The City Council of the City of Waterloo, Iowa met in Regular Session in. the Council Chambers of the City Hall in said City at 7:30 P.M. on February 3, 1969. Mayor Turner in the Chair. Present: Absent: 55821 - Councilmen Cavanaugh, Cohea, Dykeman, Keller, Miller and O'Connor. None. Councilman Charles Dykeman offered the Invocation. Moved by Miller, seconded by Keller that the Agenda, as proposed, for the Regular Session. of February 3, 1969 at 7:30 P.M,, be accepted and approved„ Motion carried. 55822 - Moved by Keller, seconded by O'Connor that the Minutes of the Regular Session held January 27, 1969 at 7:30 P.M., be approved. Motion carried, 55823 Moved by Keller, seconded by Cohea that the Report of the Traffic, Sign and Paint Department Supervisor and the Finance and Purchasing Coumxittee on the bids for traffic paint and paint thinner to be used by the Traffic, Sign and Paint Department (which bids were referred to them for checking under C.,R,#55790), recommending the acceptance of the low total bid of Vogel Paint & Wax Company of Orange City, Iowa, be received, placed onfile, the recommendation approved, the said bid accepted, and the City Clerk and Auditor instructed and authorized to issue a purchase order for same,. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and O'Connor voted Aye. Nay: None. Absent: None. Mayor declared the motion carried. 55824 Mr, Donald Kearns, 1739 Corning Avenue, presented the Council with a petition requesting that Lockard Addition be included in the R-2 One and Two Family Residence District of the new zoning plan. Mr. William E. Beery, 1429 Downing Avenue, spoke in support of the petition,. Moved by Miller, seconded by Cohea that the above petition be received, placed on file and referred to the City Planning Conuuission, with a report back to the Council on February 24, 1969. Motion carried. 55825 Moved by Cavanaugh, seconded by Keller that the communication from the City Engineer, transmitting the request from the Northwestern Bell Telephone Company, Waterloo, Iowa, for permission to place conduit on Dundee Avenue from Falls Avenue to Downing Avenue and on Ansborough Avenue from Downing Avenue to Black. Hawk Road, as shown on the attached print, and recommending approval subject to the provisions of his letter, be received, placed on file, recommendations approved and permission granted in accordance therewith. Motion carried. 55826 - Moved by O'Connor, seconded by Dykeman thatthe communication from the City Engineer, transmitting a petition from David Rainey, 835 Linden 2 55826 (continued) Avenue, et al, representing 437 of assessable properties, for asphalt paving on Linden Avenue from Glenwood Avenue to Independence Avenue, as shown on the attached print, and reporting this could be included in the 1969 Asphalt Paving Program, be received, placed on file and said street ordered included in the 1969 Asphalt Paving Program. Motion carried. 55827 - Moved by Keller, seconded by Cohea that the communication from the City Engineer, transmitting the request from Richard J. Clute for permission to blacktop the alley between Steely and Mohawk Streets from Independence Avenue to Glenwood Street, as shown on the attached print, and recommending this entire alley be improved with portland cement concrete, be received, placed on file, action deferred, and said request referred to the. Streets and Alleys Committee with a report back to the Council in two weeks. Motion carried. 55828 Moved by Dykeman, seconded by Keller that the communication from the City Planning Commission, transmitting the request of Richard H. Young for the Council on its own motion to rezone from A-1 Agricultural District to R-2 One and Two Family Residence District, R-3 Multiple Residence District, and R-4 Multiple Residence District, land east of Hoover Junior High School and west of Kimball Avenue, as shown on the attached map and legally described in the attached schedules A, B and C, and recommending approval, be received, placed on file, recommenda- tions approved, date of hearing set as February 24, 1969, at 7:30 P.M. and the City Clerk instructed to publish the necessary notice. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and O'Connor voted Aye. Nay: None. Absent: None. Mayor declared the motion carried. 55829 Moved by Miller, seconded by O'Connor that the communication from the Black Hawk County Civil Defense Board, transmitting six (6) copies of the model Local Directive on Updating Local Civil Defense Plans, and recommending Council consideration and implementation to provide a more complete local Civil Defense Emergency plan of action, be received, placed on file, recommendations and plan approved, and the Mayor and City Clerk authorized and directed to sign same on behalf of the City of Waterloo, Iowa. Motion carried. 