Sunnyside South Addition, LLC; what is the status of Williston Field; and commented on the
amount paid out to Mr. Broadhead for unused benefits.
Randy Herod, 111 Hyland Boulevard, provided a list of questions to council regarding bicycle usage
in the City of Waterloo on the new bike lane on Park Avenue.

This being the time and place of public hearing, the Mayor called for written and oral comments.
Rick Westphal, 2232 Avon, thanked Planning and Zoning Commissioner Marcia Bundschen, Mr.
Morrissey, and Aric Schroeder, for their work on the ordinance. He explained that he has a neighbor
that has numerous sheep that would be in violation of the ordinance, and asked that the rules be
suspended.

regulating Urban Animal Hobby Farms (UAHF)”, be received, placed on file, considered and passed
for the first time. Roll-call vote-Ayes: Seven. Motion carried.
Mr. Schmitt requested an overview of the ordinance and he has received calls from citizens stating
that the ordinance appears to make the ordinance less restrictive.
Aric Schroeder, City Planner, provided an overview of the proposed ordinance, approval required of
surrounding neighbors for the permit, and noted that these types of ordinances vary significantly
between communities.
Mayor Hart stepped out at 5:53 p.m. and returned at 5:55 p.m.
Mr. Schmitt questioned if this will allow for more hobby farms in the community.
Aric Schroeder explained that it opens up the potential for additional hobby farms in the community
if they have the proper lot size and neighborhood support.
Mr. Schmitt commented that allowing more farm animals in town is not going to enhance the image
of Waterloo and can aggravate relationships between neighbors.

Mr. Morrissey questioned why change from 5,000 to 10,000.
Mr. Lind commented that he is trying to find a compromise.
Mr. Morrissey explained that the Planning and Zoning Commission has already considered the
suggestion of 10,000 square feet of dedicated space, but in lieu of that, chose to recommend
approval for the reduction in required space to 5,000 square feet and also lower the density of
animals from 4 to 2. He further explained that when the Planning and Zoning Commission gives a
recommendation to approve, it may require a super majority vote by council to amend the item.
Aric Schroeder commented that the zoning ordinance does provide for the Planning and Zoning
Commission to provide a recommendation on amendments and if the recommendations are not
accepted, it takes a super majority vote to pass an ordinance. Questions about whether or not this is
a minor change is not clearly defined in the ordinance. He also recommended including (u)(2)(h) in
the motion, to match the 5,000 square feet in (u)(2)(b).
Mayor Hart questioned if a super majority will be needed to make the amendment.
Noel Anderson commented that a super majority vote would only be needed if the Planning and
Zoning Commission recommends denial.
Mr. Morrissey commented this is contrary to what was previously communicated.
Aric Schroeder explained that the question is whether or not the proposed wording change is
significant enough to warrant a super majority vote.
Mr. Schmitt questioned the previous vote of the Planning and Zoning Commission on this issue.
Aric Schroeder confirmed that before the item was remanded, there was a unanimous
recommendation of approval.
Mayor Hart clarified that no super majority vote is needed.
Mr. Morrissey questioned why two weeks ago council was told a super majority was needed to make
any changes.
Dave Zellhoefer, City Attorney, explained that it would take a simple majority for the vote.

David Dreyer, 3145 W. 4th Street, commented that he is not against the transaction unless all of the
council has not seen documentation on financing.
Noel Anderson explained that council has the majority of the documentation provided in the council
packet and an additional document will be provided once this action is complete.
Forest Dillavou, 1725 Huntington Road, commented that he attended the public meeting last
Tuesday held by the developer and was shocked to learn that the convention center has not passed a
fire inspection, that FOG drain was not properly connected, and that building has not had a liquor
license for five years.
Todd Obadal, 124 Amity Drive, commented that the city is here to vote on an amendment to a
development agreement and that the public notice for the development agreement is not in order. He
further commented on issues on the lack of maintenance for the convention center.

Mr. Schmitt thanked Mr. Leslie for providing information at his public meeting and asked that the
staff explain the maintenance at the convention center.
Edwin Leslie, Leslie Hospitality, commented that the hotel had a valid liquor license, which allowed
sales of liquor at the convention center.
Pat Treloar, Fire Chief, commented that inspections have taken place at the convention center on a
yearly basis and they create a punch list of annual items that need to be completed and the city has
worked with the Building Department to work out a feasible plan to get the corrections completed.
He further commented that he would not allow the convention center to be occupied unless it is safe.
Mayor Hart commented on future plans to bring all city buildings to where they need to be.

