Councilman Charles Dykeman offered the invocation 63015 - Moved by Miller, seconded by Keller that the Agenda, as amended, for the Regular Session of November 20, 1972, at 7:30 P:M , be accepted and ap- proved Motion carried. 63016 - Moved by Cohea, seconded by Morrissey that the Minutes of the Regular Session held November 13, 1972 at 7:30 P M , be approved:. _Motion carried 63017 - Moved by Cavanaugh, seconded by Cohea that the proof of publication of the notice of public hearing to vacate an existing 60 foot easement in proposed Bethel Addition,being in part of Section 2 -88N -13W, (South of East Ridgeway Avenue between Oregon Street and Minnesota Street, if ex- tended), as fully described in the publication in the Waterloo Daily Courier on October 26 and November 2, 1972, be received and placed on file Motion carried, 63018 - The Mayor announced the time had arrived to hear objections, if any, and asked if any one present wished to be heard or make objection, or if any written objections had been filed with the Clerk. No one appeared to object orally, and the Clerk reported no written ob- jections had been filed Thereupon it was moved by Dykemanseconded by Miller that an Ordinance be drawn and submitted vacating an existing 60 foot easement in. proposed Bethel Addition, being in part. of Section 2 -88N -13W (South of East Ridge- way Avenue between Oregon Street and Minnesota Street, if extended) as fully described in the published notice in the Waterloo Daily Courier on October 26 and November 2, 1972 Motion carried 63019 - An Ordinance vacating an existing 60 foot easement in proposed Bethel Ad- dition, being in part of Section 2 -88N -13W (South of East Ridgeway Avenue between Oregon Street and Minnesota Street, if extended), in the City of Waterloo, Iowa. was read by the Clerk., Moved by Keller. seconded by Dykeman that the rules requiring ordinances to be read in full on three separate days be suspended, said Ordinance be recorded as having passed its first, second and third readings, and be now placed on its final adoption,. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye Nay: None. Absent: None:: .Mayor declared the motion carried 63020 - Moved by Morrissey, seconded by Cohea that Ordinance No. 2614, an Ordin- ance vacating an existing 60 foot easement; in proposed Bethel Addition, being in part of Section 2 -88N -13W (South of East Ridgeway Avenue between Oregon Street and Minnesota Street, if extended), in the City of Waterloo, Iowa, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the ordinance adopted. 63021 Mayor Turner recognized Mrs. George Torkelson and thirty Girl Scouts of Troop 41, Kittreli School, and also, Larry Hamilton and the American Government Class of Central High School. 63022 - Moved by Mabrey, seconded by Miller that the communication from the City Planning Commission, transmitting the request of Wirt Hoxie, Attorney, in behalf of Construction Machinery Company, for the City of Waterloo to vacate and convey a part of Wilby Street, part of Beech Street, part of North-South Alley which lies Wly of Lot 18 and Ely of Lots 1.9, 20 and 21, Wilby's Addition, lying North of Glenwood Street and West of Linden Ave- nue, as shown on the attached print and described in Exhibit "A", and recommending approval subject to the City retaining easement rights, be received, placed on file and Resolution No. 22265, fixing the time and place of hearing for vacation and conveyance of said streets and alloy, as December 11, 1972 at 7:30 P.M. in the Council Chambers in City Hall, and instructing the City Clerk to publish the Notice of Hearing as pro- vided by law, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 63023 Moved by Dykeman, seconded by Miller that the communication from the City Engineer, transmitting the request from Wendell P. Lockard for sani- tary sewer hook on at Airline Hiway from WCF & N to Burton Avenue, re- porting an estimated construction cost of $44,000, and recommending in- stallation with cost to be charged to adjacent property under the sani- tary sewer hook -on ordinance, be received, placed on file, recommenda- tions approved and the City Engineer instructed to proceed in accordance therewith. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the motion carried. 63024 - Moved by Cohea, seconded by Mabrey that the communication from the First Church of Christ, Scienti4t, 728 West Second Street, requesting that the "No parking this. side" signs restricting parking on the north side of the 300 block of Wellington Street be changed to "No parking this side ex- cept Sundays" to allow parking on Sundays only, be received, placed on file, approved and Resolution No. 22266, approving parking on Sundays only on the north side of the 300 block of Wellington Street and in- structing the Traffic Division to replace the "No Parking" sign on said street with a "No Parking except Sunday" sign, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 63025 Moved by Cohea, seconded by Miller that the communication from the City Engineer, transmitting four (4) copies of proposed Three -Year Street Construction Program for 1973, 1974 and 1975 to be submitted to Iowa November 209 1972 3 63025 - (Continued) State Highway Commission, together with letter from City Planning Commis- sion giving approval of program, be received, placed on file, said pro- gram to be reviewed and action taken thereon by Council -as -Whole on Nov- ember 27, 1972, and the City Clerk authorized to prepare Official Budget Report for the City of Waterloo, Iowa, for the Year 1973. Motion carried. 