the proposal to vacate certain streets and alleys in the City of Waterloo in order to expedite the redevelopment plan for the Westfield -Virden Urban Renewal Project Iowa R-7, be received and placed on file. Motion carried. 55505 - The Mayor announced the time had arrived to hear objections, if any, and asked if anyone present wished to be heard or make objection, or if any written objections had been filed with the Clerk. The Clerk reported no written objections had been filed and no oral objections were made. Thereupon, it was moved by Cavanaugh, seconded by Dykeman that an Ordinance be drawn and submitted for the vacation of certain streets and alleys, as fully described in the notice published in the Waterloo Daily Courier on October 31 and November 7, 1968. 2 55505 - (Continued) On roll call, Cavanaugh, Cohea, Dykeman, Miller and O'Connor voted Aye. Mayor declared the motion carried. 55506 - An Ordinance vacating part of certain streets and alleys in the City of Waterloo, Black Hawk County, Iowa, in order to expedite the redevelopment plan for the Westfield -Virden Urban Renewal Project, Iowa R-7, was read by the Clerk. Moved by Cohea,seconded by O'Connor that the rules requiring ordinances to be read in full on three separate days be suspended, that the said ordinance be recorded as having passed its first, second and third readings, and be now placed on its final adoption. On roll call, Cavanaugh, Cohea, Dykeman, Miller and O'Connor voted Aye. Nay: None. Absent: Keller. Mayor declared the motion carried. 55507 - Moved by O'Connor, seconded by Cohea that Ordinance No. 2475, an Ordinance vacating part of certain streets and alleys in the City of Waterloo, Black Hawk County, Iowa, in order to expedite the redevelopment plan for the Westfield -Virden Urban Renewal Project, Iowa R-7, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Miller and O'Connor voted Aye. Nay: None. Absent: Keller. Mayor declared the ordinance adopted. 55508 - Moved by Miller, seconded by Cohea that the City Clerk be instructed to open the sealed informal bids on one (1) 1969, four -door, two seat station wagon for use by the Fire Department, which were as follows: Name of Bidder Feldman Pontiac, Inc. Simpson Motors, Inc. Motion carried. Address Waterloo, Iowa Waterloo, Iowa Amount $2,942.34 $3,445000 55509 - Moved by Dykeman, seconded by Cavanaugh that the above bids on one (1) 1969, four -door, two seat station wagon for use by the Fire Department, be received, placed on file and referred to the Fire Chief and Fire Department Counuittee to check and report back to the Council on December 2, 1968. Motion carried. 55510 - Moved by Dykeman, seconded by Miller that the communication from Wallace Wo Butler, Atty. on behalf of Paul D. Chambers et al, requesting the proposed new Zoning Map be amended in such a way that the area presently zoned R-2 Residence District lying South of Headford Avenue, East of Scott Avenue, North of Robin Road and West of Black Hawk and Ansborough Avenue, with the exception of Lockard Addition and the land owned by Smitty's Trailer Court, be limited to one and two family residences, be received and placed on file. Motion carried. 55511 - Moved by Dykeman, seconded by Cohea that the communication from the City Planning Commission, transmitting a proposed new zoning ordinance and map and recommending approval together with opinion from Asst. City Solicitor, be received, placed on file, recommendation approved, date of hearing set as December 16, 1968 at 7:30 P.M. and the City November 25, 1968 3 55511 - (Continued) Clerk instructed to publish the necessary notice. Mayor declared the motion carried. 