John Roof, 1509 Commercial, commented that he has approximately 16-18 panels and asked that the
city accept the panels that are currently in place and that they will be doing further construction at
the site and would need to rip up and fix the panels a second time.
Wane Castle, Associate Engineer, explained that he has worked with Mr. Roof and can work with
him on repairing the panels that need to be fixed.
Mayor Hart clarified that the city will work with Mr. Roof on any panels that may pose a danger to
the public.
Wayne Castle commented he does not wish to remove anything from the program, but will work
with Mr. Roof and the contractors to resolve any issues with the remaining panels.
David Dreyer, 3145 W. 4th Street, questioned the divisions of the sidewalk zones.
Eric Thorson, City Engineer, explained the current zone is on the city website and a map is available
at the Engineering Department.
Mack R. Henderson, Jr., 2186 Lafayette, commented on the expense of repairing the sidewalk at his
property.
Mayor Hart stepped out at 6:43 p.m. and returned at 6:43 p.m.
Wayne Castle explained the reason for the cost and that he would work with Mr. Henderson on
getting the sidewalk cleaned and re-inspected.

DOWNTOWN WATERLOO RIVERFRONT URBAN RENEWAL AND REDEVELOPMENT
PLAN
RECITALS
A. Whereas on December 23, 1974, the City Council of the City of Waterloo, Iowa
(the “City”) adopted Ordinance No. 2723 which was amended by Resolution No.
1996-804, adopted December 16, 1996, amended by resolution 2001-394, adopted
on August 6, 2001, amended by Resolution No. 2003-225, adopted on April 7,
2003, amended by Resolution No. 2011-1109, adopted December 5, 2011,
amended by Resolution No. 2014-966, adopted November 10, 2014, and amended
by Resolution No. 2015-632, adopted August 10, 2015, determining that certain
areas located within the City are eligible and should be designated as an urban
renewal area under Iowa law, and approved and adopted the Downtown Waterloo
Riverfront Urban Renewal and Redevelopment Plan of the City of Waterloo Iowa
(the “Plan”).
B. The City desires to amend the Plan again to include new urban renewal projects
and to update related information in the Plan.
AMENDMENT
NOW THEREFORE, the Downtown Waterloo Riverfront Urban Renewal and
Redevelopment Plan, as previously amended, is hereby further amended as follows:
1. Paragraph I.G.3 is hereby stricken in its entirety and replaced with the following
new paragraph I.G.3:

THE PURPOSE OF THE PUBLIC HEARING IS TO DISCUSS AND MAKE AMENDMENTS TO
THE AMENDED AND RESTATED DOWNTOWN WATERLOO RIVERFRONT URBAN
RENEWAL AND REDEVELOPMENT PLAN, TO INCLUDE ADDITIONAL PROJECTS AND
UPDATE RELATED FINANCIAL INFORMATION.
The Amended and Restated Downtown Waterloo Riverfront Urban Renewal and Redevelopment Plan
area is an area of slum and blight and an economic development area within the meaning of Iowa Code
Section 403.17(10). Such area is appropriate for commercial and industrial enterprises and is eligible for
an urban renewal project and otherwise meets all requisites under the provisions of Iowa Code Chapter
403. The rehabilitation, conservation, development, redevelopment, or a combination of such activities,
of such area is necessary in the interest of the public health, safety or welfare of the residents of the City
of Waterloo.
The Amended and Restated Downtown Waterloo Riverfront Urban Renewal and Redevelopment Plan
was initially adopted by Ordinance No. 2723 on December 23, 1974, and amended by Resolution No.
27385 adopted in 1980, Resolution No. 1996-804 adopted December 16, 1996, Resolution No. 2001-394
adopted August 6, 2001, Resolution No. 2003-225 adopted April 7, 2003, Resolution No. 2011-1109
adopted December 5, 2011, Resolution No. 2014-966 adopted November 10, 2014, and Resolution No.
2015-632 adopted August 10, 2015. An amendment to the plan is proposed to include one or more
additional urban renewal projects and to update related financial summaries of bonding capacity, project
expenses, and funding sources. The plan area, which is not being changed by the proposed amendment to
said plan, is described as follows:

the Southbound Washington Street as now located (also known as U.S. Highway 218), thence