63026 - Moved by Miller, seconded by Morrissey that the communication from the City Engineer, transmitting Change Order #2 for work and materials furn- ished by Mepco, Inc., Waterloo, Iowa, Contractors, at a decrease in cost of $6,207.25 for the East High Park and Recreation Area, Stage I, Project No. Iowa OSC-39(LD), Contract No. 130, and recommending approval, be re- ceived, placed on file, approved and the Yaycr and City Clerk authorized to sign same in behalf of the City of Waterloo, Iowa. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Taller and Morrissey voted Aye. Nayo None. Absent: None. Mayor declared the motion carried. 63027 - Moved by Morrissey, seconded by Cavanaugh that the communication from the City Engineer, transmitting Charge Order #3 for a time extension of 30 calendar days to M. F. Ccerdt Construction Company, Dubuque, Iowa, Con- tractors, for the Hawkeye "tech Sanitary Sewer, Pumping Station, Component IIIA, WS -70, Contract No. 162, and recommending approval, be received, placed on file, approved and the Mayor and City Clerk authorized to sign same in behalf of the City of Waterloo, Iowa. On roll call, Cavanaugh, Cohea, Dykeman, Keller,-Mabrey, Miller and Morrissey voted Aye. Nayo None, Absent: None. Mayor declared the motion carried. 63028 - Moved by Cavanaugh, seconded by Miller that the communication from the City Engineer, transmitting Change Order #4 for a. time extension of 60 calendar days to M. F. Coerdt Construction Co., Dubuque, Iowa, Contrc- tors, for the Maywood Sewers Progran, Component i . WS -'Iowa -70, Contract No. 162, and recommending approval, be received, placed o,n file, approved and the Mayor and City Clerk authorized to sign same in behalf of the City of Waterloo, Iowa. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the motion carried. 63029 - An Ordinance amending Ordinance No. 2479, as amended, by adding Sub -Sec- tion No. 35 to Secti©n 2A-5, rezoning certain property in the City of Waterloo, Iowa, was read by the City Clerk. Moved by Dykeman, seconded by Morrissey that said Ordinance be recorded as having passed its second reading (the first having passed under C. R. #62985 of 11/13/72). On roll call, Cavanaugh, Cohe-, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None;, Absent: None. Mayor declared the motion carried. 63030 - Moved by Cohea, seconded by Morrissey that Resolution No. 22267, a reso- lution authorizing the condemnation of certain parcels of real property in the Logan Avenue Urban Renewal Area, Project Iowa R-2, be adopted. Mayor declared the resolution adopted. 63031 Moved by Cavanaugh, seconded by Cohea that Resolution No. 22268, approv- ing the minutes of the Community Development Board for their regular meeting held October 10, 1972, in the City of Waterloo, Iowa, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 63032 - Moved by Mabrey, seconded by Keller that the communication from the Com- munity Development Administrator, transmitting proposed 47Resolution es- tablishingfair market value for certain properties to be acquired in the P P q Logan Avenue Urban Renewal Area, Project Iowa R-2", be received, placed on file and Resolution No. 22269, establishing fair market value for said properties, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 63033 - Moved by Morrissey, seconded by Dykeman that the communication from the Community Development Administrator, transmitting proposed "Resolution authorizing the sale, issuance and delivery of project notes in the ag- gregate principal amount of $1,339,000 and the execution of requisition agreement No. 5-1972", be received, placed on file and Resolution No. 22270, authorizing the sale, issuance and delivery of said project notes and execution of said agreement, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 63034 - Moved by Miller, seconded by Mabrey that the communication from the Com- munity Development Administrator, transmitting proposed "Resolution es- tablishing fair reuse value for certain parcels to be disposed of in the Westfield -Virden Urban Renewal. Area, Project Iowa R-7," be received, placed on file and Resolution No. 22271, establishing said fair reuse value, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 63035 - Moved by Cohea, seconded by Dykeman that the communication from the City Engineer, transmitting Final Estimate No. 8 Report as submitted by Brice, Petrides & Associates, Inc., Engineer, Waterloo, Iowa, as to work and materials furnished by Mepco, Inc., Waterloo, Iowa, for Project Noe Iowa OSC-39 (DL), Stage 1, East High Park and Recreation Area, Contract No. 130, and recommending approval, be received, placed on file and Resolu- tion No. 22272, approving the Final Report, accepting the work and cert- ifying payment to be made in full accordingly by the Waterloo Independent School District Board, be adopted. November 20, 1972 63036 - Moved by Keller, seconded by Cohea that the communication from Henry W. Wenthe submitting his resignation as Treasurer of the City of Waterloo, effective January 1, 1973, be received, placed on file, accepted with regret and Mr. Wenthe thanked for his fourteen and one-half years of faithful service. Motion carried. 63037 - Moved by Cavanaugh, seconded by Morrissey that the following applications, bonds and fees for Beer Permits at the locations designated in the City of Waterloo, Iowa, be, and the same are hereby approved for the issuance of licenses, that the approval be endorsed en the applications artd for- warded to the Iowa Beer and Liquor Control Department with certified fee receipts, duplicate copies of the applications, etc., be received, placed on file, and Resolution No. 222739 approving the applications, be adopted: Class IIC Osco Drug, Inca dba Osco Drug Store, 214 East 4th Street Pester -Schaefer Oil Co. dba Pester Derby Quick Shop, 1415 Logan Avenue On roll call, Cavanaugh, Cohea9 Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye.