55830 - Moved by Cavanaugh, seconded by Cohea that the Agreement between Becker -Chapman Post No. 138 of the American Legion and the City of Waterloo, Iowa, as presented by G. W. Bateman, Commander of said Post, covering the services of the American Legion Municipal Band for the year 1969 at a sum of $7,900.00, be received, placed on file, approved and the Mayor and City Clerk authorized to sign said Agreement for the City of Waterloo, Iowa. On roll call, Cavanaugh, Cohea, Dykeman, Keller. Miller and O'Connor voted Aye. Nay: None. Absent: None, Mayor declared the motion carried. February 3, 1969 - 3 - 55831 - Moved by Keller, seconded by Dykeman that the communication from the Waterloo Humane Society, transmitting an agreement for the colletion, impounding and disposition of dogs, cats, etc., effective January 1, 1969, on a schedule fee basis, be received, placed on file, action deferred, and said agreement referred to the Finance and Purchasing Committee with a report back to the Council on February 10, 1969. Motion carried. 55832 - Moved by O'Connor, seconded by Cohea that the communication from the Asst. City Solicitor, transmitting a Warranty Deed dated 11/1/68 from Carrie H. Jago, a widow, Ruth M. and. Donald Z. Huntley, husband and wife, conveying unto the City of Waterloo, Lot 22, Block 5, in Gates Park Place, known as 2153 East 4th Street, for the Virden Creek Develop- ment Program, and recommending approval, be received, placed on file, and Resolution No. 19459, approving and accepting said Deed, and directing the City Clerk to have same recorded, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and O'Connor voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 55833 - Moved by Cohea, seconded by O'Connor that the communication from the Asst. City Solicitor, transmitting an Easement dated 1/23/69 from Harold D. and Mildred M. Stiles, husband and wife, for sanitary sewer purposes on Highway 57, and recommending acceptance, be received, placed on file, approved and accepted, and the City Clerk instructed to have the same recorded. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and O'Connor voted Aye. Nay: None. Absent None. Mayor declared the motion carried. 55834 - Moved by Dykeman, seconded by Cohea that the communication from the Asst. City Solicitor, transmitting three (3) easements from (1) Mary Maxine and Merle Fay, wife and husband, dated 3/25/68, (2) Marian Frances and Leo Bernardy, wife and husband, dated 3/4/68, and (3) Mae E. McMahon, an unremarried widow, dated 8/14/68, all in Section 12 -89N -13W, for sanitary and storm sewer purposes, and recommending acceptance, be received, placed on file, approved and accepted, and the City Clerk instructed to have the same recorded. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and O'Connor voted Aye. Nay: None. Absent: None. Mayor declared the motion. carried. 55835 - A Zoning Ordinance to regulate and restrict the location and use of buildings, structures, and land for trade, industry, residence, or other purpose, in the City of Waterloo, Iowa; to regulate and restrict the height, number of stories, and size of buildings and other structures, the proportion of lot that may be occupied, the size of yards, courts, and other open spaces, and the density of population; to provide a method of enforcement and administration of the regula- tions hereof; to prescribe penalties for the violation of the provisions hereof; and repealing Ordinance No. 1734 and all amendments thereto, and all ordinances or parts or sections of ordinances in conflict herewith, was read by the Clerk. Moved by Miller, seconded by Keller that said Ordinance be recorded as having passed its third reading (the first having passed under C.R,#55762 of 1/20/69, the second under C,R.#55797 of 1/27/69), and be now placed on its final adoption. Mayor declared the motion carried. 55836 Moved by Cohea, seconded by O'Connor that Ordinance No. Ordinance to regulate and restrict the location'and use structures, and land for trade, industry, residence, or in the City of Waterloo, Iowa; to regulate and restrict 2479, a Zoning of buildings, other purpose the height, number of stories, and size of buildings and other structures, the proportion of lot that may be occupied, the size of yards, courts, and other open spaces, and the density of population; to provide a method of enforcement and administration of the regulations hereof; to prescribe penalties for the violation of the provisions hereof; and repealing Ordinance No. 1734 and all amendments thereto, and all ordinances or parts or sections of ordinances in conflict herewith, be adopted, and the Mayor thanked the members of the City Planning Commission and the City Attorney's Office. Mayor declared the ordinance adopted. , 55837 An Ordinance vacating part of Letsch Road in the City of Waterloo, Iowa, was read by the Clerk. Moved by Cavanaugh, seconded by Dykeman that said Ordinance be recorded as having passed its third reading (the first having passed under C0R.