HomeMy WebLinkAbout3/10/1969I City Hall, Waterloo, Iowa REGULAR SESSION March 101, 1969 - 7:30 P.M,, The City Council of the City of Waterloo, Iowa met in Regular Session in the Council Chambers of the City Hall in said City at 7:30 P.M. on March 10, 1969. Mayor Turner in the Chair. Present: Cavanaugh, Cohea, Dykeman, Keller, Miller and O'Connor, Absent.- None. Councilman Charles Dykeman offered the Invocation. 55995 - Moved by Keller, seconded by Miller that the Agenda, amended as follows, for the Regular Session of March 10, 1969 at 7:30 P.M,, be accepted and approved: Delete under Petitions From Public - (Page 1) Request of Roger F. Peterson, Atty., on behalf of the platters of the Brookeridge subdivision, for the vacation of that part of the 60 foot utility easement lying within the Preliminary Plat of Brookeridge and replat as a utility easement or street, together with City Planning Commission's recommendation. Set date of hearing. Motion carried. 55996 Moved by Cohea, seconded by O'Connor that the Minutes of the Regular Session held March 3, 1969 at 7:30 P.M., be approved. Motion carried. 55997 - Moved by Miller, seconded by Cohea that the proof of publication of the notice of public hearing to vacate,sell and convey all of Melrose Street lying south of Lot 13, Block 15 and north of Lot 9, Block 16 in Rose Hill Addition, as fully described in the publication in the Waterloo Daily Courier on February 13 and 20, 1969, be received and placed on file. Motion carried. 55997 -A -The Mayor announced the time had arrived to hear objections, if any, and asked if any one present wished to be heard or make objections, or if any written objections had been filed with the Clerk. No one appeared to object orally, and the Clerk reported no written objections had been filed. Thereupon, it was moved by Cavanaugh, seconded by Dykeman that an Ordi- nance be drawn and submitted vacating all of Melrose Street lying south of Lot 13, Block 15 and north of Lot 9, Block 16 in Rose Hill Addition, in the City of Waterloo, Iowa, as fully described in the published notice in the Waterloo Daily Courier on February 13 and 20, 1969. Motion carried. 55998 - An Ordinance vacating all of Melrose Street lying south of Lot 13, Block 15 and north of Lot 9, Block 16 in Rose Hill Addition, in the City of Waterloo, Iowa, was read by the Clerk. Moved by Dykeman., seconded by Cavanaugh that the said Ordinance be recorded as having passed its first reading. On roll call, Cavanaugh, Cohea,Dykeman, Keller, Miller and O'Connor voted Aye. Nay: None. Absent: None. Mayor declared the motion carried. 55999 - Moved by O'Connor, seconded by Cohea that the proof of publication of the Assessment Notice for the 1968 Sanitary Sewer Program No. 1, known as Contr.act No. 160, in the City of Waterloo, Iowa, be received and placed on file. Motion carried. - 2 - 56000 - The Mayor then announced the time had arrived to hear objections, if any, and asked if any one present wished to be heard or make objections, or if there were any written objections filed with the Clerk. No one appeared to object orally, and the Clerk reported that no written objections had been filed, Thereupon, it was moved by Miller, seconded by Dykeman that Resolution No. 19522, correcting final schedule of assessments and levying said assessments in accordance therewith for the construction of the 1968 Sanitary Sewer Program No. 1, known as Sewer Contract No. 160, in the City of Waterloo, Iowa, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and O'Connor voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 56001 - The Finance and Purchasing Committee, having checked the bids for the purchase of radios as specified in the specifications for use by various City Departments (referred to them by C.R. #55939 of 2/24/69), recommended all the bids be rejected, and the City of Waterloo not purchase said radios. Moved by Miller, seconded by O'Connor that the above recommendations be received, placed on file, bids rejected and the City of Waterloo not purchase said radios. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and O'Connor voted Aye. Nay: None. Absent: None. Mayor declared the motion. carried. 56002 Moved by O'Connor, seconded by Miller that the communication from the City Planning Commission, transmitting the request of Robert H. Park for the Council to rezone on its own motion Lots 17, 20, 21 and 22 in Forest Hill Subdivision, as shown on the attached print, from R-1 One and Two Family Residence District to C-2 Commercial District, and recommending the existing C-2 Commercial District be extended to include only Lots 20, 21 and 22 in Forest Hill Subdivision, and only after the dedication to the City of Waterloo of land needed to widen U.S. Highway #218 and provide the necessary frontage road, together with the recommendations of the Assistant City Solicitor recommending the request be referred to the Board of Adjustment, be received, placed on file, and said request referred to the Board of Adjustment. Motion carried. 