CONTRACT
for
2017 FALL STUMP REMOVAL PROJECT
This Contract for 2017 FALL STUMP REMOVAL PROJECT (the “Contract”) is made and entered into
on ______________________, 2017, by and between the City of Waterloo, Iowa (the “City”), and
_________________________________________________________________ (the “Contractor”).
WITNESSETH:
1. The Contractor shall furnish all supervision, technical personnel, labor, materials,
supplies and equipment to perform all work required for the Contract work as described in the
Specifications and shown on the Plans.
2. The Contract Documents shall consist of the following:

c. Instruction to Bidders
d. Signed copy of Bid
e. General Conditions
f. Specifications
g. Plans
These documents form the Contract Documents and are all fully incorporated as a part of this Contract as
if attached to this Contract or set forth in full herein.
3. The Contractor agrees to commence the work within ten (10) days after the City issues a
“Notice to Proceed” and to complete the work within the given time frame. Time is of the essence in the
performance of duties under this Contract.
4. The Contractor agrees to comply with and obey all ordinances of the City of Waterloo,
Iowa, relating to the obstruction of streets and alleys, keeping open passageways for water and traffic,
and maintaining proper and sufficient barricades with lights and signals during all hours of darkness.
5. Except as to any negligence of City, its officials, officers, employees or agents, in the
performance of any duty under this Contract, and to the extent not covered by insurance maintained by
Contractor, Contractor agrees to defend and indemnify City, its officials, officers, employees and agents,
and to hold same harmless, from and against any and all claims, demands, causes of action, losses, costs,
or liabilities whatsoever, including but limited to reasonable attorneys’ fees and expenses, arising from or
in connection with the acts or omissions of Contractor in performing the work contemplated by this
Contract.
6. Contractor shall be responsible for all damage to public or private property. If public or
private property is damaged by Contractor and is not repaired in a timely manner as determined by City,

City has the option of having the damage repaired at the Contractor’s expense, to be reimbursed to the
City or withheld from future payments to Contractor hereunder.
7. The Contractor shall have no cause of action against the City on account of delays and
prosecution of work, but if the work is delayed by the City, the Contractor may have extra time for the
completion of the job as was lost by reason of the delay caused by the City.
8. The City, at its sole discretion and without waiving any claims or rights, may allow for
partial payment for the work included on an invoice for which all services have not been delivered or
accepted. The City may withhold payment for reasons including, but not limited to, the following:
unsatisfactory job performance or progress, defective work, disputed work, failure to comply with
material provisions of the Contract, third-party claims filed or reasonable evidence that a claim will be
filed, or other reasonable cause.
9. In the event that Contractor defaults in the performance or observance of any covenant,
agreement or obligation set forth in this Contract, and if such default remains uncured for a period of
seven (7) days after notice thereof shall have been given by City to Contractor, then City may declare that
Contractor is in default hereunder and may terminate this Contract by delivery to Contractor of written
notice of termination, and/or take whatever other action at law or in equity may be necessary or desirable
to enforce the obligations and covenants of Contractor hereunder. Contractor shall be entitled to only
one such notice, and in connection with any subsequent breach then City may terminate this Contract
upon seven (7) days’ advance written notice. In the event of termination, the Contractor shall be
compensated for all services performed through termination date. No delay in enforcing the provisions
hereof as to any breach or violation shall impair, damage or waive the right of City to enforce the same or
to obtain relief against or recover for the continuation or repetition of such breach or violation or any
similar breach or violation thereof at any later time or times. In the event that City prevails against
Contractor in a suit or other enforcement action hereunder, Contractor agrees to pay the reasonable
attorneys’ fees and expenses incurred by City.
10. In addition to paragraph 7 above, this Contract may be terminated at any time, in whole
or in part, upon the mutual written agreement of the parties. City may also choose to terminate this
Contract at any time by delivering to Contractor twenty-one (21) days’ advance written notice of
termination.
11. Contractor may not assign, delegate or subcontract any of its duties hereunder without
the prior written consent of City.
12. Any notice under this Contract shall be in writing and shall be delivered in person or by
United States registered or certified mail, postage prepaid and addressed:

13. Nothing in this Contract shall, or shall be deemed or construed to, create or constitute
any joint venture, partnership, agency, employment, or any other relationship between the parties nor,

obligations of the other party or any other person. Contractor is an independent contractor.
14. This Contract shall be binding upon and inure to the benefit of the parties and the
respective successors and assigns of each.
15. In the event any provision of this Contract is held invalid, illegal, or unenforceable,
whether in whole or in part, the remaining provisions of this Contract shall not be affected thereby and
shall continue in full force and effect. If, for any reason, a court finds that any provision of this Contract
is invalid, illegal, or unenforceable as written, but that by limiting such provision it would become valid,
legal, and enforceable, then such provision shall be deemed to be written and shall be construed and
enforced as so limited.
16. This Contract, together with the Contract Documents, constitutes the entire agreement
between the parties pertaining to the subject matter hereof. This Contract may not be modified or
amended except by the mutual written agreement of the parties.
17. In consideration of the full compliance on the part of the Contractor with all the
provisions, stipulations and conditions hereof, or contained in the various instruments made a part of this
Contract by reference, and upon completion and acceptance of the work, the City agrees to pay the
Contractor:

For the Taking of Construction Bids for the
F.Y. 2018 WATERLOO BOATHOUSE ENHANCEMENTS

CONTRACT NO. 940
RECEIVING OF BIDS
Sealed proposals will be received by the City Clerk of the City of Waterloo, Iowa, at her office
in the City Hall of the said City on the 21st day of September , 2017 until 1:00 p.m. for the
construction of the F.Y. 2018 WATERLOO BOATHOUSE ENHANCEMENTS, Contract No. 940, as
described in detail in the plans and specifications now on file in the Office of the City Clerk.
OPENING OF BIDS
All proposals received will be opened in the First Floor Conference Room at City Hall, in the City
of Waterloo, Iowa, on the 21st day of September , 2017, at 1:00 p.m., and the proposals will
be acted upon at such later time and place as may then be fixed by the City Council.
PUBLIC HEARING
The Council of said City will conduct a public hearing on the proposed plans, specifications,
form of contract, and estimate of cost for the construction of the above-described
improvement project at 5:30 p.m. on September 25 , 2017 said hearing to be held in the Harold
E. Getty Council Chambers in City Hall in said City.
SCOPE OF WORK
The extent of the work involved is the reconstruction of the existing Waterloo Boathouse
parking lot at 707 Park Road, Waterloo, Iowa with hot mix asphalt paving, new recreational
trails, sidewalks, lighting, landscaping and such other work as may be incidental thereto.
BEGINNING AND COMPLETION DATES
The work under the proposed contract shall be commenced within ten (10) working days after
receipt of "Notice to Proceed" and all items shall be completed within fifty (50) working days
after issuance of the “Notice to Proceed”.
METHOD OF PAYMENT TO CONTRACTOR
The Contractor will be paid against bi-monthly estimates in cash on the basis of ninety-five
percent (95%) of the work as it is completed and materials delivered and work approved. Final
payment will be made thirty-one (31) days after completion of the work
and acceptance by the Council. Before final payment is made, vouchers showing that
all subcontractors and workmen and all persons furnishing materials have been fully paid for
such materials and labor will be required unless the City is satisfied that material, men and
laborers have been paid.
The Contractor is hereby notified that if the City does not have cash on hand to pay monthly
pay estimates, according to Chapter 384.57 of the Code of Iowa, payment may be made by

