The City Council of the City of Waterloo, Iowa, met in Regular Session in the Council Chambers of the City Hall in said City at 7:30 P.M. on September 25, 1972. Mayor Turner in the Chair. Present: Councilmen Cavanaugh, Dykeman, Keller, Mabrey and Miller, Absent: Councilmen Cohea and Morrissey. Councilman Charles Dykeman offered the invocation. 62770 - Moved by Cavanaugh, seconded by Miller that the Agenda, as proposed, for the Regular Session of September 25, 1972 at 7:30 P,M., be accepted and approved. Motion carried. 62771 - Moved by Keller, seconded by Mabrey that the Minutes of the Regular Ses- sion held September 18, 1972 at 7:30 P.M. and Special Session held Sep- tember 21, 1972 at 12:00 Noon, be approved. Motion carried. 62772 - Under Council Action #62624 of 8/28/72 the bids for the purchase of one (1) Pumping Engine for use by the Fire Department were referred to the Fire Chief and Public Safety Committee to check and report back to the Council on 9/25/72, and was now presented for consideration. Moved by Dykeman, seconded by Miller that the time be extended to October 5, 1972 for submission of the bid report of the Fire Chief and Public Safety Committee for the purchase of one (1) Pumping Engine. Motion carried. 62773 - Moved by Miller, seconded by Keller that the communication from the City Engineer, transmitting a request from Robert L. Peters for Wendell Lock- and Construction, Inc. of Waterloo, Iowa, for permission to construct one 35' commercial curb cut at 735 Ansborough Avenue, as shown on the attached plat, and recommending approval subject to installation of pro- per storm sewer drainage and other provisions in his letter, be received, placed on file, recommendations approved and permission granted in accord- ance therewith at no cost to the City of Waterloo, Iowa. Motion carried. 62774 - Moved by Dykeman, seconded by Miller that the communication from the City Engineer, transmitting the request from Iowa Securities Company for per- mission to asphalt pave the alley from West Third Street to the North- South alley behind the Colonial Manor Apartments, and recommending ap- proval subject to the provisions of his letter, be received, placed on file, recommendations approved and permission granted in accordance there- with at no cost to the City of Waterloo, Iowa, Motion carried. 62775 - Councilman Dykeman asked if the adjacent property owners and those within 250' of Lot 2 in Auditor Sears Plat No, 1 had been notified of the re- quest for rezoning from "R-2" One and Two Family Residence District to "R-3" Multiple Residence District. Mr. Gunderson, Administrator of the 2 62775 (Continued) Waterloo City Plan and Zoning Commission, reported that the said Commis- sion had approved this without a hearing and were asking that the Council approve the said rezone on their own motion. Moved by Mabrey, seconded by Cavanaugh that the communication from the City Planning Commission, transmitting the request of Richard Co Zellhoe- fer, Atty. in behalf of To J. McLaughlin, for the City Council on its own motion to rezone Lot 2 in Auditor Sears Plat No. 1., located south of Mitchell Avenue and east of Kimball Avenue, in the City of Waterloo,, Icwa, from "R-2" One and Two Family Residence District to "R-3" Multiple Resi- dence District, as shown on the attached print, and recommending approval., be received, placed on file, recommendations approved, date of hearing set as October 16, 1972 at 7:30 P,M,9 and the Clerk instructed to publish. the necessary notice. Frerichs, Atty. in behalf of Hurst Excavating, Inc., for the City Council on its own motion to rezone a part of the NW3 of Section 2 -88N -13W, located on the east side of Hammond Avenue south of East Ridgeway Avenue, in the City of Waterloo, Iowa, from "A•-1" Agricultural District and "R"2" One and Two Family Residence District to "R-3" and "R-4" Multiple Residence Districts, as shown on the attached plat, for purpose of platting Hurst Addition, and recommending approval, be received, placed on file, recommendation approved, date of hearing set as October 16, 1972 =t 7:30 P.M,, and the Clerk instructed to publish the necessary notice. Peter for permission to construct a temporary asphalt driveway without regard to sidewalk grade at 1917 Howard Avenue, Waterloo, Iowa, together with $3.00 in cash for recording waiver, and recommending approval, subject to the provisions of his letter, be received, placed on file, request approved and Resolution No. 22180, granting permission and authorizing construction irrespective of a later official grade, be adopted. Ross for permission to construct a temporary asphalt driveway without regard to sidewalk grade at 1902 Bourland Avenue, Waterloo, Iowa, together with $3000 in cash for recording waiver, and recommending approval subject to the provisions of his letter, be received, placed on file, request approved and Resolution No. 22181, granting permission and authorizing construction irrespective of a later official grade, be adopted. Coerdt Construction Co., Dubuque, Iow-9 at an additional cost of $49342,02, for the Maywood Sewers Prgram, Component II, WS= Iowa -70, Contract No. 162, and recommending approval, be received, placed on file, approved and the Mayor and City Clerk authorized to sign same in behalf of the City .f Waterloo, Iowa. Mayor declared the motion carried. 