56003 - Moved by Dykeman, seconded by Miller that the communication from the Assistant City Engineer, transmitting the request from Shepherd Lumber Company for permission to construct two curb cuts, one 24' and one 45'2", at 326 West 17th Street, as shown on the attached print, and to pave the area between the property line and the curb for maintenance purposes, and recommending approval subject to the pro- visions of his letter and approaches be portland cement concrete, concurred by the Police Department, be received, placed on file, recommendations approved and permission granted in accordance therewith and at no cost to the City. Shopping Center, Inco and Kimball Avenue Development Co., Inc., transmitting a Quit Claim Deed dated 11/2/67 conveying unto the City of Waterloo, Iowa certain real properties in. Section 3-88-13 for street purposes, and an easement dated 8/26/68 for storm sewer purposes along the south side of said premises, be received, placed on file and Resolution No. 19523, approving and accepting said Deed and Easement, and directing the City Clerk to have same recorded, be adopted, On roll call, Cavanaugh, Cohea, Dykeman, Keller., Miller and O'Connor voted Aye. "Hap" Rooff Construction and Demolition Co., Inc., Waterloo, Iowa, for the installation of Storm Sewer from Columbia Circle to Campbell Avenue, known as Minor Contract No. 47, in the City of Waterloo, Iowa, be received, placed on file and Resolution No. 19525, approving said contract and bond, be adopted. Mayor declared the resolution adopted. 56011 - Moved by Cavanaugh, seconded by Miller that the communication from the City Engineer, transmitting Change Order #1 for the 1968 Sanitary Sewer Program No. 4, Highway #57 West Sanitary Sewer, Contract No. 166, involving jacking of 12" sanitary sewer under Airport Road, at no change in contract cost, be received, placed on file, approved and the Mayor authorized to sign same on behalf of the City of Waterloo, Lowa On. roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and O'Connor voted Aye. Mayor declared the motion carried. 56012 - An Ordinance amending Ordinance No. 2479, by adding Sub -Section No. 1 to Section 2A-5, rezoning certain property in the City of Waterloo, Iowa, was read by the Clerk. Moved by Cohea, seconded by Keller that said Ordinance be recorded as having passed its third reading (the first having passed under C.R. #55932 of 2/24/69, the second under C.R. #55979 of 3/3/69) and be now placed on its final adoption. March 10, 1969 - 5 - 56013 - Moved by Keller, seconded by Cohea that Ordinance No. 2483, being an Ordinance amending Ordinance No. 2479, by adding Sub -Section, No. 1 to Section 2A-5, rezoning certain property in the City of Waterloo, Iowa, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and O'Connor voted Aye. Nay: None. Absent: None. Mayor declared the ordinance adopted. 56014 - Moved by Miller, seconded by O'Connor that the communication from the City Engineer, transmitting Estimate #4 Report for Fire Sub - Station No. 4 as prepared by Stenson & Warm, Inc., Architects and Engineers, Waterloo, Iowa, as to work performed and materials fur- nished by E & S Electrical Contractors, Inc., (Electrical Contract) in the City of Waterloo, Iowa, and recommending approval, be received, placed on file and Resolution No. 19526, approving the report and authorizing payment accordingly, be adopted. Mayor declared the resolution adopted. 56016 - Moved by Cavanaugh, seconded by O'Connor that the communication from the Assistant City Engineer, transmitting Estimate #9 Report as submitted by Stenson & Warm, Inc., Architects and Engineers, Waterloo, Iowa, as to work performed and materials furnished by Youngblut Construction Company, Inc., Washburn, Iowa, for the Fire Sub -Stations Nos. 3, 4, 6 and 8 (General Contract), in the City of Waterloo, Iowa, and recommending approval, be received, placed on file and Resolution No. 19528, approving the report and authorizing payment accordingly, be adopted. City Engineer, transmitting the statement dated 2/28/69, for engineering services from Robinson Engineering Company, Waterloo, Iowa, in connection with the 1968 Sanitary Sewer Program #3 (Country Club Sewer), Contract No. 163, in the City of Waterloo, Iowa, and recommending approval, be received, placed on file and Resolution No. 19529, approving the statement of said firm and authorizing payment accordingly, be adopted. Nay: None. Absent: None. Mayor declared the resolution adopted. 56019 - Moved by Cohea, seconded by Keller that the communication from Mayor Turner recommending the advancement of Richard L. King to the position of City Engineer, be received, placed on file, recommendation approved and Richard L. King appointed the City Engineer, effective immediately. Motion carried. 56020 Moved by Keller, seconded by Miller that the communication from Mayor Turner, requesting the City Attorney's and City Clerk's staffs be ordered to draw the necessary ordinance to effect changes in the Wards and Precincts in the City of Waterloo, Iowa, to be submitted as soon as possible, be received, placed on file, approved and the City Attorney and City Clerk instructed to proceed accordingly. Motion carried. 56021 - Moved by O'Connor, seconded by Cavanaugh that the report of the Building Official, submitting a list with several addresses, together with cost of demolitions in the City of Waterloo, Iowa, be received, placed on file, approved and Resolution No. 19531, Making Assessments for the demolitions and instructing the City Clerk to certify said assessments to the Black Hawk County Auditor, be adopted.
