variance to the Noise Ordinance on June 15 & 16; July 13, July 14, July 20, July

conjunction with Waterloo Bucks Summer Music Series featuring live bands as
post -game entertainment near the Party Deck, with recommendation of Police Chief
not to exceed 80dBA and music to end at 11:00 p.m. be denied.
Prior to a vote on the above motion, the following comments were heard.
Tom Jennings, Chief of Police, commented in the past, especially after 11:00
p.m., the neighbors tend to start calling in and complaining about the noise.
Councilperson Greenwood commented that the Police Chief is suggesting 11:00 p.m.
Councilperson Getty stated the reason for his motion that this request be denied
is that the phone calls and such that he has received started about a year ago
when the fireworks go after 10:00 - 10:30 p.m., he started getting phone calls
at night. Councilperson Getty commented that 10:30 - 11:00 p.m., with a band
playing and that noise goes out, up over that dike, he doesn't think they need
to be out there at that time of night.
Councilperson Kincaid asked what time are the ballgames normally over. Paul
Hutting, Leisure Services Director, responded it varies quite a bit, but Dan
Corbin, General Manager of the Waterloo Bucks, is here to answer questions.

Jack O'Day, 840 Conger, stated he has lived on Conger Street for over 25 years
and there are many like him. They get up early, go to work, and they have
raised their families in this neighborhood. There are also a lot of young
families that are also trying to raise their families in this neighborhood. Mr.
O'Day stated he sees a good neighbor as someone who respects the other's
property and privacy. The Waterloo Bucks organization seems to be taking
advantage of this situation. On Thursday, May 31, 2007, the Bucks' opening day,
their game lasted until 10:00 p.m., the fireworks lasted until 10:30 p.m., and
their live band lasted until 11:30 p.m. His son had school the next day and he
had to work. His guess is that many other families in the neighborhood had to
deal with this problem. This is not just a one-time problem, this is just a
common problem every time they shoot the fireworks or have a live band.

Consent Agenda continued
Mr. O'Day stated when he is watching TV during their live band, he has to turn
up the volume to listen to a program. Mr. O'Day explained that he has been at
Gates Park playing golf at 7:00 p.m. when they have shot their sonic boom to
start a game, and he knew where it came from, and Gates Golf Course is two miles
away. Mr. O'Day commented the council should imagine having that go off while
relaxing in their living rooms, and he doesn't think any of them would tolerate
that all summer long. Mr. O'Day stated if the council wouldn't, he doesn't'
think they should expect the people in this neighborhood to. Mr. O'Day stated
several years ago, they had to pick up pieces of fireworks that landed in their
yard and street. Mr. O'Day stated if the Bucks want to entertain the fans, they
should entertain them between innings during the course of the game. Mr. O'Day
commented lets compromise, lets only have fireworks on the 4th of July and let
the live music play from 6:00 - 7:00 p.m. before the game at a respectful noise
level. Mr. O'Day stated they are only asking the Waterloo Bucks to be a good
neighbor.

Councilperson Welper asked Mr. Corbin why would they not do this before the game
rather than after the game. Councilperson Welper stated he can appreciate the
Bucks providing a venue for these young people to play, but asked wouldn't this
be a better draw if it was before the game rather than after the game. Mr.
Corbin responded they do both. They have scheduled before and after game
concerts, from 5:30 - 6:30 p.m. and then also for an hour afterwards. Mr.
Corbin noted they ran 13 concerts last year, and neither he nor his office
received any complaints, but he doesn't know if they were directed to the police
department or not.
In answer to a question, Mr. Corbin stated they did this last year. Mr. Corbin
explained that typically the noise level for the post game concerts is no louder
than the music they play after a game through a PA system. After every home
game, win or lose, the PA announcer will say thanks for coming, wrap up the game
and tell about the promotional schedule of upcoming games, and then they play
music over the PA system for an hour or two, and people leave the park and then
they clean the ballpark. Mr. Corbin noted that the noise level from the concert
is less loud than what they play over the PA system. It shouldn't matter if
there are people actually playing music there live or if its piped in music.
Councilperson Welper asked Police Chief Tom Jennings how many complaints are we
going to have before we even shut this down. If we start getting calls, how
long are we going to let this go on. Chief Jennings responded that is the
council's call, and it can be one complaint and the police would go out.
Mr. Corbin asked where do you measure the 80dBA at. Chief Jennings responded 25
feet from the source of the sound.
A vote was taken on the motion to receive and file oral comments with the

125508 - Councilperson Greenwood stated he will vote for Mr. Getty's motion, as the At -
Large Councilman. Councilperson Greenwood stated if Mr. Getty is getting
complaints in his Ward, he will try to keep the folks over there happy, so he
will support Mr. Getty.
A vote was taken on the original motion to deny the Waterloo Buck's request with
the following result. Ayes: Six. Absent: Schmitt. Motion carried.

Hearings continued
125510 - This being the time and place of public hearing, Councilperson Welper called for
written and oral objections.
Nancy Eckert, City Clerk, reported two letters were received today regarding the
sidewalk program. We received a letter from Donald Diestler, 412 Adrian Street,
regarding 415 Courtland. Mr. Diestler is asking that the City Engineers look at
his sidewalk again and remove it from the program. He is talking about the
three pieces that are loose. There also is a letter from Wayne Billman
regarding Franklin Street. Mr. Billman does not say what property address in
Waterloo, but his concern is that the sidewalks have gotten that way because of
all the trucks that go up and down that area. Ms. Eckert noted that all council
members present received copies of the letters.
Wayne Potter, 5737 Foulk Road, stated he owns some rental property at 422 Elm
Street, and just looking at the sidewalk, the sidewalk looks pretty good, in
good condition to him. There is a crack in it, and he wondered if somebody from
the city could come and meet him at that address to explain to him why he needs
a new sidewalk there.
Eric Thorson, City Engineer, responded that he has staff at this meeting, and
after we are done with this action, he will have them meet with Mr. Potter and
set something up.