55512 - Moved by O'Connor, seconded by Dykeman that the communication from the City Engineer, transmitting the request of Phillip F. and Lillian Ohl, with five (5) copies of Iowa State Highway Commission Form #559 with attached print, for permission to widen an existing 18' entrance to a 35' Type "B" (Commercial) entrance to U.S. Highway #20 at Sta. 281+ 92, on the westerly side, approximately 89' southerly from centerline of Eleventh Street, and recommending approval subject to the provisions of his letter and at no cost to the City, concurred by the Police Department, be received, placed on file, recommendations approved and the Mayor and City Clerk authorized to sign said applicationon behalf of the City of Waterloo, Iowa. Motion carried, 55513 - Moved by Dykeman, seconded by Cavanaugh that the communication from the City Engineer, transmitting five (5) copies of Iowa State Highway Commission Form #559, with attached print, from "Minnie Pearl Chicken Systems" for permission to construct a 35' Type "B" (Conudiercial-Food Service) Entrance to U.S. Highway #218 at Sta. 744+24, on the east side, approximately 63' south of Centerline of Locke Avenue, and recommending approval subject to the provisions of his letter and at no cost to the City, concurred by the Police Department, be received, placed on file, recommendations approved and the Mayor and City Clerk authorized to sign said application on behalf of the City of Waterloo, Iowa. Motion carried, 55514 - Moved by Cohea, seconded by O'Connor that the communication from the City Engineer, transmitting five (5) copies of Iowa State Highway Commission Form #559, with print attached, from Frank J. Fox for permission to widenan existing 24' entrance to a 45' type "B" (Commercial) entrance to U.S. Highway #218 at Sta. 776+27, on the westerly side, which is approximately 147' northerly of centerline, extended, of Byron. Avenue, and recommending approval subject to the provisions of his letter and at no cost to the City, concurred by the Police Department, be received, placed on file, recommendations approved and the Mayor and City Clerk authorized to sign said application on behalf of the City of Waterloo, Iowa. Motion carried. 55515 - Moved by Cavanaugh, seconded by Dykeman that the communication from the Building Official, transmitting Building Permit No. 69458 for 328 West Park Avenue and request of Don Gardner for refund of $9.00 as work is not to be done, and recouuuending approval, be received, placed on file and refund granted. Mayor declared the motion carried, 55516 - Moved by O'Connor, seconded by Cohea that the Audit Reports covering the Year 1967 on various funds of the City of Waterloo, Iowa, as made by Den Hartog, Rogers & Co,, Certified Public Accountants, Waterloo, Iowa, and Waterloo Water Works, Waterloo Municipal Airport, and McElroy Memorial Auditorium as made by Carney, Alexander, Marold & Co., - 4 55516 - (Continued) Certified Public Accountants, Waterloo, Iowa, be received and placed on file. Motion carried. 55517 - Moved by Dykeman, seconded by Cohea that the communication from the Asst. City Solicitor, transmitting an Easement dated 11/10/68 for utility sanitary sewer and drainage area purposes from Ray J. and Virginia M. Miller, husband and wife, in connection with the Hawkeye Tech Program in Section 13 -88N -13W and recommending approval, be received, placed on file, approved and accepted, and the City Clerk instructed to have the same recorded. On roll call, Cavanaugh, Cohea, Dykeman, Miller and O'Connor voted Aye. Nay: None. Absent: Keller. Mayor declared the motion carried. 55518 - Moved by Cohea, seconded by O'Connor that the Contract of Diesch Constructors, Inc., Waterloo, Iowa, Contractors, for the installation of asphalt surfacing at Parking Lot on Coulinercial Street between West Fourth Street and West Park Avenue, in the City of Waterloo, Iowa, known as Minor Contract No. 46, be received, placed on file and Resolution No. 19335, approving the contract, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Miller and O'Connor voted Aye. Nay: None. Absent: Keller. Mayor declared the resolution adopted. 55519 Moved by Cohea, seconded by O'Connor that the Uniform Offer and Acceptance Contract dated 10/24/68 between R. William Merner, Assignee, Earle L. Brown Implement Co. and the City of Waterloo, Iowa, wherein the City offers to buy Lots 4 and 5, Block 48, Original Plat West, known as 401 West 6th Street and 810 Bluff Street, in. the City of Waterloo, for the sum $8,000 for street purposes, be received, placed on file, said contract approved with the provision that taxes payable in 1969 be paid by the seller, up-to-date abstract and deed furnished by seller and approved by the City Attorney, and the Mayor and City Clerk authorized and directed to execute said Contract with the above provisions on behalf of the City of Waterloo, Iowa. City Solicitor, transmitting a proposed "Glue Sniffing" Ordinance, referred to him under C.R. #55462 of 11/12/68, be received and placed on file. Motion carried. 