62783 m Moved by Cavanaugh, seconded by Mabrey that the communication from the City Engineer transmitting the Certificate of Completion and Recommenda tion of Acceptance submitted by Brice, Petrides & Associates, Inc., Engineers, for work performed by Cedar Valley Corporation of Waterloo, Iowa, Contractors, for the construction of Paving, Sewers and Incident- als Cedar -Commercial Street Area, Westfield -Virden Urban Renewal Project R-7, Contract No. 174, be received and placed on file. Motion carried. September 25, 1972 r 4 62784 Councilman Dykeman asked why in the request for rezoning Hurst Addition all but twelve lots were to be "R-3" Multiple Residence District but in the Preliminary Plat all forty-six lots were platted for single family dwellings. Fred Debe reported the developers planned to develop all forty-six lots into residential, but if they found there wasn't a demand for single family dwellings, these lots could be used for multiple family dwellings, except for the twelve lots nearest to Hammond Avenue. Moved by Dykeman, seconded by Keller that the communication from the City Planning Commission, transmitting Preliminary Plat of Hurst Addition, Waterloo, Iowa, the City Engineer's report, Deed of Dedication and City Planning Commission's Resolution of Approval, and recommending approval, be received, placed on file,and Resolution No. 22184, approving said Pre- liminary Plat, be adopted. Moved by Cavanaugh, seconded by Miller that said Ordinance be recorded as having passed its second reading (the first having passed under C.R. #62740 of 9/18/72) On roll call, Cavanaugh, Dykeman, Keller, Mabrey and Miller vted Aye. Mayor declared the motion carried, 62786 m An Ordinance amending Chapter 20, Human Relations, of the City of Water- loo Code of Ordinances, by adding the words "Physical Disability" to Sections 20-30(b), 20-36(a), 20-36(b), 20-43(a), 20m43(b), 20-43(c), 20-50(a), 20-50(b) and 20-50(c) and by Defining Same in 20-1, was re d by the City Clerk. Moved by Mabrey, seconded by Cavanaugh that said Ordinance be recorded as having passed its second reading (the first having passed under C.R. #62749 of 9/18/72) On roll call, Cavanaugh, Dykeman, Keller, Mabrey and Miller voted Aye. Nay: None. Absent: Cohea and Morrissey. Mayor declared the motion carried. 62787 m Andrew O. Aasgaard, 808 Wellington Street, presented the Council with petitions of obj'.ctions to the restriction of parking on Wellington Street, reporting there was a high concentration of families on said Street, on weekends the Street provided parking for ten churches in the neighborhood, and Emerson School needed parking places for parents to pick up children on bad days. Moved by Cavanaugh, seconded by Dykeman that the bove petitions be re- ceived, placed on file and Wellington Street from West Second Street to West Fifth Street deleted from the proposed Ordin:Ince, and said proposed Ordinance amended to read Wellington Street on the north and northeast sides from West Mullan Avenue to West Second Street and Wellington Street on the north and northeast sides from West Fifth Street to R ndolph Street. September 25, 1972 5 62788 m An Ordinance amending Section 213 of Ordinance No, 2203 known as the Traffic Ordinance, by prohibiting parking on one side of certain streets, was read by the City Clerk. Moved by Dykeman, sec.nded by Miller that said Ordinance, with Wellington Street from West SeccndStreet to West Fifth Street deleted, and amended to read Wellington Street on the north and northeast :sides from West Mullan Avenue to West Second Street and Wellington Street on the north and northeast sides from West Fifth Street to Randolph Street, be re- corded as having passed its third reading (the first having passed under C,Ro#62172 of 9/11/72, the second under C0Ro#62747 of 9/18/72) and be now placed on its final adoption. On roll call, Cavanaugh, Dykeman, Keller, Mabrey and Miller voted Aye. Nay: None. Absent: Cohea and Morrissey. Mayor declared the motin carried. 62789 Moved by Keller, seconded by Dykeman that Ordinance Noo 2607, an ordin- ance amending Section 213 of Ordinance No. 2203 known as the Traffic Ord- inance, by prohibiting parking on one side of certain streets, be adopted. Mayor declared the ordinance adopted. 62790 Moved by Cavanaugh, seconded by Mabrey that Resolution Noo 22185, approv- ing the minutes of the Community Develpment Board for their regular meeting held August 8, 1972, in the City of Waterloo, Iowa, be adopted. Mayor declared the resolution adopted. 62791 Moved by Miller, seconded by Dykeman that the communication from the City Engineer, transmitting Partial Payment Estimate No, 10 Report, as sub- mitted by Brice, Petrides & Associates, Inc., Waterloo, Iowa, Consulting Engineers, as to work and materials furnished by Lunda Construction Com- p ny, ommp.=ny, Black River Falls, Wisconsin, for the construction of River Road Bridge, Westfield -Virden Urban Renewal Project R-7, Bridge Contract No. 8, in the City of Waterloo, Iowa, and recommending approval, be received, placed on file and Resolution Noo 221.86, approving the report of said firm and certifying payment accordingly, be adopted.
