RESOLUTION NO. 2017-593
RESOLUTION AUTHORIZING SALE AND CONVEYANCE
OF A PORTION OF EAST SAN MARNAN DRIVE RIGHT-OF-
WAY LOCATED ADJACENT TO 121-129 EAST TOWER
PARK DRIVE, TO P AND H, LLC, IN THE AMOUNT OF $1.00,
AND AUTHORIZE MAYOR AND CITY CLERK TO EXECUTE
NECESSARY DOCUMENTS.
WHEREAS, the City of Waterloo, Iowa is the owner of real property, generally located
adjacent to 121-129 East Tower Park Drive, in the City of Waterloo, Iowa, as describe below,
and
WHEREAS, an offer to purchase said certain parcels of real property in the amount of
$1.00, has been made by P and H, LLC, and
WHEREAS, a public hearing was held on July 24, 2017 at 5:30 p.m. in the Harold E.
Getty Council Chambers, City Hall, Waterloo, Iowa, as provided by law, by the Council of the
City of Waterloo, Iowa, on the proposal to sell and convey property owned by the City of
Waterloo, Iowa,to P and H, LLC, and
WHEREAS, it is the opinion of this council that said sale and conveyance should be
made as proposed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WATERLOO, IOWA, AS FOLLOWS:
1. The following described real property, generally located adjacent to 121-129 East
Tower Park Drive, as fully described in the published notice in the Waterloo Courier on July 14,
2017 is not presently needed and will not be needed in the foreseeable future for municipal
purposes and its ownership is serving no municipal purpose.
2. That the offer of P and H, LLC, to purchase real property for the sum of $1.00 is
hereby accepted for the real property described as follows:
THAT PART OF THE NORTHWEST '/4 OF SECTION 10-88-13, WATERLOO,
BLACK HAWK COUNTY, IOWA, DESCRIBED AS FOLLOWS:
BEGINNING AT THE NORTHWEST CORNER OF LOT 3, ANDERSON'S
THIRD ADDITION, WATERLOO, BLACK HAWK COUNTY, IOWA, WHICH
IS ALSO THE SOUTHERLY RIGHT-OF-WAY LINE OF E. SAN MARNAN
DRIVE; THENCE S 88°43'24" E ALONG SAID SOUTHERLY R-O-W LINE
200.00 FEET; THENCE N O1°16'36" E 20.00 FEET; THENCE N 88°43'24" W
200.00 FEET; THENCE S O1°16"36" W 20.00 FEET TO THE POINT OF
BEGINNING. THE SOUTHERLY RIGHT-OF-WAY LINE OF E. SAN
MARNAN DRIVE IS ASSUMED TO BEAR S 88043'24" E., IN THE CITY OF
WATERLOO, IOWA.
3. That the City of Waterloo, Iowa conveys said parcels of real property described above
to P and H, LLC,by deed.
4. That the Mayor and City Clerk are authorized and directed to execute said deed.

5. That the original of said deed, fully executed and acknowledged, is hereby approved
and confirmed by this Council.
6. That the City Attorney is authorized and directed to deliver said deed to P and H, LLC,
upon receipt of$1.00.
