The City Council of the City of Waterloo, Iowa, met in Regular Session in the Council Chambers of the City Hall in said City at 7:30 P.M. on July 24, 1972. Mayor Turner in the Chair. Present: Councilmen Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey. Absent: None. Councilman Dykeman offered the invocation. 62464 - Moved by Cohea, seconded by Miller that the Agenda, as amended, for the Regular Session of July 24, 1972 at 7:30 P.M., be accepted and approved. Motion carried. 62465 - Moved by Cavanaugh, seconded by Keller that the Minutes of the Regular Session held July 17, 1972 at 7:30 P.M., be approved. Motion carried. 62466 - Moved by Mabrey, seconded by Miller that the proof of publication of the Notice of Hearing on Proposed Plans and Specifications and Proposed Form of. Contract for the 1972 Paving Program No. 1, Contract No.127, be re- ceived and placed on file. Motion carried. 62467 - This being the time nd place for a public hearing on the matter of the adoption of plans, specifications and form of contract for the construc- tion of the "Waterloo, Iowa, 1972 Paving Program #1 - Contract #127", the Mayor called for any oral objections to the making of said improve- ments, or to the adoption of the plans, specifications and form of con- tract. No oral objections were offered and the Clerk reported that no written objections thereto had been filed. Thereupon, it was moved by Keller, seconded by Cohea that Resolution No. 22062, adopting plans, specifications and form of contract, for the construction of improvements known as the Waterloo, Iowa, 1972 Paving Program #1, Contract No. 127, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted, 62468 The Mayor thereupon announced that a further purpose of the meeting was to receive, open, consider and tabulate bids for the construction of the "Waterloo, Iowa, 1972 Paving Program #1 - Contract #127", in accordance with the plans and specifications now adopted. Moved by Morrissey, seconded by Mabrey that the following bids be re- ceived, placed on file, the City Clerk instructed to open, inspect and tabulate same, and the bids referred to the Engineers for checking and to report back to the Council: Name and Address of Bidder Amount of Bid Amt. of Check 1. Motion carried. 62470 The Mayor announced the time had arrived to hear objections, if any, and asked if nyone present wished to be herd or make objections, or if any written objections had been filed with the Clerk. No one appeared to object orally, and the City Clerk reported there had been no written objections placed on file. After public hearing and no objections having been made or filed, it was moved by Miller, seconded by Morrissey, that Resolution No. 22063, resolution approving the sale of Part of Disposal Parcel No. 50-a in the Westfield -Virden Urban Renewal Area, Project No. Iowa R-7 and authorizing the execution of the necessary contrct for sale of land for private re- development and deed, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay None. Absent. None. M(.ayor declared the resolution adopted. 62471 Moved by Dykeman, seconded by Miller that the proof of publication of the Notice of Public Hearing on Proposal to Sell Real Estate in the City of Waterloo, Iowa, known as the remainder of Disposal Parcel No. 50-a in the Westfield -Virden Urban Renewal Area, Project No. Iowa R-7, near cor- ner of Thompson Street and Lafayette Street, to Aster Lewis, as fully described in the said notice published in the Waterloo Daily Courier on June 22, 1972, be received and placed on file. Motion carried. 62472 The Mayor announced the time had arrived to hear objections, if any, and asked if anyone present wished to be heard or make objection, or if any written objections had been filed with the Clerk. After public hearing and no objections having been made or filed, it was moved by Miller and seconded by Cavanaugh that Resolution No. 22064, a resolution approving the sale of the remainder of Dispossl,Parcel No. 50-a in the Westfield -Virden Urban Renewal Ares, Project No. Iowa R-7 and authorizing the execution of the necessary contract for sale of land for private redevelopment and deed, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 62473 Allie Anding, 813 Galena Street, asked why there was a charge for dumping at the City Dump as she has grandchildren who tear down motors for the copper and haul the balance to the dump. Also, she asked if they could salvage from the dump because she didn't think the City was making enough from the salvage. July 24, 1972 3 Mayor Turner reported that anyone using the dump from outside of the City or commercial haulers had to pay a charge; and, in answer to the question of whether it was profitable for the City to charge for the dump, in the past the City only recovered $2500 per year on the salvage operation but with the dump charge the City receives $5000 per month so it was much more profitable. 