anticipatory warrants issued bearing a rate of interest not exceeding that permitted by Chapter
74A, Code of Iowa.
PLANS AND SPECIFICATIONS
Plans and Specifications governing the construction of the proposed improvements have been
prepared by Wayne Claassen Engineering & Surveying, Inc. which plans and specifications and
also the prior proceedings of the City Council referring to and defining said proposed
improvements are hereby made a part of this notice, and the proposed contract by reference
shall be executed in compliance therewith.
Plans and Specifications are available from the City of Waterloo upon the receipt of a $25.00
refundable deposit. Deposits will be refunded if the plans are returned in usable condition (i.e.
generally free of highlights, ink markings, tears, stickers, water stains and soiling) to the City of
Waterloo by the end of the 14th consecutive day after the project has been awarded. No
deposits will be refunded for any requests or plans received after the 14th consecutive day,
which includes plans returned via mail service. Plan holders are responsible for ascertaining
when the project has been awarded. . If the plan holder is the prime contractor or a
subcontractor or supplier of the prime contractor that has been awarded the project, Plans and
Specifications do not need to be returned to receive the deposit. The prime contractor must
submit a list of his subcontractors and suppliers for the City of Waterloo to verify eligibility for
the refundable deposit.
Upon award of project, the prime contractor, his subcontractors and suppliers shall be supplied
with the needed number of plans and specifications at no additional cost.
CONTRACT AWARD
A contract will be awarded to the qualified bidder submitting the lowest bid.
The City reserves the right to reject any or all bids, re-advertise for new bids, and to waive
informalities in the bids submitted that might be in the best interest of the City.
Bids may be held by the City of Waterloo, Iowa, for a period not to exceed thirty (30) days from
the day of the opening of bids for the purpose of reviewing the bids and investigating the
qualifications of bidders, prior to awarding the contract.
By virtue of statutory authority, a preference will be given to products and provisions grown
and coal produced with the State of Iowa and preference will be given to local domestic labor in
the construction of the improvement.
PROPOSALS SUBMITTED
The bidder shall submit bids on the items listed in the proposal. The bidder shall clearly write
or type the unit bid price and the bid item extension (Unit Price x Estimated Qty) in numerals on
the blanks provided. Should there be any discrepancy between the unit bid price and
extension, the City of Waterloo shall consider the unit bid price as being the valid unit bid price.

The bidder has the option to submit a computer-generated spreadsheet in lieu of the portion of
the Form of Bid or Proposal, which includes the Bid Item Number, Description, Unit, Estimated
Quantity, Unit Bid Price, Total Bid Price and Total Bid. The computer-generated spreadsheet
shall include all of the information listed in that portion of the Form of Bid or Proposal as well
as bear the signature of the Prime Contractor submitting the bid. For the bidders who submit a
computer-generated spreadsheet, the TOTAL BID (with alternates, if applicable) shall also be
indicated in the space(s) provided on the Form of Bid or Proposal.
BID SECURITY REQUIRED
All bids must be accompanied in a separate envelope by a certified or cashier's check drawn on
an Iowa bank, or a bank chartered under the laws of the United States, a certified share draft
drawn on a credit union in Iowa or chartered under the laws of the
United States, or bid bond, (on the form furnished by the City) payable to the City of Waterloo,
Iowa, in the sum of not less than five percent (5%) of the bid submitted, which certified check,
certified share draft or bid bond will be held as security that the Bidder will enter into a
Contract for the construction of the work and will furnish the required bonds, and in case the
successful Bidder shall fail or refuse to enter into the Contract and furnish the required bonds,
his bid security may be retained by said City as agreed upon liquidated damages. If bid bond is
used, it must be signed by both the Bidder and the surety or surety's agent. Signature of
surety's agent must be supported by accompanying Power of Attorney.
PERFORMANCE & PAYMENT BONDS
The successful bidder will be required to furnish a “Performance Bond” and a “Payment Bond”
within ten (10) days after forms are presented to him in an amount equal to one hundred
percent (100%) of the contract price, said bond to be issued by a responsible
surety approved by the City Council and shall guarantee the faithful performance of the
contract and the terms and conditions therein contained, and shall guarantee the
prompt payment of all materials and labor and protect and save harmless the City from claims
of any kind caused by the operations of the contractor.
MAINTENANCE BOND
Before the Contractor shall be entitled to receive final payment for work done under this
contract, it shall execute and file a bond in the penal sum of not less than 100% of the
total amount of the contract, same to be known as “Maintenance Bond,” and which bond must
be approved by the City Council, and which bond is in addition to the bond given by the
Contractor to guarantee the completion of the work.
CONTRACT COMPLIANCE PROGRAM / SUBCONTRACTING
The program proposes numerical projections regarding utilization of Minority Business
Enterprise (MBE) and Women Business Enterprise (WBE) as Subcontractors, vendors and
suppliers in the performance of Contracts awarded by the City of Waterloo, Iowa.
A goal of at least ten percent (10%) for MBE participation on all City funded construction
projects that are estimated at $50,000.00 or more. A goal of at least two percent (2%) for WBE
participation on all City funded construction projects that are estimated at $50,000.00 or more.

