The City Council of the City of Waterloo, Iowa met in Regular Session in the Council Chambers of the City Hall in said City at 7:30 P.M. on May 5, 1969. Mayor Turner in the Chair. Present: Councilmen Cavanaugh, Cohea, Dykeman, Keller, Miller and O'Connor. Absent: None. City Attorney, Ed Gallagher, Jr. offered the Invocation° 56284 - Moved by Keller, seconded by Miller that the Agenda, as proposed, for the Regular Session of May 5, 1969 at 7:30 PoMa, be accepted and approved. Motion carried. 56285 - Moved by Cavanaugh, seconded by Cohea that the Minutes of the Regular Session held April 28, 1969 at 7:30 P.M., be approved. Motion carried. 56286 - Moved by Cohea, seconded by O'Connor that the proof of publication of the notice of public hearing to vacate, sell and convey to Kenneth McAhren all the unopened alley lying East of Lots 39 thru 43, Block 111, Riverview Addition, in the City of Waterloo, Iowa, as more fully described in the publication in the Waterloo Daily Courier on April 10 and 17, 1969, be received and placed on file. Motion carried. 56287 - The Mayor announced the time had arrived to hear objections, if any, and asked if any one present wished to be heard or make objections, or if any written objections had been filed with the Clerk. No one appeared to object orally, and thr Clerk reported no written objections had been, filed. Thereupon, it was moved by O'Connor, seconded by Cavanaugh that an Ordinance be drawn and submitted vacating the unopened alley lying East of Lots 39 thru 43, Block 111, Riverview Addition, in the City of Waterloo,, Iowa, as fully described in the published notice in the Waterloo Daily Courier on April 10 and 17, 19690 Motion carried. 56288 An Ordinance vacating the unopened alley lying East of Lots 39 thru 43, Block 111, Riverview Addition, was read by the Clerk. Mayor declared the motion carried. 56292 - Moved by Cavanaugh, seconded by Keller that the proof of publication of the notice of public hearing to vacate and convey to the Board of Park Commissioners a part of Campbell Avenue, lying west of Orange Grove Avenue and east of relocated U.S. Highway #63, as described in the pub- lication in the Waterloo Daily Courier on April 10 and 17, 1969, be received and placed on file. Motion carried. 56293 -A -An Ordinance vacating a part of Campbell Avenue, lying west of Orange Grove Avenue and east of relocated U.S. Highway #63, in the City of Waterloo, Iowa, was read by the Clerk. Moved by Cohea, seconded by Miller that said Ordinance be recorded as having passed its first reading. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Miller and O'Connor voted Aye. Nay: None. Absent: None. Mayor declared the motion carried. 5629 - Moved by Cohea, seconded by Cavanaugh that the proof of publication of the notice of public hearing to vacate and convey to Richard H. Young a tract of land along the west side of Kimball Avenue, south of Park Lane, in exchange for certain land in Section 4 -88N -13W, as published in the Waterloo Daily Courier on April 10 and 17, 1969, be received and placed on file. Motion carried. 56298 - Moved by Miller, seconded by O'Connor that the report of the City Clerk and Finance and Purchasing Committee, together with the bids submitted by various suppliers for tires, tubes, oils, gasoline, transmission fluids, diesel fuel, kerosene, batteries, electrolite, anti -freeze, grader blades, etc., be received, placed on file, the report approved and referred to the City Clerk and Finance and Purchasing Committee for further study and report back to the Council on May 12, 19690 Motion carried. 56299 Moved by Miller, seconded by O'Connor that the City Clerk be instructed to read the bids on Road Oil to be used in the 1969 Oiling Program in the City of Waterloo, Iowa, which were as follows. May 5, 1969 - 4 - 56301 Moved by Keller, seconded by Miller that the communication from the City Engineer, transmitting the request of Sam Annis and Company for permission to construct a temporary asphalt driveway without regard to sidewalk grade at 807 Rainbow Drive, Waterloo, Iowa, together with $3000 check for recording a waiver, and recommending approval subject to the provisions of his letter, be received, placed on file, request approved and Resolution Noo 19637, granting permission and authorizing construction irrespective of a later official grade, be adopted. Mayor declared the resolution adopted. 56302 - Moved by Dykeman, seconded by Cohea that the communication from the City Engineer, transmitting the request from Sam Annis and Company for permission to blacktop the area between the curb and property line at 807 Rainbow Drive, and recommending approval with stipulation this area will not be used for parking purposes and subject to the provisions of his letter, be received, placed on file, recommendations approved and permission granted inaccordance therewith at no cost to the City. Motion carried, 56303 - Moved by Cohea, seconded by Cavanaugh that the communication from the City Engineer, transmitting the request from the Concordia Lutheran Church for permission to construct one 22' concrete approach to serve parking lot on West Parker Street, as shown on the attached print, and recommending approval subject to the provisions of his letter, concurred by the Police Department, be received, placed on file, recommendations approved and permission granted in accordance there- with and at no cost to the City.
