The City Councilof the City of Waterloo, Iowa, met in Regular Session in the Council Cnambers of the City Hall in said City at 7:30 P.M. on July 10, 19720 Mayor Turner in the Chair. Present: Councilmen Cavanaugh, Cohea, Keller, Mabrey, Miller and Morrissey. Absent: Councilman Dykeman. Councilman Glenda Mabrey offered the invocation. 62405 - Moved by Keller, seconded by Cohea that the Agenda, as amended, for the Regular Session of July 10, 1972 at 7:30 P.M., be accepted and approved. Motion carried. 62406 - Moved by Morrissey, seconded by Miller that the Minutes of the Regular Session held July 3, 1972 at 7:30 P.M., be approved. Motion carried. 62407 Moved by Miller, seconded by Mabrey that the communication from the City Engineer, transmitting the request from the Waterloo Community Schools for permission to construct one 22° curb cut on West Second Street be- tween Randolph Street and Wellington Street, 217° from the corner of Wellington Street to the center of the 229 curb cut, as shown on the at- tached plat, to serve Emerson School at 314 Randolph Street, and recom- mending approval subject to the provisions of his letter, concurred by the Police Department, be received, placed on file, recommendations ap- proved and permission granted in accordance therewith at no cost to the City of Waterloo, Iowa. Motion carried. 62408 Moved by Cohea, seconded by Cavanaugh that the communication from the City Engineer, transmitting the request from William Dotson for permis- sion to construct a temporary asphalt driveway without regard to side- walk grade at 129 Prospect Circle, Waterloo, Iowa, together with $3.00 check for recording waiver, and recommending approval subject to the pro- visions of his letter, be received, placed on file, request approved and Resolution No. 22034, granting permission and authorizing construction irrespective of a later official grade, be adopted. Mayor declared the resolu- tion adopted. 62409 - Moved by Cohea, seconded by Cavanaugh that the communication from the City Engineer, transmitting the request from Ronald Edsill for permis- sion to construct a temporary concrete driveway without regard to side- walk grade at 305 Midlothian Boulevard, Waterloo, Iowa, together with $3.00 in cash for recording waiver, and recommending approval subject to the provisions of his letter, be received, placed on file, request approved and Resolution Noo 22035, granting permission and aut norizing construction irrespective of a later official grade, be adopted. Mayor declared the resolution adopted. - 2 62410 - In the discussion on the request for the removal of the loading zone in the 1400 block of West Third Street, Councilman Keller inquired as to a one-half hour time limit on parking in the adjacent area. Moved by Keller, seconded by Miller that the communication from Mayor Turner, transmitting the report of the Superintendent of Traffic and Sign Department on the petition of Dale A. Kilpatrick, 414 Home Park Blvd., et al, requesting removal of the loading zone in the 1400 block of West Third Street, referred to said Department under C0R.#62352 of 6/26/72, and recommending denial, be received, placed on file, and re- quest denied with a study to be made to allow one-half hour parking in the adjacent area. Motion carried 62411 Donald Maxfield, 5037 Foulk Road, asked as to what the problem was in the Foulk Road and East Shaulis Road area. Mayor Turner reported that cer- tain property owners in this area had seepage in their basements due to the ditches filling up. Peter Christensen,5147 Foulk Road, inquired if a storm sewer could be constructed and how soon as there was three to five feet of water in the ditches which was a hazard to the children. Mayor Turner reported this area was partially developed before being taken into the City and part of the problem could be solved by cleaning the ditches but not all. Donald Fraser, 5137 Foulk Road, said he had no problem until the ditches Frere filled in, then seepage began in his basement. City Engineer King reported on the grades in this area. Mrs. James Newcomer, 5057 Foulk Road, said the Water Works installation of water main raised the level of the ditches which further complicated the problem. Mayor Turner mentioned that three-fourths of the cost of the storm sewer would be paid by the City. Moved by Keller, seconded by Morrissey that the communication from the City Engineer, reporting on the petition from the property owners of the Foulk Road and East Shaulis Road area against having to clean out the ditches along their properties, referred to the Engineering Department under C.R. #62301 of 6/19/72, be received, placed on file, Council Action #62111 of May 8, 1972, approving the removal of obstruction of ditches, rescinded and referred to the City Engineer for a study as to the feas- ibility of a storm sewer district for this area. Motion carried. 62412 Moved by Miller, seconded by Cohea that the communication from the City Clerk reporting on the results of the negotiations with the bidders for the best price for the sale of nine (9) GMC Model 3501 T.D.H. Passenger Buses without tire (see C.R.#62349 of 6/26/72), be received, placed on file and the bids of Coralville Transit Bus Company, Coralville, Iowa, for three buses in the amount of $3,000 each, of Grace Baptist Church, Evansdale, Iowa, for one bus in the amount of $2,222000, and of Sioux City Transit Company for five buses in the amount of $2,000 each, ac- cepted, subject to D.O.T. approval. Absent: Dykkemana Mayor declared the motion carried. 62415 - Moved by Cohea, seconded by Miller that the communication from the City Engineer, transmitting Change Order #1 and Change Order #2 for the 1972 Storm Sewer Program #1, Contract No. 83, for work performed by Hurst Excavating Co., Inc., at additional costs of $1,448050 and $600.00 res- pectively, and recommending approval, be received, placed on file, ap- proved and the Mayor and City Clerk authorized to sign same on behalf of the City of Waterloo, Iowa: On roll call, Cavanaugh, Cohea, Keller, Mabrey, Miller and Morrissey voted Aye.