Any project funded in part or in total with federal funds shall follow the respective agencies
contract compliance program and goals. The
Prime Contractor shall make "good-faith efforts" to meet the Contract Compliance MBE/WBE
goals. The MBE/WBE subcontractors, suppliers or vendors must provide the Prime Contractor a
reasonably competitive price for the service being rendered or the Contractor is not required to
accept their bid.
LIQUIDATED DAMAGES
Time is an essential element of this contract. It is important that the work be diligently pursued
to completion. If the work is not completed within the specified contract period, plus
authorized extensions, the contractor shall pay to the City Liquidated Damages in
the amount of Five Hundred dollars ($500.00) per day, for each day, as further described
herein, in excess of the authorized time.
Days beyond the specified completion date for which Liquidated Damages will be charged will
be working days that the contractor does, or could have worked, from Monday through
Saturday. Sundays will be counted only if work is performed. Partial working days will be
considered as a full working day. Days not chargeable for Liquidated Damages will include rain
days, Sunday if no work is done, and legal holidays.
Working days will cease to be charged when only punch list items remain to be completed.
Punch list items do not include contract bid items or approved change/extra work orders.
When the Contractor believes the project to be substantially completed, a written notice
stating the same shall be submitted to the Engineer and a request made for a Punch List. If the
work under the Contract extends beyond the normal construction season for
such work the Contractor shall submit to the Engineer in writing a request that working days
counted toward the project be suspended until work is resumed the following construction
season.
This amount is not construed as a penalty. These damages are for the cost to the City of
providing the required additional inspection, engineering and contract administration.
PRE-CONSTRUCTION CONFERENCE
Before the work is commenced on this contract, a conference shall be held for the purpose of
discussing the contract. The conference shall be attended by the prime contractor,
subcontractors and City Officials.
RESIDENT BIDDER/NON-RESIDENT BIDDER
Attention of bidders is called to compliance with the provisions of the Resident Bidder/Non-
Resident Bidder requirements.
Each bidder submitting a bid shall execute and include with the bid, a Resident Bidder
Certification or a Non-Resident Bidder Certification in the form(s) herein provided.

West High School located at 425 E.Ridgeway Avenue is requesting permission to
hold their annual homecoming parade on Friday, September 15, 2017. The parade
assembly will start at 1:30pm in the back parking lot of West High School.
The parade will start at approximately 2:15pm and will consist of 4 floats,
West High marching band and approximately 12 other vehicles.
The parade route is as follows. The parade will exit the back parking lot of
West High School onto Easton Avenue and head east until the reach Baltimore
Street. Once on Baltimore Street the parade will head south until it reaches
Ridgeway Avenue. Once on Ridgeway Avenue the parade will head west and re-
enter into the back parking lot of West High School.
On duty School Resource Officers are to provide the route security. There
will be no police overtime for this parade. Thanks for your attention to the

what o ther c ommunities have d o ne to s timulate ho using: free lots from c ity,
T I F Distric ts , urb an revitalization areas, ro ad c o ns truc tion by c ities. After
extensive review of p ro grams and a need to try and stimulate more hous ing
s tarts in Waterlo o , the G R O W C o mmittee rec ommend ed a three year
ad o p tion o f the C LU R A fo r one and two family c o nstruc tion only. T he C ity

b y Blac k Hawk C o unty, those as s es s ments are typic ally higher than what the
p ermit valuatio n is , thus b ringing new tax revenue to the C ity o nc e the three
year ab atement is completed , which otherwis e may not have b een
cons tructed in Waterlo o witho ut the p rogram in plac e. Numbers fo r two -
family d wellings have als o pic ked up, with a to tal o f 52 two -family d wellings
b eing c o ns truc ted s ince the adoptio n o f the program.
In early 2017 s taff brought fo rth a p ro p os al to C ity C ounc il reques ting the
C L UR A be extended indefinitely. After dis c us s ions it was dec id ed that it
would be bes t to bring together the G R O W C o mmittee once again to make
a rec o mmend ation for the abatement program. T he G R O W C ommittee
d is cus s ed many optio ns fo r the ab atement inc lud ing extend ing it to 3-4 unit
res id enc e, owner o cc upant o nly residence and three to ten year timeframe
extensions . Ultimately the committee d ecid ed there was not eno ugh
s upporting evidence that a need for an abatement program was necessary fo r
three-fo ur unit res idence. T here was als o d is c us s io n o n the timeframe fo r the
ab atement program. T he c o mmittee wanted to keep a sens e of urgenc y to
b uild within the c o mmunity but als o allow fo r an extend ed period o f time fo r
d evelopers fill lo ts within their d evelopments .
T he C ommittee ultimately recommend ed a 5-year extension of the C LUR A
fo r one and two family dwellings .