Councilperson Cole stated she has a point of clarification on the letter in the
council's packet dated June 6, 2007 that pertains to this item. This pertains
to the Planning & Zoning meeting. The letter says there were some
representatives from VGM, including Councilperson Cole, who expressed concern
with maintaining a high level of design. Councilperson Cole explained that she
would like to clarify that she was not representing VGM, she was representing
Ward 2 where this property lies.

Prior to a vote on the above motion, the following comments were heard.
Councilperson Getty stated the agreement with Black Hawk County for building
maintenance administration it bothers him that the cover letter said that
Section 2 of the document is written so that July 1 of each succeeding year, the
28E Agreement automatically renews with the appropriate cost increase.
Councilperson Getty stated he has a problem that the contract renews and it
renews every year and every year and never comes back to this council to look at
it. Councilperson Getty explained that he met earlier today with Mr. Cutwright,
and they talked because he felt that with the work Mr. Cutwright does and the
many facilities that he has, he felt that he was getting short changed in his
Third Ward. Having people out there looking at what is going on or what is
happening and getting things cleaned up that need to be cleaned up.
Councilperson Getty stated they have come to an understanding. He has some
documents that he has to get through yet, so he was happy to sit down with Mr.
Cutwright about that. Councilperson Getty stated his my main concern is to
continue to renew a contract year after year, he is just not happy with that
amendment that is in this contract with the county.
Lou Cutwright, Building Official/Maintenance Administrator, explained there is a
section in the contract that gives either party, the county or the city, the
option to discontinue the contract anytime they want for this item. So the out
is there for the city or for the county to discontinue the contract if they no
longer want to cooperate together as an entity.
Councilperson Gunderson commented that in looking at this about the automatic
cost increase, he thinks the compensation still has to come back to council
every year.
Mr. Cutwright noted that concerning the compensation, he thinks Item Number 7
lists three years at the graduated 4 percent per year of renewal, but then at
the end of that third year it would have to come back for approval of that
compensation again.

125344 - Greg McClain, 4104 Tiffany Lane, Cedar Falls, Iowa, stated he wanted to talk
about the locker room policy at the Family YMCA of Black Hawk County. The
problem is that the YMCA allows children of the opposite sex (up to age six) to
be in locker rooms with adults of the opposite sex. Mr. McClain listed the
serious concerns with this policy. 1. The locker room policy is not consistent
with Christian principals. 2. The locker room policy creates a very unsafe
environment for children. Actual occurrences are infrequent and random. 3.
The locker room policy invades the privacy, decency and modesty of adults. 4.
Some adults leave their children unattended in locker rooms. Actual incidents
have been witnessed by Y members and reported to Y officials. Some of them have
been very dangerous. 5. Some naked adults take their naked children into the
shower room with other naked adults of the opposite sex. Actual incidents have
been witnessed by Y members and reported to Y officials. Some men in the Men's
Fitness Locker Room take their daughters into the Jacuzzi with other naked men
in the Jacuzzi. Actual incidents have been witnessed, actual occurrences are
infrequent and random. Mr. McClain stated his solutions as follows: 1. Revise
the current locker room policy such that children of the opposite sex are not
allowed in locker rooms with or without a parent or guardian. 2. Revise the
policy such that naked adults are never put in a situation where they have to
let a child of the opposite sex stare at them. 3. Encourage parents and
guardians with opposite sex children (up to age six) to use the Special Needs
Locker Room to dress and undress their children. 4. Implement the YMCA of USA
Child Abuse Prevention Program. Mr. McClain listed his request to the Waterloo
City Council as follows: 1. Record his comments in the minutes of this
meeting. 2. Approve and adopt a resolution that encourages the family YMCA of
Black Hawk County to revise their locker room policy such that: a. Children of
the opposite sex are not allowed in locker rooms with or without parents or
guardians. b. Adults are never put into a situation where a child of the
opposite sex (dressed or undressed) can observe them naked. Mr. McClain
submitted his letter to be filed with the City Clerk.
Forest Dillavou, 1725 Huntington Road, stated he was a little surprised at the
council's action tonight with the Waterloo Bucks' concern. Mr. Dillavou stated
he lives at Huntington Road, which is in the middle of a triangle between where
they hold the My Waterloo Days entertainment, Sunnyside Country Club and Central
Intermediate. It sounds like a war zone lots of times in the summer and its
late at night. Mr. Dillavou stated if the council is going to do this to the
Waterloo Bucks, then maybe they better do it to these other organizations around
town. Many, many times Central Intermediate is sending off those sky busters or
whatever they are called. It rolls his wife right out of bed, but they don't
call as they figure that's part of living next to the ball stadium. They don't
call when Sunnyside does it, it is a part of their fun and organizations. And
they don't call during My Waterloo Days as they figure that's a part of being in
Waterloo. Mr. Dillavou stated he thinks that perhaps the council better rethink
what they did to the Waterloo Bucks. It has been a hard time getting them here
and it's a hard time to keep them here.
Councilperson Cole commented she would just like to share some happy news from a
happy citizen. This is a letter addressed to the council members and the name
is Amy Walser and it is highly complimentary of the children's library staff at
the Waterloo Public Library. Amy says that she is continually impressed with
their hard work and the time they spend on and off the clock. Making a trip to
the children's section as fun and inviting to kids of all ages. They decorate
for every holiday, do a wonderful job making story time a weekly treat for her
kids. They've been preparing for the summer reading program and the library
looks amazing. Amy suggests that maybe the council find a way to recognize
these women for helping to make a trip to the library such a positive
experience.