62474 - Lucille Endigo, 139 Linwood Avenue, asked if the law prohibited anyone from picking up some thing that had been discarded at the landfill; also, if consideration had been made for the small garbage hauler to pay a lesser charge than others. Public Works Director Culver reported it wasn't the policy of the City to allow all persons to salvage at the landfill and items brought in on a truck would have to be left at the landfill. Mayor Turner stated the City would have to look into the policy to see if there could be some changes made to allow someone not to salvage at the dump but to, maybe, take an article someone else had brought before it was discarded. 62475 - Katherine Flute, 320 East 7th Street, asked if the Ordinance covering landfill (Ordinance 2588 adopted 3/20/72) could be changed to eliminate the charges for the people who could not afford to pay, pointing out how ecology was involved in salvaging and recycling items from the dump, which would make jobs for persons picking up articles at the dump and keep them off of welfare. 62476 - The Engineers having checked the extensions and totals of the bids for the construction of the Waterloo, Iowa, 1972 Paving Program Noa 1, Contract No. 127 reported the bid of Cedar Valley Corps of Waterloo, Iowa in the sum of $981,861, was the lowest bid received. Mayor declared the resolution adopted. 62477 m Moved by Morrissey, seconded by Cohea that the communication from the City Engineer, transmitting the request from Stenson and Warm, Inc., Architects and Engineers, Waterloo, Iowa, for permission to construct one 26' curb cut in proposed street to north of site of new facility for Deyo & Co., Inca in Brookeridge Addition, and recommending tentative ap- proval subject to the provisions of his letter, be received, placed on file, recommendations approved and permission granted in accordance there- with at no cost to the City of Waterloo, Iowa. Motion carried. 62478 m Moved by Keller, seconded by Cohea that the communication from the City Engineer, transmitting the request from John Rottjer for permission to construct one 22' curb cut at 1950 Plymouth Avenue, as shown on the at- tached plat, and recommending approval subject to the provisions of his letter, concurred by the Police Department, be received, placed on file, recommendations approved and permission granted in accordance therewith at no cost to the City of Waterloo, Iowa. Mayor declared the resolution adopted. 62480 - Moved by Miller, seconded by Cavanaugh, that the communication from the Iowa State Highway Commission, transmitting an approved copy of a permit for the City of Waterloo, Iowa to construct a 30' Type "B" (Lift Station) entrance to U.S. 218 at Sta. 682+00, on the easterly side, Form #559, as shown on the attached print, be received, placed on file, approved and the Mayor and City Clerk authorized to sign said application in behalf of the City of Waterloo, Iowa. Motion carried. 62481 -- Moved by Dykeman, seconded by Cohea that the communication from the City Engineer, transmitting a Comprehensive Drainage Study of No Name Creek, reporting same must be transmitted to the Iowa Natur.,1 Resources Council for their concurrence, for pending improvements of Dike for Corps of Engineers, Wagner -Hackett Expressway, Greenway Development adjacent to the Hackett Expressway, bridge and road crossings at Airline Hiway, Big Rock Road and Wagner Road, and recommending the Council request concur- rence of said Study in, order to proceed with the preliminary designs, be received, placed on file, said Study and recommendations approved, and the City Engineer instructed to transmit said Study .end request for con- currence. Motion carried. 62482 - Moved by Morrissey, seconded by Cavanaugh that the communication from the City Engineer, transmitting Change Order #4 for the 1972 Storm Sewer Program #1, Contract Noo 83, for work performed by Hurst Excavating Co., Inc. at a decrease in cost in the amount of $1,070.35, and recommending approval, be rec-ived, placed on file, approved and the Mayor and City Clerk authorized to sign same in behalf of the City of Waterloo, Iowa. Motion carried. 62483 Mayor Turner, in reporting on the City acting under the Home Rule Act, stated additional time was very important because of two federal bills which, if passed, would benefit cities and towns; one, the bus subsidy, which if passed, the City would receive approximately $90,000, and the other, the revenue sharing bill under which the City could receive as much as $1,100,000, which could mean a big reduction in property taxes, and it would benefit the City to have additional time on the budget. Moved by Mabrey, seconded by Cohea that Resolution No. 22067, a resolu- tion electing to act under and be subject to certain divisions and parts of divisions of the City Code of Iowa, known as the Home Rule Act, Chap- ter 1088 of the Acts of the Sixty -Fourth Iowa General Assembly (1972), to utilize those provisions deemed beneficial to the City and its citi- zens, be adopted. Mayor Turner stated he did not agree with the State law which allowed anyone to get a beer permit. Moved by Cohea, seconded by Keller that the application, bond and fee from Harley Arthur Thompson dba Thompson's Used Car and Trucks for a Class "C" Beer Permit at 2230 Independence Avenue, be approved and Resolution No. 22074, approving said application, be adopted.
