REGUALR SESSION
November 6, 1972 - 7:30 P.M.
The City Council of the City of Waterloo, Iowa, met in Regular Session in the
Council Chambers of the City Hall in said City at 7:30 P.M. on November 6, 1972.
Mayor Turner in the Chair.
Present: Councilmen Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and
Morrissey.
Absent: None.
Councilman Charles Dykeman offered the invocation.

62953 - Moved by Morrissey, seconded by Cohea that the proof of publication of
the Notice of Hearing on the Issuance of $40,000.00 Sewer Improvement
Bonds of the City of Waterloo, Iowa (Special Assessments) to be issued
in anticipation of the deferred payment of assessments levied for the
Beedh Street Storm Sewer, Component 1 of the 1971 Waterloo, Iowa, Storm
Sewer Improvement Program, Components 1, 4 & 5, Contract No. 1629 be re-
ceived and placed on file.
Motion carried.
62954 - The Mayor announced that this was the time for public hearing on the
matter of the issuance of $40,000.00 Sewer Improvement Bonds, and asked
whether any written objections had been filed. No oral objections were
offered and the Clerk advised no written objections had been filed.
Moved by Miller, seconded by Dykeman that the proof of publication of the
Notice of Bond Sale for the sale of $40,000.00 Sewer Improvement Bonds
(Special Assessments) for the Beech Street Storm Sewer, Component 1 of
the 1971 Waterloo, Iowa, Storm Sewer Improvement Program, Components 1,
4 & 5, Contract No. 162, in the City of Waterloo, Iowa, be received and
placed on file

62955 - This also being the time and place for the opening of bids for the sale
of said above described bonds, the meeting was throw:open for the re-
ceipt of bids for said bonds.
Moved by Keller, seconded by Morrissey that the following sealed bids be
received, placed on file but NOT OPENED:

City Engineer, transmitting a request from Redell Walls, owner of Rede1i
Living Room Lounge, for permission to place asphalt paving on the parking
at 1428 East Fourth Street, and recommending approval subject to the pro-
visions of his letter, be received, placed on file, recommendations ap-
proved and permission granted in accordance therewith at no cost to the
City of Waterloo.

the City Engineer, transmitting the request from R. R r. Bedard for a 24°

Engineer, transmitting the request from Grace Baptist Church for permis-
sion to construct two (2) temporary asphalt driveways without regard to
sidewalk grade at 3800 Hammond Avenue, Waterloo, Iowa, together with
$3.00 in cash for recording waiver, and recommending approval subject to

proved and Resolution Neo 222439 granting permission and authorizing con
struction irrespective cf a later official grade, be adopted.

62961 Moved by Miller, seconded by Yabrey that the communication from the Asst.
City Engineer, transmitting a letter and construction plans from North-
western Bell Telephone Co. requesting approval to rebuild two (2) man-
holes, one on West Park Avenue between Commercial Street and Jefferson
Street and the other at the corner of West Fourth Street and Allen Stre-
et, and recommending approval subject to the provisions of his letter,
be received, placed on file, recommendaticns approved and permission
granted in accordance therewith.

Giese Construction Company, Inc., Eagle Grove, Iowa, for the 1972 Grading
Program #1, Contract No., 129 in the amount of $34,060050, be received,
placed on file and Reso"lition No. 22244, approving said Contract and
Bond, be adopted.

62963 - Public Works Director Culver explained the Addendum to the Agreement be-
tween the C. W. Shirey Company and the City of Waterloo for continuation
of snow removal and ice control and the advantages of not using the gar-
bage trucks to save wear and tear en them.
Councilman Dykeman asked if it would take more time to remove the snow,
Public Work, Director Culver stated it would probe bly take longer in the
beginning but the use of the present equipment would be carefully scrut-
inized to obtain more efficiency and, thereby, have more efficient snow
removal operation.
Moved by Cohea, seconded by Miller that the communication from the Direc-
tor of Public Works, transmitting four copies of an Addendum to an Agree-
ment dated 8/1/71 between C. W. Shirey Company and the City cf Waterloo,
Iowa, for the continuation of services by said Company in connection
with the City's snow and ire control program for thewinter of 1972-1973,
and recommending approval, be received, placed on file, approved and the
Mayor authorized to execute said Addendum on behalf of the City of
Waterloo, Iowa.

Engineer, transmitting a contract dated 11/6/72 between the City cf
Waterloo and Imman.uel Baptist Church cf Waterloo wherein the City offers
to purchase certain real property in Unplatted Waterloo West, W 940' E
990° M/L. of S 400' N 430' NES NE's Sec. 29 -89N -13W (.25 acres) in the Cit
of Waterloo, Iowa, for the sum of $1050.00, for 1972 Grading Program #1,

on file, approved and accepted, the Mayor and City Clerk authorized and

62965 The City Clerk and Auditor, having checked the bids submitted for the
$40,000oOG Sewer Improvement Bonds being offered for sale in connection
with the Beech Street Storm Sewer, Component 1 of the 1971.Waterloo,
Iowa, Storm Sewer Improvement Program, Components 1, 4 & 5, Contract No.,
162, referred to him by Council Action # 62956, reported that after check
ing the bids, the bid of Carleton Do Beh, Co., of Des Moines, Iowa being)
an effective interest rate of 4038197, was the best bid received.
After due consideration of the bids received, it was moved by Cavanaugh,
seconded by Morrissey that Resolution No. 22245, directing the Sale cf
$40,000°00 Sewer Improvement Bonds of Waterloo, Iowa, to Carleton D. Beh
Co. of Des Moines, Iowa for the Beech Street Storm Sewer, Component 1 of
the 1971 Waterloc, Iowa, Storm Sewer Improvement Program, Components 1,
4 & 5, Contract Nco 162, in the City of Waterloc, Iowa, be adopted.

Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the
resolution adopted.

Low Rent Housing Commission submitting minutes of their regular meeting
of October 4, 1972, be received, placed on file and Resolution No. 22246,
approving said minutes, be adopted.

Building Official as to work performed and materials furnished by Reich-
ert -Neiman, Inc., Contractors, for the Remodeling of Police Department,
Contract No. B-23, together with sub -contractors lien waivers, Contrac-
tor's Affidavit of Release of Liens, Contractor's Affidavit of Payment
of Debts and Claims, Consent of Surety Company to Final Payment, Sales
tax forms, two-year door guarantee from Calmar Manufacturing Co,, and
Certificate of Substantial Completion noting 9/18/72 as start of one year
guarantee period, and recommending approval, be received, placed cn file,
approved. and Resolution No. 22247, approving the report, accepting the
work and authorizing payment in full accordingly, be adopted.

Building Official transmitting a waiver for assessment cf cost from Vern
and Etta DeBower for the City of Waterloo to install city water service
for sanitation purposes at 1335 Calhoun Street, be received, placed on
file, approved, the Building Official instructed to secure sealed inform-
al bids, and Resolution No, 22248, ordering the installation of said city
water service at 1335 Calhoun Street, be adopted.

62969 - Moved by Dykeman, seconded by Cohea that the communication from the Di-
rector of Public Works submitting a list of City owned equipment no
longer needed, with the approximate value of each, and recommending dis-
position of same by advertising for sealed bids or, preferably, at a
public auction, be received, placed on file, recommendations approved
with the City Clerk instructed to sell said equipment at a public auction
to be held on December 2, 1972 at 10:00 A.M. at Street Department Garage,
and to publish the necessary notice.
