REGULAR SESSION
August 21, 1972 - 7:30 P.M.
The City Council of the City of Waterloo, Iowa, met in Regular Session in the
Council Chambers of the City Hall in said City at 7:30 P.M. on August 21, 19720
Mayor Turner in tne Chair.
Present: Councilmen Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and
Morrissey.
Absent: None.
Councilman Glenda Mabrey offered the invocation.
62581 - Moved by Cohea, seconded by Miller that the Agenda, as proposed, for tne
Regular Session of August 21, 1972 at 7:3C P.M., be accepted and approved.
Motion carried.
62582 - Moved by Cavanaugh, seconded by Morrissey that the Minutes of the Regular
Session held August 14, 1972 at 7:30 P.M., be approved.
Motion carried.
62583 m Moved by Miller, seconded by Mabrey tnat ttie proof of publication of the
Notice of Hearing on Proposed Resolution of Necessity for Street Imprcve-
ments in Waterloo, Iowa, 1972 New Sidewalk Program, Contract No. 40, be
received and placed on file.

62534 - The Mayor then announced the time had arrived to near objections., if any,
and asked if anyone present wished to be heard or make objection, or if
there were any written objections filed with tie Clerk:
No one appeared to object orally, and the Deputy City Clerk reported tnere
were no written objections placed on file.

Engineer, submitting a list of properties to be deleted from the 1972
New Sidewalk Program, in the City of Waterloo, Iowa, known as Contract
Noo 40, due to construction by a Contractor of their choice, and Revised
Preliminary Plats and Schedules of Proposed Assessments and Estimate of
Cost, etc., be received, placed on file, approved, and Resolution No.
22109, being a Resolution Amending Resolution of Necessity as Proposed
by Deleting Certain Lots as Recommended by the City Engineer for said
Program, be adopted.
On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and
Morrissey voted Aye. Nay: None. Absent: None. Mayor declared tne
resolution adopted.
62585 m Moved by Morrissey, seconded by Dykeman that Resolution Noo 22110, adopt-
ing the Resolution of Necessity, as amended, for the 1972 New Sidewalk
Program in the City of Waterloo, Iowa, known as Contract No. 40, be
adopted.

Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the
resolution adopted.
62586 - Moved by Cavanaugh, seconded by Morrissey that Resolution Noo 22111,
ordering construction and directing advertisement for bids for tne 1972
New Sidewalk Program in toe City of Waterloo, Iowa, known as Contract No.
40, be adopted.

62587 Kenneth Dammann, 7818 University Avenue, Cedar Falls, Iowa, presented the
Council with letters from "Aligned Community of Epileptics", Exceptional
Persons, Inc., Goodwill Industries of N.E. Iowa and United Cerebral Palsy
of Iowa, requesting Waterloo Human Rights Ordinance No. 2513, Section 202,
be amended to include all handicapped persons.
Moved by Mabrey, seconded by Keller that the said letters be received,
placed on file and referred to the Waterloo Commission on Human Rights
to be presented to the Council.
Motion carried.
62588 - Moved by Keller, seconded by Cohea that the communication from H & F, Inc.
805 Rainbow Drive, et al, requesting that the City of Waterloo install
sanitary sewer on Rainbow Drive in the area between Ansborough Avenue and
Forrester Avenue with the cost to be assessed against the property owners
at such time as they hook on to the sewer, be received, placed on file,
and referred to the City Engineer for study and report back on August 28,
1972.

62589 - Moved by Cavanaugh, seconded by Mabrey that the courunication from the
Assistant City Engineer, transmitting the letter and work prints #12 to
#18 and #20 to #22 from Northwestern Bell Telephone Company requesting
permission to place buried cable within tree area south of West Fiftf.
Street, between Denver Street and Western Avenue to Mitchell Avenue, and
recommending approval subject to the provisions of his letter, be re-
ceived, placed on file, recommendations approved and permission granted
in accordance therewith.

62590 = Moved by Miller, seconded by Dykeman that the communication from the
Assistant City Engineer, transmitting letter and prints #17 and #18 from.
Ncxthwestern Bell Telephone Company requesting permission to place buried
cable on Randolph Street from Byron Avenue to Cornwall Avenue, and rec-
ommending approval subject to the provisions of his letter, be received,
placed on file, recommendations approved and permission granted in accor-
dance therewith.

Engineer, transmitting the request from Catherine E. Ahrenholz for per-
mission to construct two temporary asphalt driveways without regard to
sidewalk grade at 2261 Burton Avenue, one on Burton Avenue and the other
on Midland Street, Waterloo, Iowa, together with $3.00 check for record-
ing waiver, and recommending approval subject to the provisions of his
letter, be received, placed on file, request approved and Resolution No.
22112, granting permission and authorizing construction irrespective of
a later official grade, be adopted.

Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the

62592 Under Council Action #62541 of 8/14/72, action on the objections of John
Davis, 621 Harwood Avenue, and Duane Timmerman, 615 Harwood Avenue, to
vacate and convey to Falls Avenue Wesleyan Churcn, part of the existing
alley on Lots 213 and 214 and all the alley south of said Lots, and a
part of East-West alley lying south of Lots 212 and 211 except the east
16' of the existing alley south of Lot 211, all in the First Addition to
Galloway, was deferred to August 21, 1972,.and werernw presented for con-
sideration,
John Davis, 621 Harwood Avenue, said he would like to see alley stay
in the present location.
Moved by Dykeman, seconded by Keller that the objections of John Davis
and Duane Timmerman to said vacation and conveyance be overruled and the
request of the Falls Avenue Wesleyan Church approved.
On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and
Morrissey voted Aye. Nay None. Absent None. Mayor declared the
motion carried.
62593 - Moved by Mabrey, seconded by Miller that an Ordinance be drawn and sub-
mitted vacating part of the existing alley on Lots213 and 214 and all
the alley south of said Lots, and a part of East-West alley lying south
of Lots 212 and 211, except the east 16° of the existing alley south of
Lot 211, all in the First Addition to Galloway, in the City of Waterloo,
Iowa, as fully described in the published notice in the Waterloo Daily
Courier on July 20 and 27, 1972.
Motion carried.
62594 - An Ordinance vacating part of the existing alley on Lots 213 and 214 and
all the alley south of said Lots, and a part of East-West alley lying
south of Lots 212 and 211 except the east 16' of the existing alley south
of Lot 211, all in the First Addition to Galloway,in the City of Waterloo,
Iowa, was read by the Deputy City Clerk.
Moved by Morrissey, seconded by Cavanaugh that the said Ordinance be re-
corded as having passed its first reading.

Morrissey voted Aye. Nay None. Absent. None. Mayor declared the
motion carried.
62595 Moved by Cavanaugh, seconded by Miller that the communication from the
City Engineer, transmitting Change Order #1 at a decrease in cost of
$90.00 for work performed by Denman Phillips Construction Company, Inc.
for the Grant Educational Park, Project Iowa OSC-54 (PIC), Contract No.
3, and recommending approval, be received, placed on file, approved and
the Mayor and City Clerk authorized to sign same in behalf of the City
of Waterloo, Iowa.

Morrissey voted Aye. Nay None. Absent. None. Mayor declared the
motion carried.
62596 - Moved by Mabrey, seconded by Cohea that the communication from the Direc-
tor of Public Works, transmitting Iowa State Highway Commission Project
Agreement and plans for highway improvements in the area of U.S. 63, 218
and Falls Avenue, reporting on Items 8, 11, 12 and 13, and stating if
said Agreement and plans are approved as submitted, the City will be re-
quired to install 370' of 30" storm sewer to make the Highway Commission

storm sewer work properly, be received, placed on file, and Resolution
No. 22113, approving said Agreement and plans, and authorizing and direct-
ing the Mayor to sign same in behalf of the City of Waterloo, Iowa, be

from the Low Rent Housing Commission submitting the minutes of a special
meeting held on July 24, 1972 and an executive session held on July 24,
1972, be received, placed on file and Resolution Noo 22114, approving
said minutes, be adopted.

held July 11, 1972, in the City of Waterloo, Iowa, be adopted.

City Engineer, transmitting a statement dated 8/14/72 from Brice, Pet-
rides & Associates, Inc., Waterloo, Iowa, for resident inspection and
testing services from April to July, 1972, for Demolition and Recon-
struction of Falls Avenue Bridge, Bridge Contract No. 7, in the City of
Waterloo, Iowa, and recommending approval, be received, placed on file
and Resolution Noo 22116, approving the statement of said firm and
authorizing payment accordingly, be adopted.

Maywood Sanitary and Storm Sewers, WS -Iowa -70, Component II, Contract No.
162, and recommending approval, be received, placed on file and Resolu-
tion Noo 22117, approving the statement of said firm and authorizing pay-
ment accordingly, be adopted.

in connection with the City View Heights Storm Sewer Project, WS®Iowa-70,
Component V, Contract No, 162, and recommending approval, be received,
placed on file and Resolution No. 22119, approving the statement of said
firm and authorizing payment accordingly, be adopted.

Commission on Human Rights of John Sandoval to fill the unexpired term
of John W. Herron to expire on January 1, 1973, and Willie R. Allen with
term to expire on January 1, 1975, be received, placed on file and ap-
proved.

62604 Moved by Cohea, seconded by Miller that the communication from Mayor
Turner, submitting for Council consideration the reappointment of James
C. Anderson, Richard H. Morris and Melvin H. Sodawasser to the Low Rent
Housing Commission for two-year terms, to expire July 13, 1974, and the
new appointment of Sandra Eickelberg for a one-year term to expire July
13, 1973, be received, placed on file and approved.