#55760 of 1/20/69, the second under C0R.#55798 of 1/27/69), and be now placed on its final adoption. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and O'Connor voted Aye. Nay: None. Absent: None. Mayor declared the motion carried. 55838 Moved by Dykeman, seconded by Keller that Ordinance No. 2480, being an Ordinance vacating part of Letsch Road in the City of Waterloo, Iowa., be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and O'Connor voted Aye. Nay: None. Absent: None. Mayor declared the ordinance adopted. 55839 Moved by Miller, seconded by Cohea that Resolution No. 19460, a resolution authorizing the conveyance of part of Letsch Road, as fully described in the published notice in the Waterloo Daily Courier on December 26, 1968 and January 2, 1969, to Paul G. Christensen and Irene M. Braun for an exchange conveyance of an improved full width street to be known as Christensen Drive in Paul's Replat of a Part of Lawless Addition, and directing and authorizing the Mayor and City Clerk to execute and deliver a Quit Claim Deed for said property, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and O'Connor voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 55840 - Under Council Action #55803 of 1/27/69, action was deferred on Bill No. 12446 of the Illinois Central Railroad Company for payment of $24,648.30 for expenses incurred for construction of a concrete box culvert BR -W -276-2A for Virden Creek enclosure, for a corrected resolution authorizing payment. Moved by Cohea, seconded by Cavanaugh that Resolution No. 19461, being a resolution authorizing payment of Bill No. 12446 of Illinois Central 5 55840 - (continued) Railroad Company for partial costs for construction of a concrete box culvert BR -W -276-2A for Virden Creek Enclosure in the City of Waterloo, Iowa, be adopted, On roll call, Cavanaugh_, Cohea, Dykeman, Keller, Miller and O'Connor voted Aye. Nay: None., Absent: None. Mayor declared the resolution adopted.. 55841 - Moved by Keller, seconded by O'Connor that the communication from the Fire Chief reporting Asst. Chief Wilbur Grove of the Fire Department has tendered his resignation effective as of February 1, 1969, after 374 years of service, be received, placed on file, and the Mayor and Council expressed their appreciation to Asst. Chief Wilbur Grove for his faithful and dedicated service in the Fire Department, and that a plaque would be presented to him at a later date, Motion carried., 55842 - Moved by Dykeman, seconded by Cohea that the communication from the Fire Chief requesting Council approval of the following promotions of members of the Waterloo Fire Department, effective February 1, 1969, be received, placed on file and promotions approved Captain Gerald Olson to rank of Assistant Chief, Lieutenant Daniel Lorraine to rank of Captain,. Fireman John. Flynn to rank of Lieutenant. Motion carried. 55843 - Moved by Dykeman, seconded by Miller that the communicationfrom the City Engineer, transmitting a suggested 1969 Street Program Map with both arterial and local streets, together with cost estimate for each, and requesting the Council review these improvements with corrections or approval, be received, placed on file, Linden Avenue from Glenwood Street to Independence Avenue be included i.nthe asphalt paving plans, specifications, estimate of cost, etc. and the City Engineer instructed to proceed with the 1969 Asphalt Paving Program. Motion carried. 55844 - Moved by Keller, seconded by Cohea that the following streets be included in the concrete paving plans, specifications, estimate of cost, etc. and the City Engineer instructed to proceed with the 1969 Concrete Paving Program: Ansborough Avenue from Ridgeway Avenue to Highway 412. Upland Drive between existing paving, Grandview Avenue from. Parker Street to Highway 20, Dundee Avenue from Upton Avenue to Falls Avenue. Motion. carried. 55845 _. Moved by Dykeman, seconded by Cavanaugh that the communication from the City Engineer, transmitting the request of Jack E. Broell, 536 Dundee Avenue, that Dundee Avenue from Stratford Avenue to Upton. Avenue, now be considered for curb and gutter as the storm sewer has been installed (see C.R.#44722 of 7/3/62), and recommending Dundee Avenue from Stratford Avenue to Falls Avenue be improved and improvement be Portland cement concrete paving, full width, rather than just curb and gutter, and same could be included in the 1969 Concrete Paving Program, be received, placed on file, recommendations approved and - 6 55845 - (continued) Dundee Avenue from Stratford Avenue to,Falls Avenue ordered included in the 1969 Concrete Paving Program.