55521 An Ordinance prohibiting the illegal use (commonly known as "Glue Sniffing") of model glue, hair spray, inhalers, and other solvents or chemicals having the property of releasing toxic vapors, was read by the City Clerk. Moved by Miller, seconded by Dykeman that said Ordinance be recorded as having passed its first reading. On roll call, Cavanaugh, Cohea, Dykeman, Miller and O'Connor voted Aye. Nay: None. Absent: Keller. Mayor declared the motion carried. November 25, 1968 - 5 55522 - An Ordinance amending Ordinance No. 1745 by changing Section 2 (a), making the annual permit fee ten dollars; and adding a section providing for inspection fees both for annual licenses and temporary licenses, was read by the City Clerk. Moved by Cavanaugh, seconded by O'Connor that said Ordinance be recorded as having passed its first reading. On roll call, Cavanaugh, Cohea, Dykeman, Miller and O'Connor voted Aye. Nay: None. Absent: Keller. Mayor declared the motion carried, 55523 Moved by Cohea, seconded by Cavanaugh that Resolution No. 19336, making assessments for cleaning of vaults in the City of Waterloo, Iowa, for the Calendar Year 1968, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Miller and O'Connor voted Aye. Nay: None. Absent: Keller. Mayor declared the resolution adopted. 55524 Moved by Miller, seconded by Cohea that Resolution No. 19337, being a resolution accepting and approving certain offers to sell real properties to the City and accepting and approving certain deeds (Urban Renewal), be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Miller and O'Connor voted Aye. Nay: None. Absent: Keller. Mayor declared the resolution adopted. 55525 - Moved by Cavanaugh, seconded by Dykeman that the communication from the City Engineer, transmitting Monthly Estimate #2 Report as submitted by Robinson Engineering Company, Waterloo, Iowa, as to work performed, and materials furnished by Rooff Construction Company, Waterloo, Iowa for the Storm and Sanitary Sewer Program 1968, Contract No. 79, in the City of Waterloo, Iowa, and recommending approval, be received, placed on file, and Resolution No. 19338, approving the report and authorizing payment accordingly, be adopted. Mayor declared the resolution adopted. 55526 Moved by Dykeman, seconded by O'Connor that the communication from the City Engineer, transmitting the statement dated 11/19/68, for engineering services from Robinson Engineering Company, Waterloo, Iowa, in connection with the Sanitary and Storm Sewer Extensions through Crossroads Center, Inc., Contract No. 79, in the City of Waterloo, Iowa, and recommending approval, be received, placed on file, and Resolution No, 19339, approving the statement of said firm and authorizing payment accordingly, be adopted. Mayor declared the resolution adopted. 55527 Moved by Cohea, seconded by Cavanaugh that the communication from the City Engineer, transmitting Partial Payment Estimate #13 Report prepared by Brice, Petrides & Associates, Inc., Engineers, as to work performed and materials furnished by J. F. Brennan Company, Inc., LaCrosse, Wisconsin, Contractors, for the Virden Creek Enclosure from Edwards Street to Cedar River, Contract No. 76, in the City of Waterloo, Iowa, be received, placed on file and Resolution No. 19340, approving the report of the Engineers and authorizing payment accordingly, be adopted. November 25, 1968 6 - 55528 Moved by O'Connor, seconded by Dykeman that the communication from the City Engineer, transmitting Final Estimate Report and Certificate of Completion and Recommendation of Acceptance submitted by Brice, Petrides & Associates, Inc,, Consulting Engineers, Waterloo, Iowa, as to work performed and materials furnished by Cedar Falls Construction Co. of Cedar Falls, Iowa, Contractors, for the Eighteenth Street Bridge Repairs, known as Bridge Contract No. 2, in the City of Waterloo, Iowa, and recommending approval, be received, placed on file, approved and Resolution No. 19341, approving the report, accepting the work and authorizing payment accordingly, be adopted.