DESCRIPTION:
Request Dwayne Eilers to vacate a 33’ x 106’ portion of a platted
public alley for the purpose of installing chain-link fence around
the entire property for security purposes.

USE:
The request to vacate the 33’ x 106’ dead-end portion of alley
would not appear to have a negative impact on the surrounding
neighborhood as it dead ends just past the applicant’s property.

CONDITIONS:
The request to vacate the 33’ x 106’ portion of alley would not
appear to have a negative impact on vehicular or pedestrian
traffic as this portion of alley dead-ends at the applicant’s
property.
RELATIONSHIP TO
RECREATIONAL TRAIL
PLAN:
The Cedar River Loop bike trail that runs along the levee to
north.
ZONING HISTORY
FOR SITE AND
IMMEDIATE VICINITY:
The site has been zoned “M-1” Light Industrial District since
adoption of Zoning Ordinance No. 2479 in 1969.
BUFFERS REQUIRED/
NEEDED:
The request would not require any buffering by ordinance
standards.
DRAINAGE: The proposed vacate of the alley would not have an adverse
impact on drainage in the area.
DEVELOPMENT
HISTORY:
The area consists of primarily industrial uses and it appears that
the alley was originally platted as a dead-end.
FLOODPLAIN: This area is not located within a special flood hazard area
according to the Federal Emergency Management Agency
(FEMA) Flood Insurance Rate Map.
PUBLIC /OPEN
SPACES/ SCHOOLS:
There are no schools located near the site in question. Lafayette
Park is located to the north on the north side of the Cedar River.
UTILITIES: WATER,
SANITARY SEWER,
STORM SEWER, ETC.
No utilities are known to be within the area requested to be
vacated.
RELATIONSHIP TO
COMPREHENSIVE
LAND USE PLAN:
The Future Land Use Map designates the area as Industrial, and
this request would be in compliance with such designation. The
site is located within the Primary Growth Area as designated on
the Growth Area Map within the Comprehensive Plan.
STAFF ANALYSIS –
ZONING ORDINANCE:
Staff feels that the request to vacate the 33’ x 106’ portion of alley
would not appear to be a negative impact. Staff feels that the

area is not needed for city purposes and will not appear to
negatively impact the area in question. The vacation of a portion
of the alley that is currently being utilized will continue to allow an
existing business to continue its operations in the City of
Waterloo. The current city policy does not allow for the creation
of dead-end segments of right-of-way, but the alley in question is
already a dead-end and the request will only shorten the length
of the of the dead-end alley.
The City of Waterloo ordinance requires that all property owners
with property abutting the area requested to be vacated be
offered the opportunity to purchase there half of the alley. The
applicant submitted a form signed by Ray Mount Towing stating
that they did not wish to purchase their portion of the alley. In
2013 R&M Metals purchased the dead end portion of alley
directly to the east. This request would extend the vacated
portion of alleyway.
STAFF ANALYSIS –
SUBDIVISION
ORDINANCE:
There would be no platting required in relation to the request.

RECOMMENDATION:
Therefore, staff recommends the request by Dwayne Eilers
to vacate a 33’ x 106’ portion of a platted public alley in
Block 14 of Hayes Addition, located adjacent to 2014 Black
Hawk Street be approved for the following reasons:
1. The request to vacate would not appear to have a negative
impact on the surrounding area
2. The request to vacate would not appear to have a negative
impact on vehicular or pedestrian traffic in the area.
3. The request to vacate is in accordance with the
Comprehensive Plan and Future Land Use Map for this area
4. The request would appear to meet the requirements of the
Zoning Ordinance.
5. The request to vacate will allow an existing business to
continue its operations in an efficient manner in the City of
Waterloo, and the existing dead-end alley would just be
shortened.
